متهورون أحالوا سياراتهم إلى أدوات قتل وتعدٍّ على حياة الأبرياء، باستعجالهم ورعونتهم ورغبتهم في الوصول الى مبتغاهم قبل غيرهم، بقيادة متهورة تفوق الحد المسموح به في الطرق والشوارع، وتنفيذ مناورات خطرة، وتغيير المسارات فجأة، وتجاوزات غير آمنة، وعدم ترك مسافات آمنة، فضلاً عن الاستخدام الخاطئ للأنوار، ما يعرضهم والآخرين للحوادث وخطر الإصابة أو الموت.
هذه التصرفات المتهورة تصل إلى حدّ تصنيفها جريمة متعمدة لإيذاء الآخرين، لأن أصحابها أحالوا السيارات التي خُصصت للراحة والتنقل الآمن، إلى أداة لاستعراض التهور، والمناورة أمام المركبات الأخرى بأسلوب خطر، كاسراً النظام حتى إن وصل به الحد إلى التجاوز خارج الخط الأصفر؛ لأنه لا يطيق دقائق الانتظار ويريد طريقاً فسيحاً يسير فيه لوحده، حتى إن بعضهم يصر على أن يفسح له الجميع الطريق مهما كانت ظروف السير، وإن لم يحصل على هدفه ومبتغاه احتك بالسيارة التي أمامه أو التي بجانبه، المهم أن يتجاوز الجميع.. هؤلاء جناة ومجرمون في حق أنفسهم وفي حق الآخرين وفي حق مجتمعهم.
لهذا سنّت إدارة المرور أنظمة لتعزيز السلامة المرورية، وكبح السلوكيات الخطرة على الطرق، والحد من وقوع الحوادث المُرورية، وإلحاق الضرر بالأفراد والمُمتلكات.
التباهي بالمغامرة والرعونة الغريب في الأمر قيام البعض بنشر تلك التصرفات الخطرة على منصات التواصل والتباهي بها، كأنهم يتباهون بتعريض حياة الآخرين للخطر. وفي الحقيقة أن ذلك دليل إدانة بحقه، فأنظمة المرور أوضحت الحالات التي يُعد فيها مرتكب الحادث المروري متعدياً أو مفرطاً، وتضمنتها «المادة 62»، فالمتسبب في الحادث المروري يُعد متعدياً في حال نتجت عنه إصابة في الحالات التالية: التفحيط، القيادة تحت تأثير المسكر أو عقارات تؤثر على القيادة، تجاوز الإشارة الحمراء، القيادة عكس حركة السير، تجاوز السرعة المحددة.
فيما يُعد المتسبب في الحادث المروري مفرطاً، في حال نتج عن الحادث إصابة مدة الشفاء منها 15 يوماً فأقل، في حالات عدم أخذه الاحتياطات اللازمة عند إيقاف المركبة في حالات الطوارئ على الطرق العامة، أو عدم تغطية وتثبيت الحمولة المنقولة، أو الانشغال عن الطريق أثناء القيادة، أو عدم إبعاد الحيوانات المسؤول عنها عن حرم الطريق.
إحالة المغامر إلى المحكمة
نصّت (المادة 62) على معاقبة كل من ارتكب حادثاً مرورياً متعدياً أو مفرطاً ونتجت عنه وفاة أو زوال عضو أو تعطيل منفعة أو جزء منهما، بالسجن لمدة لا تتعدى أربع سنوات، وغرامة لا تزيد على 200 ألف ريال، أو بإحدى العقوبتين، دون الإخلال بما تقرر للحق الخاص.
ويُعاقب من ارتكب حادثاً متعدياً أو مفرطاً ونتجت عنه إصابة تزيد مدة الشفاء منها على 15 يوماً، بالسجن مدة لا تتعدى سنتين، وغرامة لا تزيد على 100 ألف ريال، أو بإحدى العقوبتين، دون الإخلال بما تقرر للحق الخاص.
وفي ما عدا ما سبق ذكره من حوادث وعقوباتها، يُحال من ارتكب حادثاً متعدياً أو مفرطاً إلى المحكمة المختصة للنظر في تقرير العقوبة المناسبة بحقه، دون الإخلال بما تقرر للحق الخاص.
