أسدلت محكمة جنايات القاهرة، المنعقدة بالتجمع الخامس، الستار على واحدة من أبرز قضايا تصنيع وترويج المخدرات التي شغلت الرأي العام خلال الفترة الماضية، بإصدار أحكام مشددة بحق المنتجة سارة خليفة و27 متهمًا آخرين، فيما شهدت جلسات المحاكمة أيضًا صدور حكم في قضية أخرى تتعلق باتهامها بهتك عرض سائقها.
وفي قضية تصنيع المخدرات، قضت المحكمة بإعدام سارة خليفة و12 متهمًا آخرين شنقًا، بينما عاقبت 9 متهمين بالسجن المؤبد، وأصدرت أحكامًا متفاوتة بحق باقي المتهمين.
وكانت المحكمة قد أحالت في أغسطس الماضي أوراق سارة خليفة و12 متهمًا آخرين إلى مفتي الجمهورية لاستطلاع الرأي الشرعي في شأن أحكام الإعدام، قبل تحديد جلسة 5 سبتمبر للنطق بالحكم في القضية التي تضم 28 متهمًا.
اتهامات بتكوين عصابة لتصنيع المخدرات
وتعود القضية إلى إحالة النيابة العامة سارة خليفة و27 متهمًا إلى محكمة جنايات القاهرة الجديدة، بعد توجيه اتهامات إليهم بتكوين عصابة إجرامية منظمة تخصصت في جلب المواد المستخدمة في تصنيع المواد المخدرة، وتصنيعها بقصد الاتجار والترويج.
كما تضمنت الاتهامات إحراز وحيازة أسلحة نارية وذخائر دون ترخيص، فيما أشارت التحقيقات والتغطيات المحلية إلى ضبط أكثر من 750 كيلوغرامًا من المواد المخدرة والمواد الخام المستخدمة في تصنيعها، إلى جانب معدات وأدوات مرتبطة بعمليات التصنيع.
وبحسب ما ورد في التحقيقات، جرى توزيع الأدوار بين المتهمين، إذ تولى بعضهم جلب المواد الخام، فيما ارتبطت أدوار آخرين بعمليات التصنيع والترويج، مع استخدام أحد العقارات في تخزين المواد الخام وتصنيع المواد المخدرة.
متهم يتحدث عن ترحيله من دبي
وخلال إحدى جلسات المحاكمة، تحدث أحد المتهمين أمام هيئة المحكمة، موضحًا أنه يبلغ من العمر 26 عامًا وأنها المرة الأولى التي يواجه فيها مثل هذا الموقف.
وقال المتهم إن بداية الواقعة كانت أثناء وجوده في محل إقامته بإمارة دبي، مشيرًا إلى أن قوات الشرطة داهمت مقر سكنه وأجرت عملية تفتيش، مؤكدًا، وفق روايته أمام المحكمة، أنه لم يُعثر بحوزته على أي مواد مخدرة.
وأضاف أنه اقتيد بعد ذلك إلى قسم الشرطة، قبل ترحيله إلى مصر عبر مطار سفنكس، ثم نُقل إلى جهات التحقيق المختصة لاستكمال الإجراءات القانونية والتحقيق معه في القضية.
حكم آخر في قضية هتك العرض
وفي قضية منفصلة، أصدرت محكمة جنايات القاهرة، المنعقدة بمحكمة القاهرة الجديدة، حكمًا بحق سارة خليفة على خلفية اتهامها بهتك عرض سائقها، حيث قضت بسجنها 3 سنوات، فيما عاقبت متهمًا آخر بالسجن 5 سنوات، مع مصادرة الهاتف محل القضية.
وخلال مرافعتها أمام المحكمة، قالت النيابة العامة إن المتهمة جردت المجني عليه من ملابسه، في واقعة وصفتها بأنها تضمنت اعتداءً على حرمة جسده.
وأوضحت النيابة أن سارة خليفة أقرت خلال تحقيقات النيابة العامة بتفاصيل الواقعة، فيما تمسك المجني عليه بأقواله، مضيفًا، بحسب ما ورد في المرافعة، أن المتهمة مارست بحقه أشكالًا من التعذيب.
كما اتهمت النيابة سارة خليفة بالظهور أمام الآخرين بصورة مغايرة لحقيقتها، مشيرة إلى أن التحقيقات، وفق ما عرضته أمام المحكمة، كشفت عن دورها في قيادة تشكيل ضم متهمين آخرين، وارتباطهم بواقعة هتك عرض المجني عليه والتعدي عليه بدنيًا ونفسيًا.
دفاع سارة خليفة يتمسك بالبراءة
وخلال نظر قضية تصنيع المخدرات، دفع دفاع سارة خليفة والمتهمين بعدم صحة عدد من الأدلة الواردة في التحقيقات، وطالب بتغيير قيد ووصف الاتهام المتعلق بالمواد المخدرة المضبوطة، مستندًا إلى قرار بعدم دستورية قرار لرئيس هيئة الدواء المصرية بشأن جداول المخدرات.
