علمت «عكاظ»، عن صدور الموافقة على تعديل أنظمة التوثيق والتحكيم والمحاماة، وتضمنت التعديلات عدة مواد قانونية، منها قسمة الأموال الشائعة، وقبول الهبة، واختصاصات كتاب العدل، ومدة الوكالة الشرعية، وأتعاب المحاماة.في نظام التوثيق تم تعديل الفقرة 6 من المادة 11 لتكون بالنص الآتي: «قسمة الأموال الشائعة - بما فيها العقار - إذا لم يكن فيها نزاع، أو حصة وقف أو وصية، أو عديم الأهلية أو ناقصها، أو غائب»، وتعديل المادة 12 لتكون بالنص الآتي: «لا يختص كاتب العدل بتوثيق أي إقرار أو عقد يكون أحد طرفيه عديم الأهلية أو ناقصها، أو غائباً، أو ناظر وقف أو وصية، إلا في حالات قبول الهبة، وتصرفات الأب في مال ولده عديم الأهلية أو ناقصها، وإقرار البائع بالبيع على مورث عديم الأهلية أو ناقصها وقبضه الثمن قبل وفاة المورث، وما ينزع من العقار للمنفعة العامة ما لم يكن البدل عقاراً وعقد تأجير مدته لا تتطلب الإذن من المحكمة المختصة».كما تم تعديل المادة 38 لتكون: «مدة صك الوكالة خمس سنوات من تاريخ صدوره ما لم تُفسخ أو يُتوفى أحد طرفيها أو تُفقد أهليته قبل مضي هذه المدة أو يحدد الموكل مدتها بما يقل عن تلك المدة». وتعديل الفقرة 2 من المادة 40 لتكون بالنص الآتي: «يراعى عند إعداد نماذج العقود حق المتعاقدين في إضافة أي شرط أو اتفاق، ما لم يخالف النصوص النظامية».نظام التحكيمتعديل الفقرة 1 من المادة 10 لتكون بالنص الآتي: «لا يصح الاتفاق على التحكيم إلا ممن يكون أهلاً للتصرف سواء كان شخصاً ذا صفة طبيعية أم شخصاً ذا صفة اعتبارية»، وتعديل الفقرة الفرعية (ب) من الفقرة (1) من المادة 50 لتكون بالنص الآتي: «إذا كان أحد طرفي اتفاق التحكيم وقت إبرامه عديم الأهلية، أو ناقصها، وفقاً للنظام الذي يحكم أهليته».نظام المحاماةتعديل المادة 18 لتكون بالنص الآتي: «للمحامين المقيدين في جدول الممارسين دون غيرهم، حق الترافع عن الغير أمام المحاكم أو ديوان المظالم، أو اللجان المشار إليها في المادة (الأولى) من هذا النظام، واستثناء من ذلك يقبل للترافع عن الغير في حالة الزوج أو صهر الشخص، أوالقريب له إلى الدرجة الرابعة، الممثل النظامي للشخص ذي الصفة الاعتبارية، الوصي والولي وناظر الوقف في قضايا الوصاية ونظارة الوقف التي يقومون عليها ومأمور بيت المال فيما هو من اختصاصه بحسب المنصوص عليه نظاماً».وتعديل المادة 26 لتكون بالنص الآتي: «تحدد أتعاب المحامي وطريقة دفعها باتفاق يعقده مع موكله، فإن لم يوجد اتفاق أو كان الاتفاق باطلاً أو فُسخ أو انفسخ، قدّرتها المحكمة التي نظرت في القضية عند اختلافهما بناء على طلب المحامي أو الموكل بما يتناسب مع الجهد الذي بذله المحامي والنفع الذي عاد على الموكل. كما يطبق هذا الحكم كذلك إذا نشأ عن الدعوى الأصلية أي دعوى فرعية».

The newspaper "Okaz" learned that approval has been granted for amending the documentation, arbitration, and law systems. The amendments included several legal provisions, including the division of common property, acceptance of gifts, the powers of notaries, the duration of legal representation, and attorney fees.
In the documentation system, paragraph 6 of Article 11 was amended to read as follows: "Division of common property - including real estate - if there is no dispute, or a share of a trust or will, or if one party is incapacitated or has limited capacity, or is absent." Article 12 was amended to read as follows: "A notary is not authorized to document any acknowledgment or contract if one of the parties is incapacitated or has limited capacity, or is absent, or is a trustee of a trust or will, except in cases of accepting a gift, and the actions of a father regarding the property of his incapacitated or limited-capacity child, and the seller's acknowledgment of the sale to an ancestor who is incapacitated or has limited capacity and receiving the price before the ancestor's death, and what is expropriated from real estate for public benefit unless the compensation is real estate and the lease contract duration does not require permission from the competent court."
Article 38 was also amended to read: "The duration of the power of attorney is five years from the date of issuance unless it is revoked, or one of the parties passes away, or loses their capacity before the expiration of this period, or the principal specifies a duration shorter than that period." Paragraph 2 of Article 40 was amended to read as follows: "When preparing contract templates, the rights of the contracting parties to add any condition or agreement shall be taken into account, unless it contradicts the statutory texts."
Arbitration System
Paragraph 1 of Article 10 was amended to read as follows: "An agreement for arbitration is only valid if made by someone who is competent to act, whether a natural person or a legal entity," and subparagraph (b) of paragraph (1) of Article 50 was amended to read as follows: "If one of the parties to the arbitration agreement at the time of its conclusion is incapacitated or has limited capacity, according to the system governing their capacity."
Law System
Article 18 was amended to read as follows: "Only lawyers registered in the practitioners' list, and no one else, have the right to represent others before the courts or the Board of Grievances, or the committees referred to in Article (1) of this system. An exception to this is made for representation in the case of a spouse or in-law of the person, or a relative up to the fourth degree, the legal representative of a legal entity, the guardian and custodian in guardianship cases and the administration of the trust they oversee, and the treasurer of the public treasury in matters within their statutory jurisdiction."
Article 26 was amended to read as follows: "The attorney's fees and the method of payment shall be determined by an agreement made with their client. If there is no agreement, or if the agreement is invalid, revoked, or terminated, the court that heard the case shall determine them in case of disagreement based on a request from the attorney or the client, in proportion to the effort exerted by the attorney and the benefit that accrued to the client. This provision also applies if any ancillary claim arises from the original lawsuit."
