قضت محكمة القاهرة الاقتصادية، اليوم (السبت)، بحبس الإعلامية مصممة الديكور المصرية مها الصغير، طليقة الفنان أحمد السقا، لمدة شهر مع إيقاف التنفيذ، وتغريمها 10 آلاف جنيه، بعد إدانتها في قضية انتهاك حقوق الملكية الفكرية لأعمال فنية تعود لفنانين أوروبيين، من بينهم فنانة دنماركية.
بداية الواقعة
تعود تفاصيل القضية إلى حلقة تلفزيونية أُذيعت في يونيو الماضي ضمن برنامج «معكم منى الشاذلي» على قناة ON، ظهرت خلالها مها الصغير وهي تعرض عدداً من اللوحات الفنية، مؤكدة أنها من إبداعها الشخصي.
اكتشاف السرقة
عقب بث الحلقة، أعلنت الفنانة الدنماركية ليزا لاش نيلسون أن إحدى اللوحات المعروضة، وتحمل عنوان «صنعت لنفسي بعض الأجنحة» (I Made Myself Some Wings)، هي عملها الأصلي الذي أنجزته عام 2019.
اتهام صريح
وأكدت نيلسون، عبر حسابها على «إنستغرام»، أن اللوحة المعروضة نسخة مطابقة تماماً لعملها الأصلي دون أي تعديل أو إعادة رسم، مشيرة إلى أن عرضها تم دون إذن مسبق، ما يمثل انتهاكاً واضحاً لحقوق الملكية الفكرية.
فنانون آخرون
ولم تقتصر الاتهامات على الفنانة الدنماركية، إذ انضم فنانون من فرنسا وألمانيا إلى القضية، مؤكدين تعرض أعمالهم الفنية للعرض والنسب دون إذن أو إشارة إلى أصحابها الأصليين.
تحرك رسمي
وعلى خلفية البلاغات، أحالت الجهات المختصة القضية إلى النيابة العامة، بعد تحقيقات شملت المجلس الأعلى لتنظيم الإعلام، الذي سبق أن قرر منع مها الصغير من الظهور الإعلامي لمدة 6 أشهر، قبل إحالة الملف إلى المحكمة الاقتصادية.
سند قانوني
واستندت المحكمة في حكمها إلى قانون حماية الملكية الفكرية رقم 82 لسنة 2002، الذي يجرم نشر أو عرض المصنفات الفنية دون موافقة أصحاب الحقوق، ويقر عقوبات بالحبس والغرامة.
جدل واسع
ويأتي الحكم في ظل جدل إعلامي وشعبي واسع أثاره الظهور التلفزيوني، خصوصاً مع تزامنه مع الأنباء المتداولة حول انفصال مها الصغير عن الفنان أحمد السقا.
The Economic Court of Cairo ruled today (Saturday) to imprison the media personality and Egyptian interior designer Maha El-Saghir, the ex-wife of artist Ahmed El-Sakka, for one month with a suspended sentence, and fined her 10,000 Egyptian pounds, after she was convicted in a case of violating the intellectual property rights of artistic works belonging to European artists, including a Danish artist.
The Beginning of the Incident
The details of the case date back to a television episode aired last June as part of the program "With You Mona El-Shazly" on ON channel, during which Maha El-Saghir appeared showcasing several artworks, claiming they were her personal creations.
Discovery of the Theft
After the episode aired, Danish artist Lisa Lush Nielsen announced that one of the displayed paintings, titled "I Made Myself Some Wings," was her original work completed in 2019.
Explicit Accusation
Nielsen confirmed via her Instagram account that the displayed painting is an exact copy of her original work without any modifications or redrawing, noting that its display was done without prior permission, which constitutes a clear violation of intellectual property rights.
Other Artists
The accusations were not limited to the Danish artist, as artists from France and Germany joined the case, confirming that their artworks were exhibited and attributed without permission or acknowledgment of their original creators.
Official Action
In light of the complaints, the relevant authorities referred the case to the public prosecution after investigations that included the Supreme Council for Media Regulation, which had previously decided to ban Maha El-Saghir from media appearances for six months before referring the file to the Economic Court.
Legal Basis
The court based its ruling on the Intellectual Property Protection Law No. 82 of 2002, which criminalizes the publication or display of artistic works without the consent of the rights holders and stipulates penalties of imprisonment and fines.
Widespread Controversy
The ruling comes amid widespread media and public controversy sparked by the television appearance, especially as it coincides with circulating news about Maha El-Saghir's separation from artist Ahmed El-Sakka.