كيف تعرف السائق المتهور؟
مدير مرور جدة السابق اللواء محمد حسن القحطاني قال لـ«عكاظ»: إن القيادة المتهورة تؤثر على جميع السائقين على الطريق، فقد لا يدرك المتهور مدى خطورة ما يقوم به، ولا يعلم كيف يُسيطر على سلوكه.
وبيّن اللواء القحطاني أن علامات القيادة المتهورة تشمل تجاوز السرعة المُقررة، والانحراف عن الحارة المرورية بشكل خاطئ ودون استخدام الإشارات الضوئية، وتعمد عدم ترك مسافة آمنة بين المركبات، والالتصاق بالمركبات الأخرى ومزاحمتها، واستخدام آلة التنبيه دون مُبرر، والاستخدام الخاطئ للأضواء، والتوقف بغير سبب، أو الاستخدام العنيف للمكابح.
وقدّم اللواء القحطاني جملة من الإرشادات؛ من أهمها الحرص على وجود مسافة آمنة عند قيادة المركبة، والقيادة بهدوء، وعدم مجاراة تصرفات وأفعال السائق المتهور، والالتزام بالأنظمة المرورية وعدم مخالفتها.
آلاف غرامة المراوغة
فرضت الإدارة العامة للمرور، غرامة مخالفة على المراوغة بين المركبات. وقالت عبر منصة (إكس)، إن المراوغة بين المركبات مخالفة غرامتها المالية 3000- 6000 ريال، ونبهت الى أن المُراوغة بين المركبات تُفقد السيطرة على المركبة وتتسبب في حوادِث فُجائية.
وأكد المحامي والمستشار القانوني عبيد بن أحمد العيافي، أن كُل من ارتكب حادثاً مرورياً متعدياً أو مفرطاً نتجت عنه وفاة أو زوال عضو أو تعطيل منفعته أو جزء منهما، يُعاقب بالسجن مدة تصل إلى أربع سنوات، وبغرامة تصل إلى 200 ألف ريال، أو بإحداهما، دون إخلال بما يتقرر للحق الخاص.
وبيّن أن نظام المرور أوضح عقوبات تَعمُّد الحوادث المرورية ضد الآخرين، اذ قد تصل للسجن 4 سنوات وغرامة 200 ألف ريال، وينتج عنها شقان لكلٍّ عقوبته، وتتضمن الحق العام للدولة والحق الخاص للمتضرر. مضيفاً أن العقوبة تكون على فئتين؛ الأولى تختص بالحادث الذي نتجت عنه إصابة بليغة، وتصل فيها مدة الشفاء إلى 15 يوماً أو أكثر، وعليها غرامة مالية بما لا يزيد على 100 ألف ريال، أو السجن بما لا يتجاوز السنتين، أو بالعقوبتين معاً، والثانية أن يتسبب الحادث المروري في وفاة المصاب أو فقده أحد أعضائه، وتصل العقوبة في هذه الحالة للسجن أربع سنوات، والغرامة المالية لـ200 ألف ريال، أو بهما معا.
العيافي شدد على أنه يحال كل من ارتكب حادثاً مروريّاً متعدياً أو مفرطاً إلى المحكمة المختصة للنظر في تقرير العقوبة المناسبة بحقه، دون إخلال بما يتقرر للحق الخاص، وتحدد اللائحة حالات التعدي والتفريط.
ونصت «المادة الـ60» على أن الحادث المروري يعد موجباً للمسئولية إذا نتج عن الإهمال، أو قلة الاحتراز، أو عدم مراعاة الأنظمة.

Reckless individuals have turned their cars into tools of killing and aggression against the lives of innocents, due to their haste, recklessness, and desire to reach their goals before others. They drive recklessly, exceeding the speed limit on roads and streets, executing dangerous maneuvers, suddenly changing lanes, making unsafe overtakes, and failing to leave safe distances, in addition to the improper use of lights, which exposes them and others to accidents and the risk of injury or death.
These reckless behaviors reach the point of being classified as a deliberate crime to harm others, as their owners have transformed vehicles, which were designated for comfort and safe transportation, into a means of showcasing recklessness and maneuvering dangerously in front of other vehicles, breaking the rules even to the extent of overtaking outside the yellow line; because they cannot bear a few minutes of waiting and want a spacious road to drive alone, even insisting that everyone clears the way for them regardless of traffic conditions. If they do not achieve their goal, they will collide with the car in front of them or beside them; the important thing is to overtake everyone... These are offenders and criminals against themselves, others, and their community.
