شدد خبير في قانون العمل على أن أن توثيق عقد العمل في منصة «قوى» لا يعني إقرار صحة البنود المخالفة للنظام أو إضفاء المشروعية عليها. وقال الخبير خالد رشاد خياط لـ«عكاظ» أن أي شرط يتضمنه عقد العمل ويخالف أحكام النظام يُعد باطلًا حتى وإن وافق عليه العامل ووقّع العقد، مشيرا إلى أنه يمنع حرمان العامل من الإجازات المقررة قانونا، إذ يبطل الشرط وتثبت للعامل الإجازات وفق أحكام النظام.
وأوضح أن المادة الثامنة من نظام العمل نصت على أنه: «يبطل كل شرط يخالف أحكام هذا النظام، ويبطل كل إبراء أو مصالحة عن الحقوق الناشئة للعامل بموجب هذا النظام أثناء سريان عقد العمل، ما لم يكن أكثر فائدة للعامل».
وبيّن خياط أن نظام العمل لا يترك لطرفي العلاقة العمالية حرية مطلقة في الاتفاق على ما يخالف أحكامه، فإذا تضمن عقد العمل شرطًا ينتقص من حق قرره النظام للعامل، فإن الشرط يكون باطلًا، فيما يبقى العقد قائمًا في ما عدا الشرط المخالف.
وأشار إلى أن النظام راع أن العلاقة العمالية ليست متكافئة تمامًا من الناحيتين الاقتصادية والتنظيمية، باعتبار العامل الطرف الأضعف ولذلك وضع قواعد آمرة ذات طابع حمائي توفر الحد الأدنى من الحماية وتحقق التوازن بين طرفي عقد العمل. وفي المقابل، فإن أي شرط يمنح العامل حقوقًا أو مزايا إضافية أكثر فائدة له يُعد صحيحًا.
وعن تنازل العامل عن حقوقه أثناء الخدمة، أكد خياط أن الإبراء أو المخالصة التي يوقعها العامل وهو على رأس العمل، وتتضمن إسقاط حق من حقوقه النظامية أو التنازل عنه، لا يُعتد بها متى كانت تنتقص من الحقوق التي كفلها له النظام. وينطبق ذلك على المصالحة أثناء سريان العقد إذا ترتب عليها إسقاط حق نظامي، إلا إذا كانت أكثر فائدة للعامل.
وأضاف أن تشديد المنظم على فترة سريان عقد العمل يأتي مراعاةً للمركز التفاوضي للعامل، إذ قد يوافق على التنازل خشية فقدان وظيفته أو الفصل أو تعرضه للتعسف، مؤكدًا أن موافقة العامل وحدها لا تكفي لإهدار الحقوق التي قررها النظام بقواعد آمرة.
التحذير من توقيع مخالصة قبل استلام كامل المستحقات
وحذّر خياط العاملين من توقيع مخالصة بعد انتهاء العلاقة العمالية تتضمن التنازل عن حقوقهم، أو توقيع أي مخالصة قبل استلام كامل مستحقاتهم، لافتًا إلى أن المخالصة الموقعة بعد انتهاء العلاقة العمالية يُعتد بها، حتى لو تضمنت تنازلًا عن حقوق، إذ تكون إرادة العامل بعد انتهاء العلاقة كاملة.
ونصح خياط العاملين بأخذ الرأي القانوني من المحامين والمختصين قبل توقيع عقد العمل أو المخالصة، والاطلاع على أحكام نظام العمل لمعرفة حقوقهم والتزامهم.
An expert in labor law emphasized that documenting an employment contract on the "Qiwa" platform does not mean acknowledging the validity of terms that violate the law or granting them legitimacy. Expert Khalid Rashad Khayyat told "Okaz" that any condition included in the employment contract that contradicts the provisions of the law is considered null and void, even if the worker agrees to it and signs the contract, pointing out that it is prohibited to deprive the worker of legally mandated vacations, as the condition is void and the worker's right to vacations is established according to the law.
He explained that Article 8 of the Labor Law states: "Any condition that contradicts the provisions of this law is void, and any waiver or settlement of rights arising for the worker under this law during the term of the employment contract is void, unless it is more beneficial to the worker."
Khayyat indicated that the Labor Law does not leave the parties in the employment relationship with absolute freedom to agree on terms that contradict its provisions. If the employment contract includes a condition that diminishes a right established by the law for the worker, then that condition is void, while the contract remains valid in all other respects.
He pointed out that the law recognizes that the employment relationship is not entirely equal from both economic and organizational perspectives, considering the worker as the weaker party. Therefore, it has established mandatory rules of a protective nature that provide a minimum level of protection and achieve balance between the parties to the employment contract. Conversely, any condition that grants the worker additional rights or benefits that are more advantageous to them is considered valid.
Regarding the worker waiving their rights during service, Khayyat confirmed that any waiver or settlement signed by the worker while still employed, which includes the relinquishment of any of their statutory rights, is not considered valid if it diminishes the rights guaranteed to them by the law. This applies to settlements made during the contract term if they result in the relinquishment of a statutory right, unless they are more beneficial to the worker.
He added that the regulator's emphasis on the duration of the employment contract is to consider the worker's negotiating position, as they may agree to waive rights for fear of losing their job or being dismissed or subjected to abuse, stressing that the worker's consent alone is not sufficient to undermine the rights established by the law through mandatory rules.
Warning Against Signing a Settlement Before Receiving Full Entitlements
Khayyat warned workers against signing a settlement after the end of the employment relationship that includes waiving their rights, or signing any settlement before receiving their full entitlements, noting that a settlement signed after the end of the employment relationship is considered valid, even if it includes a waiver of rights, as the worker's will is complete after the relationship ends.
He advised workers to seek legal advice from lawyers and specialists before signing an employment contract or settlement, and to review the provisions of the Labor Law to understand their rights and obligations.