كما تمسك الدفاع بأن اتصالًا هاتفيًا منسوبًا إلى أحد موكليه لا يمثل دليلًا على التورط في القضية، موضحًا أن الاتصال، الموجود ضمن الأحراز، يتعلق بأعمال خاصة في مجال العقارات ولا يمت بصلة إلى الاتهامات محل المحاكمة.
وأشار الدفاع كذلك إلى أن فحص هواتف المتهمين لم يكشف، بحسب ما عرضه أمام المحكمة، عن محتوى أو تسجيلات تثبت اشتراكهم في الجريمة، معتبرًا أن أوراق القضية تخلو من دليل فني أو مادي قاطع يدين موكليه.
كما دفع بانتفاء تعاطي المتهمين للمواد المخدرة، وطالب ببطلان التحريات لعدم جديتها واعتمادها، بحسب وصف الدفاع، على أقوال مرسلة لا تسندها أدلة يقينية.
وتأتي الأحكام الصادرة في القضيتين بعد جلسات متعددة شهدت مناقشة الاتهامات والأدلة ومرافعات الدفاع، بينما تظل الآثار القانونية المترتبة على كل حكم خاضعة للإجراءات وطرق الطعن المقررة بموجب القانون المصري.
The Cairo Criminal Court, convening in the Fifth Settlement, has drawn the curtain on one of the most prominent drug manufacturing and trafficking cases that has captured public attention in recent times, issuing severe sentences against producer Sara Khalifa and 27 other defendants. The trial sessions also witnessed a ruling in another case concerning her accused of assaulting her driver.
In the drug manufacturing case, the court sentenced Sara Khalifa and 12 other defendants to death by hanging, while 9 defendants received life imprisonment, and varying sentences were issued against the remaining defendants.
The court had referred the papers of Sara Khalifa and 12 other defendants to the Grand Mufti of the Republic in August for a legal opinion regarding the death sentences, before setting the session for September 5 to announce the verdict in the case involving 28 defendants.
Charges of forming a drug manufacturing gang
The case dates back to the referral of Sara Khalifa and 27 defendants by the Public Prosecution to the Cairo Criminal Court, after they were charged with forming an organized criminal gang specializing in bringing in materials used in the manufacture of narcotic substances and producing them for the purpose of trafficking and promotion.
The charges also included the possession and carrying of firearms and ammunition without a license, while investigations and local reports indicated the seizure of more than 750 kilograms of narcotic substances and raw materials used in their manufacture, along with equipment and tools related to the manufacturing processes.
According to the investigations, roles were distributed among the defendants, with some responsible for bringing in raw materials, while others were involved in manufacturing and promoting, using one of the properties to store raw materials and manufacture narcotic substances.
A defendant speaks about his deportation from Dubai
During one of the trial sessions, one of the defendants spoke before the court, explaining that he is 26 years old and that this is the first time he has faced such a situation.
The defendant stated that the incident began while he was in his residence in the Emirate of Dubai, noting that police forces raided his residence and conducted a search, affirming, according to his testimony before the court, that no narcotic substances were found in his possession.
He added that he was then taken to the police station before being deported to Egypt via Sphinx Airport, and then transferred to the relevant investigative authorities to complete the legal procedures and interrogate him in the case.
Another ruling in the assault case
In a separate case, the Cairo Criminal Court, convening at the New Cairo Court, issued a ruling against Sara Khalifa regarding her accusation of assaulting her driver, sentencing her to 3 years in prison, while another defendant was sentenced to 5 years, with the confiscation of the phone involved in the case.
During her plea before the court, the Public Prosecution stated that the accused stripped the victim of his clothes, in an incident it described as an attack on the sanctity of his body.
The prosecution clarified that Sara Khalifa admitted during the Public Prosecution's investigations to the details of the incident, while the victim maintained his statements, adding, according to what was mentioned in the plea, that the accused subjected him to forms of torture.
The prosecution also accused Sara Khalifa of presenting herself to others in a manner contrary to her true nature, indicating that the investigations, as presented before the court, revealed her role in leading a group that included other defendants, and their involvement in the incident of assaulting the victim and physically and psychologically abusing him.
Sara Khalifa's defense insists on innocence
During the consideration of the drug manufacturing case, Sara Khalifa's defense and the defendants argued against the validity of several pieces of evidence presented in the investigations, requesting a change in the classification and description of the charges related to the seized narcotic substances, relying on a decision declaring the unconstitutionality of a decision by the head of the Egyptian Drug Authority regarding drug schedules.
The defense also insisted that a phone call attributed to one of their clients does not constitute evidence of involvement in the case, clarifying that the call, which is among the evidence, relates to private business in the real estate field and has no connection to the charges at trial.
The defense also pointed out that the examination of the defendants' phones did not reveal, according to what was presented before the court, any content or recordings proving their involvement in the crime, considering that the case files lack conclusive technical or material evidence that incriminates their clients.
They also argued that the defendants did not consume narcotic substances, and requested the invalidation of the investigations for lack of seriousness and reliance, according to the defense's description, on unsubstantiated statements that are not supported by conclusive evidence.
The rulings issued in both cases come after multiple sessions that witnessed discussions of the charges, evidence, and defense pleas, while the legal consequences of each ruling remain subject to the procedures and appeal methods stipulated under Egyptian law.