For this reason, the traffic department has enacted regulations to enhance road safety, curb dangerous behaviors on the roads, and reduce traffic accidents, as well as harm to individuals and property.
The flaunting of reckless adventure is strange, as some individuals publish these dangerous behaviors on social media and boast about them, as if they are proud of endangering the lives of others. In reality, this serves as evidence against them, as traffic regulations clarify the situations in which the perpetrator of a traffic accident is considered to be reckless or negligent, as outlined in "Article 62." The cause of the traffic accident is considered reckless if it results in injury in the following cases: drifting, driving under the influence of alcohol or drugs that affect driving, running a red light, driving against the flow of traffic, and exceeding the speed limit.
Meanwhile, the cause of the traffic accident is considered negligent if the accident results in an injury with a recovery period of 15 days or less, in cases where they did not take necessary precautions when stopping the vehicle in emergencies on public roads, or did not cover and secure the transported load, or were distracted from the road while driving, or did not keep animals they are responsible for away from the road.
Referring the adventurer to court
Article 62 stipulates that anyone who commits a traffic accident that is reckless or negligent, resulting in death or loss of a limb or disabling a benefit or part thereof, shall be punished with imprisonment for a period not exceeding four years, and a fine not exceeding 200,000 riyals, or one of the two penalties, without prejudice to what is decided for private rights.
Anyone who commits a reckless or negligent traffic accident resulting in an injury with a recovery period of more than 15 days shall be punished with imprisonment for a period not exceeding two years, and a fine not exceeding 100,000 riyals, or one of the two penalties, without prejudice to what is decided for private rights.
Aside from the aforementioned accidents and their penalties, anyone who commits a reckless or negligent accident shall be referred to the competent court to consider determining the appropriate penalty against them, without prejudice to what is decided for private rights.
How to identify a reckless driver?
The former Director of Traffic in Jeddah, Major General Muhammad Hassan Al-Qahtani, said to "Okaz": Reckless driving affects all drivers on the road; the reckless driver may not realize the danger of their actions and may not know how to control their behavior.
Major General Al-Qahtani indicated that signs of reckless driving include exceeding the set speed limit, swerving out of the lane incorrectly and without using turn signals, intentionally not leaving a safe distance between vehicles, tailgating other vehicles and crowding them, using the horn without justification, improper use of lights, stopping without reason, or using the brakes aggressively.
Major General Al-Qahtani provided a number of guidelines, the most important of which are to ensure a safe distance when driving, to drive calmly, not to imitate the actions of reckless drivers, and to adhere to traffic regulations and not to violate them.
Thousands in fines for weaving
The General Traffic Department has imposed a fine for weaving between vehicles. It stated via the platform (X) that weaving between vehicles is a violation with a financial penalty of 3,000 - 6,000 riyals, and warned that weaving between vehicles can lead to loss of control over the vehicle and cause sudden accidents.
Lawyer and legal advisor Ubaid bin Ahmad Al-Ayafi confirmed that anyone who commits a reckless or negligent traffic accident resulting in death or loss of a limb or disabling a benefit or part thereof shall be punished with imprisonment for up to four years and a fine of up to 200,000 riyals, or one of the penalties, without prejudice to what is decided for private rights.
He explained that the traffic system clarified the penalties for deliberately causing traffic accidents against others, which can reach up to four years in prison and a fine of 200,000 riyals, resulting in two aspects for each penalty, including public rights for the state and private rights for the affected party. He added that the penalty is divided into two categories; the first pertains to accidents resulting in severe injury with a recovery period of 15 days or more, and carries a financial penalty not exceeding 100,000 riyals, or imprisonment not exceeding two years, or both penalties together. The second category involves causing a traffic accident that results in the death of the injured party or the loss of one of their limbs, with a penalty in this case reaching four years in prison and a financial fine of 200,000 riyals, or both together.
Al-Ayafi emphasized that anyone who commits a reckless or negligent traffic accident shall be referred to the competent court to consider determining the appropriate penalty against them, without prejudice to what is decided for private rights, and the regulations specify cases of recklessness and negligence.
