كشف مصدر في وزارة العدل لـ«عكاظ» آلية تعامل صندوق النفقة مع الحالات التي تحصل على أحكام نفقة، ويكون الأب ممتنعاً أو مماطلاً عن التنفيذ، وقال المصدر: «بموجب المادة (4) من تنظيم صندوق النفقة، يقوم الصندوق بصرف النفقة المحكوم بها للمستفيد في حال امتناع المنفذ ضده عن التنفيذ أو تعذر تحصيل النفقة منه، ثم يتولى مطالبة من تجب عليه النفقة بمقدار ما قام بصرفه من نفقة للمستحق وفق الإجراءات النظامية». وفي ما يتعلق بتوسيع مفهوم النفقة لتشمل رفاهية الطفل واحتياجاته غير المعيشية قال المصدر: إن الصندوق غير مختص نظاماً بتحديد ما يجب أن تشتمل عليه النفقة، وإنما يلتزم بتنفيذ ما يرد في صك الحكم الصادر من المحكمة المختصة.وأكد صندوق النفقة أن أحد أهدافه الأساسية هو ضمان صرف النفقة المحكوم بها دون تأخير في حال تأخر أو تعذر التنفيذ من قبل المنفذ ضده، بما يسهم في استقرار الأسرة وصون كرامتها. كما يحرص الصندوق على تسهيل إجراءات الاستفادة من خدماته عبر المنصة الإلكترونية، ويعمل بشكل تكاملي مع وزارة العدل والجهات ذات العلاقة لتعزيز العدالة الأسرية والحماية الاجتماعية.وأجمعت كل من المحامية نسرين الغامدي والمحامية عبير محمد دغريري على أن صندوق النفقة أحد المشاريع التي تقدمها وزارة العدل في السعودية بهدف إشباع الحاجات الأساسية للأسرة التي امتنع فيها المنفق عن القيام بنفقتهم خلال فترة التقاضي من الأب المماطل، وذلك بهدف الإسهام في استقرار الأسرة والمجتمع من خلال إنجاز صرف النفقة لمن يستحق وضمان استردادها لتعزيز المسؤولية وضمان الاستدامة وتنمية الموارد المالية.وأضافتا أنه وفقاً لنظام الأحوال الشخصية تعد النفقة حقاً من حقوق المنفق عليه، وتشمل الطعام، والكسوة، والسكن، والحاجيات الأساسية بحسب العرف وما تقرره الأحكام النظامية ذات الصلة، ويراعى في تقدير النفقة حال المنفَق عليه وسعةُ المنفِق. وتجوز زيادة النفقة أو إنقاصها تبعاً لتغير الأحوال. ولا تُسمع دعوى زيادة النفقة أو إنقاصها قبل مضي «سنة» من تاريخ صدور الحكم بالنفقة إلا في الظروف الاستثنائية التي تقدّرها المحكمة.

A source in the Ministry of Justice revealed to "Okaz" the mechanism by which the Alimony Fund deals with cases that receive alimony rulings, where the father is refusing or delaying execution. The source stated: "According to Article (4) of the Alimony Fund Regulation, the fund disburses the alimony awarded to the beneficiary in case the obligated party refuses to execute or if it is impossible to collect the alimony from him. The fund then proceeds to claim from the person obligated to pay alimony the amount it has disbursed to the rightful beneficiary according to legal procedures." Regarding the expansion of the concept of alimony to include the child's welfare and non-living needs, the source said that the fund is not legally authorized to determine what should be included in alimony; rather, it is obligated to implement what is stated in the ruling issued by the competent court.
The Alimony Fund confirmed that one of its main objectives is to ensure the timely disbursement of the awarded alimony in case of delay or inability to execute by the obligated party, which contributes to the stability of the family and the preservation of its dignity. The fund also strives to facilitate the procedures for benefiting from its services through the electronic platform and works in a complementary manner with the Ministry of Justice and relevant entities to enhance family justice and social protection.
Both lawyer Nasreen Al-Ghamdi and lawyer Abeer Mohammed Dghreeri agreed that the Alimony Fund is one of the projects offered by the Ministry of Justice in Saudi Arabia aimed at meeting the basic needs of families where the provider has refrained from fulfilling their alimony during the litigation period due to the delaying father, with the goal of contributing to the stability of the family and society by ensuring the disbursement of alimony to those who deserve it and guaranteeing its recovery to enhance responsibility, ensure sustainability, and develop financial resources.
They added that according to the Personal Status Law, alimony is a right of the beneficiary and includes food, clothing, housing, and basic necessities according to custom and what is determined by relevant legal rulings, taking into account the condition of the beneficiary and the capacity of the provider. Alimony may be increased or decreased depending on changes in circumstances. A claim for increasing or decreasing alimony is not heard until "one year" has passed from the date of the alimony ruling, except in exceptional circumstances deemed by the court.
