علمت «عكاظ» عن متابعة ورصد كافة الممارسات التي تتعلق بنشر بعض المحامين وقائع التحقيقات وتفاصيل الدعاوى والمحاكمات عبر وسائل الإعلام والمنصات الرقمية، في ضوء الضوابط النظامية والمهنية المنظمة للنشر والظهور الإعلامي. وبحسب مصادر أوضحت لـ«عكاظ» أن المادة التاسعة من نظام المطبوعات والنشر تحظر نشر وقائع التحقيقات أو المحاكمات بأي وسيلة دون الحصول على إذن من الجهة المخولة نظاماً، فيما تنظم القاعدتان السابعة والثلاثون والثامنة والثلاثون من قواعد السلوك المهني للمحامين مشاركة المحامي في وسائل الإعلام والنشر الإلكتروني والإعلان المباشر وغير المباشر. وتلزم القواعد المحامي بحماية خصوصية العملاء وسرية بياناتهم، ومراعاة مقتضيات التحقيق والمحاكمة، وتجنب التضليل والخداع، كما تضبط الإعلان بما يحفظ أصول المهنة والثقة بالمرفق العدلي.
خصوصية أطراف الدعوى
وبحسب مصادر «عكاظ»، تشمل الممارسات محل المتابعة المستمرة، نشر تفاصيل أو وثائق مرتبطة بقضايا منظورة، بما في ذلك نشر أي حكم قضائي أو أي جزء منه، في مختلف درجات التقاضي، سواء اكتسب الحكم الصفة النهائية أم لم يكتسبها، متى كان النشر دون إذن الجهة المختصة. وشددت المصادر، على أن الحالات المخالفة ستخضع للإجراءات المقررة وفق الأنظمة والقواعد ذات الصلة، إذ تهدف هذه الضوابط إلى حماية حقوق أطراف الدعوى وخصوصيتهم، والمحافظة على سلامة إجراءات التحقيق والنظر القضائي، وتعزيز المسؤولية المهنية للمحامي عند تناول القضايا في المجال العام. وأرجعت مصادر تحدثت لـ«عكاظ» أسباب هذه الخطوة إلى ما تم رصده في مواقع ومنصات التواصل الاجتماعي من مخالفات جسيمة وظهور غير مقنن لبعض المحامين في منصات التواصل الاجتماعي ونشرهم أحكاماً قضائية لم تكتسب الصفة القطعية أو نشر وتفسير لوائح وأنظمة بخلاف صحتها فضلاً عن تجاوزات مهنية متكررة جرى حصرها وتنبيه المتجاوزين لحدود الأنظمة. وبحسب قانونيين، فإن الحاجة تقتضي ضبطاً مهنياً متوازناً يحفظ هيبة المهنة وحقوق المحامي في آن، بحيث لا تتحول المنصات الرقمية إلى ساحة تجاوزات قد تمس شرف مهنة المحاماة فضلا عن سلامة إجراءات التحقيق والنظر القضائي، وتعزيز المسؤولية المهنية للمحامي.
سحب تراخيص محامين
ورصدت «عكاظ» تحركات في هذا الاتجاه، على مدى سنوات مضت من بينها سحب رخص محامين خالفوا آداب الظهور الإعلامي والتحقيق مع آخرين في مخالفات مهنية. ومن بين الوقائع إيقاف محامٍ عن المهنة لمدة ستة أشهر بعد ثبوت مخالفته نظام المحاماة. وسجلت الوقائع أيضاً شطب محامٍ ثبت استخدامه وكالة لشخص متوفى واستلام مبالغ بالإنابة عن ورثة وعدم تسليمها، إضافة إلى قضية انتهت بإلزامه بسداد مليون ريال لمواطنة مقابل أعمال لم ينجزها. وبين الوقائع أيضاً إحالة محامٍ من لجنة تأديب المحامين على خلفية سلوك عُد مخالفًا لأخلاقيات المهنة، فضلا عن سحب رخص محامين ممن خالفوا آداب الظهور الإعلامي من الجهة المختصة بوزارة العدل والتحقيق مع آخرين في مخالفات مهنية مماثلة. وبحسب ذات المصادر، فإن وزارة العدل ماضية في التعامل بحزم مع أي تجاوزات تخل بآداب وأخلاقيات مهنة المحاماة، وستوقع عقوبات وفق الأنظمة ذات العلاقة بحق كل من يثبت تجاوزه، عبر المنصات الرقمية، بما يحفظ هيبة المهنة ويصون حقوق المتقاضين. يذكر أن وزارة العدل كانت قد أصدرت تعميما على كافة الجهات التابعة للوزارة تضمن الموافقة على قواعد الضبط، ورفع الدعوى التأديبية التي تستهدف مهنة المحاماة، وتهدف القواعد لضبط المخالفات المهنية للمحامين، والتحقيق في المخالفات المهنية، وتشكيل لجنة للتأديب ونظر الدعوى التأديبية.

