أصدرت الهيئة العامة للأوقاف لائحة إنشاء الأوقاف أو تمويلها من خلال جمع التبرعات، وذلك بموجب قرار مجلس إدارتها، لتكون إطاراً تنظيمياً يعزز الشفافية والحوكمة في إدارة عمليات جمع التبرعات المخصصة للأوقاف، سواء لإنشاء أوقاف جديدة أو لدعم وتنمية الأوقاف القائمة.
وتهدف اللائحة إلى تمكين إنشاء الأوقاف الجديدة، أو تمويل الأوقاف القائمة، من خلال جمع التبرعات وفق ضوابط محددة، بما يسهم في استدامتها وتنميتها وتوجيه مواردها نحو مصارف البر والنفع العام داخل المملكة، بما يتوافق مع أحكام الشريعة الإسلامية والأنظمة المرعية.
وتتضمن اللائحة آليات واضحة لتقديم طلبات الترخيص لإنشاء الأوقاف من خلال جمع التبرعات، وشروط مقدم الطلب، وضوابط المصارف الوقفية، إضافةً إلى المدد الزمنية المحددة لإصدار التراخيص والبت فيها، والتزامات المرخص له، يشار إلى أن اللائحة اشترطت فتح حساب بنكي مخصص لكل عملية جمع تبرعات لضمان الشفافية المالية.

The General Authority for Awqaf has issued a regulation for the establishment of endowments or their funding through fundraising, based on a decision by its Board of Directors, to serve as a regulatory framework that enhances transparency and governance in managing the fundraising operations designated for endowments, whether for establishing new endowments or for supporting and developing existing ones.
The regulation aims to enable the establishment of new endowments or the funding of existing ones through fundraising according to specific controls, contributing to their sustainability and development, and directing their resources towards charitable and public benefit purposes within the Kingdom, in accordance with the provisions of Islamic law and applicable regulations.
The regulation includes clear mechanisms for submitting license applications for establishing endowments through fundraising, the conditions for the applicant, and the controls for endowment expenditures, in addition to the specified timeframes for issuing and deciding on licenses, and the obligations of the licensee. It is noted that the regulation requires the opening of a dedicated bank account for each fundraising operation to ensure financial transparency.
Licensees are obligated to submit periodic reports to the authority and document all related operations, enabling the authority to issue a completion certificate after verifying compliance with the spending conditions for establishing endowments and executing the specified purposes.
