وصف المحامي عبدالله الكاسب توجيه النائب العام، رئيس مجلس النيابة العامة الدكتور خالد اليوسف بإطلاق خدمة التحقيق إلكترونياً مع الموقوفين داخل السجون بأنه يرفع كفاءة الإجراءات العدلية وتسريعها، مع المحافظة على الضمانات النظامية المقررة للمتهم.

وبيّن لـ «عكاظ» أن الخدمة تسهم في تقليص المدد اللازمة لاستكمال إجراءات التحقيق، من خلال الربط الإلكتروني بين الجهات المعنية؛ ما يسرّع إنجاز القضايا، ويقلل فترات انتظار الموقوفين، وينسجم مع مبادئ العدالة الناجزة، ويوفر بيئة قانونية أكثر موثوقية.
وأضاف أن توثيق إجراءات التحقيق إلكترونياً يعزز الشفافية، ويثبت الإجراءات المتخذة، ويحد من الأخطاء الإجرائية والمنازعات المتعلقة بصحة التحقيق.
وأكد الكاسب أحقية المحامي أو الوكيل في حضور التحقيق الإلكتروني إلى جانب موكله، استناداً إلى المادة الرابعة من نظام الإجراءات الجزائية، التي تنص على حق كل متهم في الاستعانة بوكيل أو محامٍ للدفاع عنه خلال مرحلتي التحقيق والمحاكمة.
وأشار إلى أن المادة الـ22 من اللائحة التنفيذية لنظام الإجراءات الجزائية أوجبت تعريف المتهم، عند القبض عليه أو توقيفه، بأسباب القبض أو التوقيف، وحقه في الاستعانة بوكيل أو محامٍ خلال مرحلتي التحقيق والمحاكمة، إضافة إلى حقه في الاتصال بمن يرغب في إبلاغه بالقبض عليه أو توقيفه.
ولفت إلى أن المادة الـ70 من النظام نصت على عدم جواز عزل المتهم، أثناء التحقيق، عن وكيله أو محاميه الحاضر معه، ولا يجوز للوكيل أو المحامي التدخل في التحقيق إلا بإذن المحقق، مع احتفاظه بحق تقديم مذكرة خطية بملحوظاته، على أن يضمها المحقق إلى ملف القضية.
واختتم الكاسب حديثه بالتأكيد على أن الخدمة تعكس التطور المستمر في أعمال النيابة العامة، وحرصها على تسريع الإجراءات النظامية ورفع كفاءة العمل وتعزيز التحول الرقمي، بما يواكب مستهدفات رؤية المملكة 2030.
وكان النائب العام وجّه أخيراً، بإطلاق خدمة التحقيق الإلكتروني مع الموقوفين على ذمة التحقيق داخل السجون في مناطق المملكة كافة، بهدف تعزيز مركزية الممكنات عبر تقنيات آمنة، وتسهيل الإجراءات وتسريعها قضائياً، وتعزيز دورة التكامل الرقمي المحكوم، وتوفير بيئة قانونية وحقوقية مهيأة.
وتعتمد آلية التنفيذ على استخدام ممكنات تقنية آمنة لإجراء التحقيقات إلكترونياً عبر الاتصال المرئي؛ بما يعزز كفاءة الإجراءات وموثوقيتها، ويحقق إجراءات أسرع، وأعباء أقل، وكفاءة أعلى.
Lawyer Abdullah Al-Kasib described the Attorney General's directive, from the Chairman of the Public Prosecution Council Dr. Khalid Al-Yousef, to launch the electronic investigation service with detainees inside prisons as a means to enhance and expedite judicial procedures while maintaining the legal guarantees established for the accused.

He explained to "Okaz" that the service contributes to reducing the time required to complete investigation procedures by electronically linking the relevant authorities; this accelerates the resolution of cases, reduces the waiting periods for detainees, aligns with the principles of swift justice, and provides a more reliable legal environment.
He added that documenting investigation procedures electronically enhances transparency, verifies the actions taken, and limits procedural errors and disputes related to the validity of the investigation.
Al-Kasib confirmed the right of the lawyer or representative to attend the electronic investigation alongside their client, based on Article Four of the Criminal Procedure Law, which states that every accused person has the right to seek the assistance of a representative or lawyer for their defense during the investigation and trial stages.
He pointed out that Article 22 of the executive regulations of the Criminal Procedure Law requires informing the accused, upon their arrest or detention, of the reasons for their arrest or detention, their right to seek the assistance of a representative or lawyer during the investigation and trial stages, in addition to their right to contact someone they wish to inform about their arrest or detention.
He noted that Article 70 of the law stipulates that the accused cannot be isolated during the investigation from their present representative or lawyer, and the representative or lawyer may not intervene in the investigation except with the investigator's permission, while retaining the right to submit a written memorandum with their observations, which the investigator must include in the case file.
Al-Kasib concluded his remarks by emphasizing that the service reflects the continuous development in the work of the Public Prosecution and its commitment to expedite legal procedures, enhance work efficiency, and promote digital transformation in line with the objectives of Saudi Vision 2030.
Recently, the Attorney General directed the launch of the electronic investigation service with detainees under investigation inside prisons across all regions of the Kingdom, aiming to enhance the centralization of capabilities through secure technologies, facilitate and expedite judicial procedures, strengthen the governed digital integration cycle, and provide a prepared legal and rights environment.
The implementation mechanism relies on using secure technological capabilities to conduct investigations electronically via visual communication; this enhances the efficiency and reliability of procedures, achieving faster processes, lower burdens, and higher efficiency.