رحب عدد من المحامين والقانونيين بهذه الخطوة، مؤكدين على أهمية وقار مهنة المحاماة كونها جزءاً من السلطة القضائية. وعلّق المحامي فراس طرابلسي على التوجه نحو تعزيز متابعة الضوابط المنظمة للظهور الإعلامي للمحامين، قائلاً: «أرى أن هذه التنظيمات تعكس تطوراً مهماً في متابعة الممارسة المهنية، ويُحسب لوزارة العدل حرصها المستمر على رصد ما تفرزه الممارسة من تحديات والتعامل معها بما يحفظ شرف مهنة المحاماة ومكانتها، ويحمي في الوقت ذاته حقوق الموكلين والمتقاضين وهيبة المرفق العدلي، فتنظيم المهنة لا يكتمل بوضع القواعد وحدها، بل بمتابعة أثرها في الواقع ومواكبة ما يستجد في وسائل الممارسة والتواصل». وأضاف طرابلسي: «الظهور الإعلامي للمحامي في أصله أمر إيجابي، بل يؤدي دوراً مهماً في نشر الثقافة القانونية ورفع الوعي بالحقوق والواجبات، لكن المحامي ليس معلقاً يبحث عن السبق، ولا ينبغي أن تتحول قضية موكله إلى مادة لصناعة الحضور أو المشاهدات، فالمحامي شريك في تحقيق العدالة، وما يعرفه بحكم مهنته قد يكون سراً لموكله، أو متعلقاً بتحقيق أو محاكمة لم تكتمل، أو بحقوق أطراف آخرين لا يجوز أن تصبح تفاصيلهم مادة للتداول العام».
سرية البيانات
وأوضح طرابلسي أن الأطر النظامية والمهنية القائمة أرست بالفعل هذه الحدود؛ فنظام المطبوعات والنشر يحظر نشر وقائع التحقيقات أو المحاكمات دون الحصول على إذن من الجهة المخولة نظاماً، كما تؤكد قواعد السلوك المهني للمحامين حماية خصوصية العملاء وسرية بياناتهم، ومراعاة مقتضيات التحقيق والمحاكمة، وتجنب التضليل، وضبط التعامل مع وسائل الإعلام بما يصون نزاهة القضاء وشرف المهنة. وأكد طرابلسي أن «تعزيز الرصد والمتابعة وتفعيل هذه الضوابط لا ينبغي أن يُقرأ باعتباره تقييداً للمحامي، بل حمايةً له ولموكله ولحقوق أطراف الدعوى وللمهنة ذاتها، فالحرية المهنية لا تنفصل عن المسؤولية المهنية، وكلما اتسع حضور المحامي أمام الجمهور ازدادت مسؤوليته عن الكلمة والمعلومة والصورة التي يقدمها عن العدالة». واختتم قائلاً: «المحامي لا يحتاج إلى قضايا الناس ليصنع شهرته؛ علمه وأمانته وأداؤه هي التي تصنع اسمه، وحماية هذا الفارق هي في حقيقتها حماية لشرف المحاماة».
ضوابط مهنية وأخلاقية
ماجد قاروب. محامي ومستشار قانوني
وأكد المحامي ماجد قاروب على أهمية وقار المهنة على اعتبار أنها جزء من السلطة القضائية. وقال: «إن تسويق وتعريف المحامين ومكاتبهم وخدماتهم يجب أن تكون بما يتفق مع نظام المحاماة ولائحة سلوكيات المحامين». وشدد على أهمية تقنين ظهور المحامين في الإعلام ممن يتحدثون عن أسرار المتقاضين ونشر وقائع المحاكمات والتحقيقات، فضلاً عن تفسير البعض من المبتدئين لنصوص الأنظمة بشكل غير صحيح. وأوضح قاروب أن هذه الخطوة الطيبة في رصد ومنع التجاوزات سوف تدعم مهنة المحاماة لتكون في إطار واضح من العمل وفق ضوابط مهنية وأخلاقية تدعم العمل المؤسسي لمكاتب المحاماة الملتزمة بالتوظيف والتدريب الحقيقي وليس الشكلي والوهمي. ودعا قاروب إلى أخذ التعهدات على أصحاب المكاتب وجميع العاملين من سعوديين وأجانب بعدم التحايل والتلاعب في التوظيف والتزاماته من رواتب حقيقية وسداد التأمينات الاجتماعية والتأمين الطبي بما يخل بالمنافسة الشريفة وأخلاقيات العمل وحقيقة التدرج والتدريب والقضاء على ما يسمى العمل الحر لأصحاب الرخص وحتى ممن لديهم رخص متدربين. وطالب بأن تكون هناك توعية وتثقيف للمجتمع وقطاع الأعمال والإدارة عن كيفية اختيار مكاتب المحامين على أساس الخبرات والسمعة وفريق العمل والتخصص إلى غيرها من عناصر المهنة التي لا تعتمد على عناصر غير حميدة، مثمناً صدور قرار سابق يمنع استخدام عبارة قاضي سابق ومن في حكمه أو نحوه من النيابة واللجان القضائية وغيرها في التعريف بنفسه مجتمعياً.
سير العدالة

