أجاز نظام المنافسات والمشتريات الحكومية الجديد، حرمان المتنافسين والمتعاقدين المخالفين من التعامل مع الجهات الحكومية لمدة تصل إلى خمس سنوات، أو تخفيض تصنيفهم، أو الجمع بين العقوبتين، كما أتاح فرض غرامة تصل إلى 10% من القيمة الإجمالية للعرض بدلاً من عقوبة المنع.
وحدد النظام آلية للنظر في مخالفات المتنافسين والمتعاقدين من خلال لجنة أو أكثر من المختصين.
وبحسب المادة الـ87، تملك اللجنة إصدار قرار بمنع المخالف من التعامل مع الجهات الحكومية مدة لا تتجاوز خمس سنوات، أو تخفيض تصنيفه أو الجمع بين الإجراءين، مع عدم الإخلال بأي عقوبة ينص عليها نظام آخر.
ومنح النظام اللجنة خيار فرض غرامة مالية بدلاً من المنع، على ألا تتجاوز 10% من القيمة الإجمالية للعرض، ما يرفع قيمة العقوبة كلما ارتفعت قيمة المنافسة الحكومية.
وأوضح المستشار القانوني سعود الرمان، أن قوة النص لا تتوقف عند العقوبة المالية، وإنما تمتد إلى الآثار التجارية والمهنية المترتبة على حرمان المنشأة من التعامل مع الجهات الحكومية، خصوصاً بالنسبة للشركات التي تمثل العقود الحكومية جزءاً رئيسياً من نشاطها.
وبيّن، أن ربط الغرامة بالقيمة الإجمالية للعرض يمنح الجزاء أثراً مالياً كبيراً؛ فعرض تبلغ قيمته 100 مليون ريال يمكن أن تصل الغرامة عليه، عند تطبيق الحد الأعلى، إلى 10 ملايين ريال.
وأضاف الرمان، أن النظام كفل للمخالف في المقابل ضمانات نظامية، إذ أجاز التظلم من قرار اللجنة أمام المحكمة المختصة خلال 60 يوماً من تاريخ نفاذه.
ولا يقف أثر المخالفة عند الحرمان أو الغرامة، إذ أوجب النظام نشر ملخص قرار اللجنة على نفقة المخالف في إحدى الصحف المحلية أو أي وسيلة أخرى مناسبة، بعد انتهاء مدة التظلم دون الاعتراض على القرار، أو صدور حكم نهائي من المحكمة المختصة برفض التظلم.
وبذلك قد تمتد تبعات المخالفة من الجزاء المالي إلى الحرمان من السوق الحكومية والتأثير في تصنيف المنشأة وسمعتها التجارية، في إطار يستهدف تعزيز الانضباط والنزاهة في المنافسات والعقود الحكومية.
The new government procurement and competition system allows for the exclusion of violating competitors and contractors from dealing with government entities for a period of up to five years, or for the reduction of their classification, or for the combination of both penalties. It also permits the imposition of a fine of up to 10% of the total value of the bid instead of the exclusion penalty.
The system specifies a mechanism for reviewing violations by competitors and contractors through one or more committees of specialists.
According to Article 87, the committee has the authority to issue a decision to prevent the violator from dealing with government entities for a period not exceeding five years, or to reduce their classification, or to combine both measures, without prejudice to any penalties stipulated by another system.
The system grants the committee the option to impose a financial fine instead of exclusion, provided that it does not exceed 10% of the total value of the bid, which increases the penalty amount as the value of the government competition rises.
Legal advisor Saud Al-Rumman clarified that the strength of the text does not stop at the financial penalty but extends to the commercial and professional consequences resulting from depriving the establishment of dealing with government entities, especially for companies for which government contracts represent a major part of their activities.
He indicated that linking the fine to the total value of the bid gives the penalty significant financial impact; for a bid valued at 100 million riyals, the fine could reach up to 10 million riyals when applying the maximum limit.
Al-Rumman added that the system guarantees the violator legal protections, as it allows for an appeal against the committee's decision before the competent court within 60 days from the date of its enforcement.
The impact of the violation does not stop at exclusion or fines; the system requires the publication of a summary of the committee's decision at the violator's expense in one of the local newspapers or any other appropriate means, after the appeal period has ended without objection to the decision, or a final ruling from the competent court rejecting the appeal.
Thus, the repercussions of the violation may extend from the financial penalty to exclusion from the government market and affect the establishment's classification and commercial reputation, within a framework aimed at enhancing discipline and integrity in government competitions and contracts.
