كشفت صحيفة واشنطن بوست الأمريكية أن طالباً فلسطينياً بجامعة كولومبيا يدعى «محمود خليل» رفع دعوى قضائية ضد إدارة الرئيس الأمريكي دونالد ترمب الخميس، مطالباً بتعويض قدره 20 مليون دولار؛ بسبب احتجازه لأكثر من 100 يوم في مركز احتجاز تابع لدائرة الهجرة والجمارك الأمريكية (ICE).

ووفقاً للصحيفة الأمريكية، يتهم الطالب الفلسطيني الإدارة الأمريكية بـ«الاحتجاز الباطل» و«الإجراءات القضائية الكيدية»، معتبراً أن اعتقاله كان انتقامياً بسبب نشاطه المؤيد للقضية الفلسطينية خلال احتجاجات جامعية ضد الحرب الإسرائيلية في غزة. وتعد تلك الدعوى مقدمة لقضية فيدرالية بموجب قانون المطالبات المدنية الفيدرالية، تستهدف وزارة الأمن الداخلي، ودائرة الهجرة والجمارك، ووزارة الخارجية.
وفي 8 مارس الماضي، ألقي القبض على محمود خليل، البالغ من العمر 30 عاماً، في شقته بنيويورك، أمام زوجته الحامل آنذاك نور عبد الله، من قبل عملاء فيدراليين بملابس مدنية دون تقديم مذكرة توقيف، وتم نقله إلى مركز احتجاز في نيوجيرسي، ثم إلى لويزيانا، حيث قضى 104 أيام في الحجز دون توجيه تهم رسمية.
وخلال فترة احتجازه فاتته ولادة ابنه «دين»، وتخرجه في جامعة كولومبيا، حتى أمر القاضي الفيدرالي جيسي فورمان بالإفراج عنه في 20 يونيو، معتبراً أن محاولة ترحيله بناءً على آرائه السياسية قد تكون غير دستورية. وتتهم الدعوى الإدارة الأمريكية بالسعي لـ«ترهيب خليل وعائلته» من خلال استهدافه بسبب دوره البارز في تنظيم احتجاجات مؤيدة لفلسطين في جامعة كولومبيا.
وأعلن محامو الطالب الفلسطيني أنهم أقاموا الدعوى ضد وزارة الخارجية ووزارة الأمن الداخلي في إدارة ترمب بموجب قانون يلزم بطلب تعويضات مباشرة من الحكومة قبل التمكن من رفع دعوى تعويضات قضائية، ويتاح للمسؤولين 6 أشهر للرد. ووصف متحدث باسم وزارة الأمن الداخلي مطالبة خليل بأنها «غريبة»، وقال إن إدارة ترمب تصرفت بما يقع ضمن نطاق سلطتها القانونية لاحتجاز خليل.

وتتهم الدعوى إدارة ترمب بانتهاك حقوق الشاب الفلسطيني بموجب التعديلين الأول والخامس من الدستور الأمريكي، اللذين يحميان حرية التعبير وحقوق الإجراءات القانونية، حيث أثارت القضية جدلاً واسعاً حول حرية التعبير في الجامعات الأمريكية، حيث انتقدت منظمات حقوقية، مثل الاتحاد الأمريكي للحريات المدنية، الاعتقالات باعتبارها محاولة لقمع النشاط السياسي، في حين ردت وزارة الأمن الداخلي على الدعوى واصفة إياها بـ«السخيفة»، مدعية أن تصرفات خليل شكلت تهديداً للطلاب اليهود، بينما أكدت وزارة الخارجية أن إجراءاتها قانونية.
وفي مقابلة له مع وكالة «أسوشيتد برس»، قال خليل إنه يسعى لمحاسبة إدارة ترمب على احتجازه، وعلى «الأثر المخيف الذي خلفته هذه الإجراءات على المجتمع، وعلى المجموعة الداعمة لفلسطين، وعلى الطلاب عموماً، وعلى الشعب الأمريكي أيضاً»، معرباً عن أمله في أن يشكل «رادعاً للإدارة».

According to the American newspaper, the Palestinian student accuses the U.S. administration of "wrongful detention" and "frivolous legal proceedings," considering that his arrest was retaliatory due to his pro-Palestinian activism during university protests against the Israeli war in Gaza. This lawsuit is a precursor to a federal case under the Federal Tort Claims Act, targeting the Department of Homeland Security, ICE, and the State Department.
On March 8, Mahmoud Khalil, 30 years old, was arrested in his apartment in New York in front of his then-pregnant wife Noor Abdullah by federal agents in plain clothes without presenting an arrest warrant. He was transferred to a detention center in New Jersey and then to Louisiana, where he spent 104 days in custody without being formally charged.
During his detention, he missed the birth of his son "Deen" and his graduation from Columbia University until federal judge Jesse Forman ordered his release on June 20, considering that the attempt to deport him based on his political views could be unconstitutional. The lawsuit accuses the U.S. administration of seeking to "intimidate Khalil and his family" by targeting him for his prominent role in organizing pro-Palestine protests at Columbia University.
Lawyers for the Palestinian student announced that they filed the lawsuit against the State Department and the Department of Homeland Security in the Trump administration under a law that requires direct compensation requests from the government before being able to file a tort claim, giving officials six months to respond. A spokesperson for the Department of Homeland Security described Khalil's claim as "strange," stating that the Trump administration acted within its legal authority to detain Khalil.

The lawsuit accuses the Trump administration of violating the rights of the young Palestinian under the First and Fifth Amendments of the U.S. Constitution, which protect freedom of expression and due process rights. The case has sparked widespread debate about freedom of expression at American universities, with human rights organizations, such as the American Civil Liberties Union, criticizing the arrests as an attempt to suppress political activism, while the Department of Homeland Security responded to the lawsuit, calling it "absurd," claiming that Khalil's actions posed a threat to Jewish students, while the State Department affirmed that its actions were legal.
In an interview with the Associated Press, Khalil stated that he seeks to hold the Trump administration accountable for his detention and for "the chilling effect that these actions have had on the community, on the pro-Palestine group, on students in general, and on the American people as well," expressing hope that it would serve as a "deterrent to the administration."