وقالت المحامية منال الحارثي: «إن الأنظمة ذات العلاقة حظرت نشر وقائع التحقيقات والأحكام وهو إجراء قانوني وتنظيمي يهدف إلى حماية سير العدالة، ومنع التأثير على مجريات القضايا، أو الإساءة للأطراف، وخصوصية الأفراد».
محامي نبيل ملحان
وأضاف المحامي نبيل ملحان: «إن البعض قد يتهاون في نشر الوثائق والمعلومات السرية في منصات التواصل الاجتماعي». وأوضح أنه في حال تعلق الأمر بوثائق أو معلومات رسمية سرية تمس الأمن الوطني، يسري عليها نظام عقوبات نشر الوثائق والمعلومات السرية وإفشائها وتصل العقوبات فيه إلى السجن حتى 20 سنة أو غرامة تصل إلى مليون ريال.
نسرين الغامدي. محامية.
وقالت المحامية نسرين على الغامدي: «إن القاعدة العامة المعمول بها نظاماً تقضي بحظر نشر وقائع التحقيقات القضائية أو الأحكام (أو صكوكها) التي لم تُنشر رسمياً، أو في حال كانت التحقيقات لا تزال قائمة، لما يمثله ذلك من تأثير على مجريات العدالة أو الرأي العام. ونبهت على ضرورة عدم الخوض في القضايا في منصات التواصل الاجتماعي أو نشر الأحكام كون في ذلك مخالفة نظامية تستوجب المساءلة. وذكرت أن وزارة العدل تعمل على صون وحفظ هيبة المهنة وحقوق المحامي في آن، بحيث لا تتحول المنصات الرقمية إلى ساحة تجاوزات.
بشائر العظمة. محامية
وقالت المحامية بشائر العظمة: «يحظر نظاماً نشر وقائع التحقيقات أو تفاصيلها أثناء سيرها لحماية مجريات العدالة، وسنت الأنظمة عقوبات وغرامات حيال مخالفات النشر أو عند إفشاء المعلومات ونشر الوثائق». وشددت على أن وزارة العدل خطت خطوات حثيثة ومهمة نحو حماية نزاهة مهنة المحاماة ومنع التجاوزات.
"Okaz" learned about the monitoring and tracking of all practices related to the publication by some lawyers of investigation details and trial proceedings through media and digital platforms, in light of the regulatory and professional controls governing publication and media appearances. According to sources that clarified to "Okaz," Article Nine of the Press and Publication Law prohibits the publication of investigation or trial proceedings by any means without obtaining permission from the authorized entity. Meanwhile, the thirty-seventh and thirty-eighth rules of the professional conduct code for lawyers regulate the lawyer's participation in media, electronic publication, and direct and indirect advertising. The rules require the lawyer to protect client privacy and confidentiality of their data, consider the requirements of investigation and trial, and avoid misleading and deception, while also regulating advertising in a manner that preserves the profession's principles and trust in the judicial facility.
Privacy of the Parties in the Case
According to "Okaz" sources, the practices under continuous monitoring include the publication of details or documents related to pending cases, including the publication of any judicial ruling or any part of it, at various levels of litigation, whether the ruling has acquired finality or not, whenever the publication is without the permission of the competent authority. The sources emphasized that violations will be subject to the prescribed procedures according to the relevant regulations and rules, as these controls aim to protect the rights and privacy of the parties