كشف برنامج الضمان الاجتماعي آلية التعامل مع مَن صرف له معاش الضمان الاجتماعي وثبت من خلال المتابعة أنه غير مستحق، وإيقاف صرف المعاش المخالف، ومطالبة المستفيد باسترداد ما صرف له دون وجه حق وإحالته للجهة المختصة لمتابعة الإجراءات النظامية، وذلك بحسب ما جاء بدليل الأسئلة الشائعة لبرنامج الضمان الاجتماعي.
وأكدت النيابة العامة في منشور لها على منصة «إكس» أنه يُحظر ممارسة أي أساليب احتيالية بقصد الحصول على معاش الضمان الاجتماعي دون وجه حق، كما يُحظر عدم صرف المعاش على التابعين من أفراد الأسرة؛ تعزيزاً لفاعلية معالجة الحالات الأكثر احتياجاً بالمجتمع، وضماناً لتلبية وصول الاحتياجات الأساسية لكل مستفيد ورعاية تابعيه منها.
أساليب احتيالية
وحذرت المحامية نسرين علي الغامدي من ممارسة أي أساليب احتيالية بقصد الحصول على «معاش الضمان». وقالت: «العقوبة المقررة في حال ثبوت الإدانة تصل للسجن مدة عام ودفع غرامة مالية قدرها 10 آلاف ريال، فضلاً عن الحكم على من يثبت إدانته برد ذلك المال، والهدف الرئيسي لتطبيق نظام الضمان الاجتماعي هو توفير الدعم المالي للفئات المستحقة فعلياً لذلك الدعم، حيث وضعت شروطاً محددة لمن ينطبق عليه الشروط الخاصة بالاستحقاق لتلقي معاش الضمان الاجتماعي، لا بد من توافرها في من يستحق الدعم».
وأضافت: «أما في حالة التلاعب في الأوراق أو البيانات بغير حق فإن عقاب مستفيدي الضمان الاجتماعي يكون ما بين السجن والغرامة، وهو النظام الذي يهدف لحماية المجتمع ومنح كل ذي حق حقه، ويتم الحكم عليه بضرورة رد المال الذي أخذه من الضمان بالكامل، وحدد برنامج الضمان الاجتماعي معايير عائل الأسرة، وفق عدة معايير تتعلق بالمسؤولية والدخل».
الفئات الأكثر احتياجاً
ووفقاً للضمان الاجتماعي يهدف الضمان إلى تقديم الدعم للفئات الأكثر احتياجاً، بغض النظر عن النوع أو الحالة الاجتماعية إذا تحققت شروط ومعايير الاستحقاق، وتطلب الأسرة المعنية تسمية العائل من بين أفرادها، ويكلف الباحث الاجتماعي بزيارة المسكن، وتقصي الحالة، ورفع تقرير بتوصياته إلى الوزارة بناءً على ما يتوصل إليه من معلومات، وتحدد الوزارة العائل استناداً إلى قرار أغلبية أفراد الأسرة، مع الأخذ في الاعتبار الحالة المعيشية، الوضع الوظيفي، مستوى الدخل لكل فرد، ويحق لأفراد الأسرة التظلم من قرار الوزارة أمام اللجنة المختصة.
تسجيل البيانات
وبعد اكتمال تسجيل بيانات مقدم الطلب للاستفادة من معاش الضمان الاجتماعي، يتم إجراء الزيارة الميدانية من قبل الباحث للتحقق من البيانات المسجلة، وأوضح الحساب الرسمي للضمان الاجتماعي آلية دراسة طلب الاستحقاق؛ وهي التحقق من بيانات مقدم الطلب سواءً كان (مستقلاً أو أسرة) من خلال الربط الإلكتروني مع الجهات ذات العلاقة. وزيارة المسكن وذلك بعد التأكد من صحة واكتمال البيانات المدخلة في النظام الإلكتروني، ثم دراسة الاستحقاق بناءً على المعلومات والبيانات التي تم جمعها من الجهات ذات العلاقة، وبتم إبلاغ مقدم الطلب بنتيجة الطلب (قبول أو رفض) مع توضيح السبب.
The social security program revealed the mechanism for dealing with those who have received social security benefits but have been found, through follow-up, to be ineligible. It involves stopping the disbursement of the incorrect benefits, demanding that the beneficiary return what was received without justification, and referring them to the relevant authority to follow up on the legal procedures, as stated in the FAQ guide for the social security program.
The Public Prosecution confirmed in a post on the "X" platform that any fraudulent methods aimed at obtaining social security benefits without justification are prohibited. It is also prohibited to withhold benefits from dependents within the family; this is to enhance the effectiveness of addressing the most needy cases in society and to ensure that the basic needs of every beneficiary and their dependents are met.
Fraudulent Methods
Lawyer Nasreen Ali Al-Ghamdi warned against practicing any fraudulent methods aimed at obtaining the "social security pension." She stated: "The penalty for proven conviction can reach up to one year in prison and a fine of 10,000 riyals, in addition to ordering anyone found guilty to repay the money received. The main objective of implementing the social security system is to provide financial support to those who are genuinely entitled to that support, as specific conditions have been set for those who qualify for social security benefits, which must be met by those deserving of assistance."
She added: "In cases of manipulation of documents or data unjustly, the punishment for social security beneficiaries can range from imprisonment to fines. This system aims to protect society and ensure that everyone receives their rightful due, and it is mandated that the money taken from social security be fully repaid. The social security program has defined criteria for the head of the household based on several factors related to responsibility and income."
Most Needy Groups
According to social security, the program aims to provide support to the most needy groups, regardless of gender or social status, if the eligibility conditions and criteria are met. The concerned family is required to designate the head of the household from among its members, and a social researcher is tasked with visiting the residence, assessing the situation, and submitting a report with recommendations to the ministry based on the information gathered. The ministry determines the head of the household based on the majority decision of family members, taking into account the living conditions, employment status, and income level of each individual, and family members have the right to appeal the ministry's decision before the relevant committee.
Data Registration
After completing the registration of the applicant's data to benefit from the social security pension, a field visit is conducted by the researcher to verify the registered data. The official social security account clarified the mechanism for studying the eligibility request; it involves verifying the applicant's data, whether (independent or family), through electronic linkage with relevant authorities. A visit to the residence is conducted after ensuring the accuracy and completeness of the data entered into the electronic system, followed by studying the eligibility based on the information and data collected from relevant authorities. The applicant is then informed of the outcome of the request (acceptance or rejection) along with the reason.