in the case, maintain the integrity of investigation and judicial proceedings, and enhance the professional responsibility of the lawyer when addressing cases in the public domain. Sources speaking to "Okaz" attributed the reasons for this step to the serious violations observed on social media platforms and the unregulated appearances of some lawyers on social media, along with their publication of judicial rulings that have not acquired finality or the publication and interpretation of regulations and systems contrary to their validity, in addition to repeated professional violations that have been documented and the violators warned about exceeding the limits of the regulations. According to legal experts, the need calls for a balanced professional regulation that preserves the dignity of the profession and the rights of the lawyer simultaneously, so that digital platforms do not turn into arenas of violations that could affect the honor of the legal profession, as well as the integrity of investigation and judicial proceedings, and enhance the professional responsibility of the lawyer.
Revocation of Lawyers' Licenses
"Okaz" has observed movements in this direction over the past years, including the revocation of licenses from lawyers who violated the ethics of media appearances and the investigation of others for professional violations. Among the incidents was the suspension of a lawyer from practice for six months after confirming his violation of the Law of Advocacy. The incidents also recorded the disbarment of a lawyer who was found to have used a power of attorney from a deceased person and received amounts on behalf of heirs without delivering them, in addition to a case that ended with his obligation to pay one million riyals to a citizen for work he did not complete. Among the incidents was also the referral of a lawyer from the Disciplinary Committee for Lawyers due to behavior deemed contrary to the ethics of the profession, as well as the revocation of licenses from lawyers who violated the ethics of media appearances by the competent authority at the Ministry of Justice and the investigation of others for similar professional violations. According to the same sources, the Ministry of Justice is proceeding firmly in dealing with any violations that undermine the ethics and morals of the legal profession, and will impose penalties according to the relevant regulations against anyone proven to have violated them through digital platforms, in a manner that preserves the dignity of the profession and protects the rights of litigants. It is worth noting that the Ministry of Justice had issued a circular to all entities affiliated with the ministry, which included approval of the regulatory rules and the initiation of disciplinary lawsuits targeting the legal profession, aiming to regulate professional violations of lawyers, investigate professional violations, and form a committee for discipline and consideration of disciplinary lawsuits.

Lawyer Firas Traboulsi commented on the move towards enhancing the monitoring of the controls governing lawyers' media appearances, saying: "I see that these regulations reflect an important development in monitoring professional practice, and the Ministry of Justice deserves credit for its continuous commitment to tracking the challenges arising from practice and dealing with them in a way that preserves the honor and status of the legal profession while simultaneously protecting the rights of clients and litigants and the dignity of the judicial facility. Regulating the profession is not complete by merely establishing rules, but by monitoring their impact in reality and keeping pace with what is new in the means of practice and communication." Traboulsi added: "The media appearance of the lawyer is fundamentally a positive matter; it plays an important role in disseminating legal culture and raising awareness of rights and duties. However, the lawyer is not a commentator seeking precedence, and a client's case should not become material for generating presence or views. The lawyer is a partner in achieving justice, and what he knows by virtue of his profession may be a secret to his client, or related to an investigation or trial that has not been completed, or to the rights of other parties that should not become details for public circulation."

Traboulsi clarified that the existing regulatory and professional frameworks have indeed established these boundaries; the Press and Publication Law prohibits the publication of investigation or trial proceedings without obtaining permission from the authorized entity, and the professional conduct rules for lawyers emphasize the protection of client privacy and confidentiality of their data, consideration of the requirements of investigation and trial, avoidance of misleading, and regulation of dealings with the media in a manner that preserves the integrity of the judiciary and the honor of the profession. Traboulsi affirmed that "enhancing monitoring and activating these controls should not be interpreted as a restriction on the lawyer, but rather as protection for him, his client, the rights of the parties in the case, and the profession itself. Professional freedom is inseparable from professional responsibility, and the more the lawyer's presence before the public expands, the greater his responsibility for the words, information, and images he presents about justice." He concluded by saying: "The lawyer does not need people's cases to create his fame; his knowledge, integrity, and performance are what establish his name, and protecting this distinction is, in fact, protecting the honor of the legal profession."

Lawyer Majid Qaroub emphasized the importance of the dignity of the profession as it is part of the judicial authority. He said: "The marketing and introduction of lawyers, their offices, and their services should be in accordance with the Law of Advocacy and the Code of Conduct for Lawyers." He stressed the importance of regulating the media appearances of lawyers who speak about the secrets of litigants and publish details of trials and investigations, in addition to some beginners misinterpreting the texts of regulations incorrectly. Qaroub clarified that this good step in monitoring and preventing violations will support the legal profession to operate within a clear framework of professional and ethical controls that support the institutional work of law offices committed to real, not formal and illusory, employment and training. Qaroub called for commitments to be taken from office owners and all employees, both Saudis and foreigners, not to manipulate and deceive in employment and their obligations regarding real salaries and payment of social insurance and medical insurance, which disrupts fair competition and work ethics and the reality of progression and training, and to eliminate what is called freelance work for license holders and even for those with trainee licenses. He demanded that there be awareness and education for the community, business sector, and management on how to choose law offices based on experience, reputation, team work, specialization, and other elements of the profession that do not rely on unsavory elements, praising the previous decision to prohibit the use of the phrase "former judge" and those in similar positions from the prosecution and judicial committees, etc., in self-introduction in society.

Lawyer Manal Al-Harithi stated: "The relevant regulations prohibit the publication of investigation proceedings and rulings, which is a legal and regulatory procedure aimed at protecting the course of justice and preventing influence on the proceedings of cases or harming the parties and the privacy of individuals."

Lawyer Nabil Malhan added: "Some may be careless in publishing confidential documents and information on social media platforms." He clarified that if it concerns official confidential documents or information that touches on national security, the penalties for publishing and disclosing confidential documents and information apply, with penalties reaching imprisonment for up to 20 years or fines up to one million riyals.

Lawyer Nasreen Ali Al-Ghamdi stated: "The general rule in force prohibits the publication of judicial investigation proceedings or rulings (or their documents) that have not been officially published, or if the investigations are still ongoing, as this represents an impact on the course of justice or public opinion. She warned against discussing cases on social media platforms or publishing rulings, as this constitutes a regulatory violation that warrants accountability. She mentioned that the Ministry of Justice is working to preserve and uphold the dignity of the profession and the rights of the lawyer simultaneously, so that digital platforms do not turn into arenas of violations.

Lawyer Bashayer Al-Athma stated: "The law prohibits the publication of investigation proceedings or their details during their course to protect the course of justice, and the regulations have established penalties and fines for violations of publication or when disclosing information and publishing documents." She emphasized that the Ministry of Justice has taken significant and important steps toward protecting the integrity of the legal profession and preventing violations.
