أكدت منصة «قوى» أنه لا يتم تعديل نوع العقد من محدد المدة إلى غير محدد المدة تلقائياً من المنصة، ويتطلب من المنشأة التعديل والتحديث على العقد واختيار نوع العقد غير محدد المدة.
وأضافت أن آلية التحويل التلقائي من عقد محدد المدة إلى عقد غير محدد المدة في حال التجديد 3 مرات متتالية أو إذا تجاوزت مدته مع التجديدات 4 سنوات غير مفعّلة حالياً في منصة «قوى»، إذ يتم تجديد العقود بنوعها نفسه ما لم يتم تعديلها يدوياً من قبل صاحب العمل.
وأشارت «قوى» إلى أنه يتم إسقاط الموظف من المنشأة عند إنهاء العلاقة التعاقدية، ويُستبعد الموظف السعودي بعد انتهاء فترة الإشعار أو فوراً إذا كان الإنهاء مباشراً، ويُمنح المقيم فترة سماح 60 يوماً بعد انتهاء العقد لنقل خدماته أو الخروج أو إعادة التعاقد، وبعدها يُبلَّغ عنه كمتغيب. كما يتم الاستبعاد بعد تحديثات نظامية في منصة «قوى». على صعيد آخر، أكدت منصة «قوى» أنه يتم عكس بيانات رخصة العمل في أنظمة وزارة الداخلية «أبشر أعمال/مقيم» خلال 48 ساعة من تاريخ السداد.
The "Qiwa" platform confirmed that the type of contract is not automatically changed from a fixed-term to an indefinite-term contract by the platform, and it requires the establishment to modify and update the contract and select the type of indefinite-term contract.
It added that the mechanism for automatic conversion from a fixed-term contract to an indefinite-term contract in the case of renewal three consecutive times or if its duration exceeds four years with renewals is currently not activated on the "Qiwa" platform, as contracts are renewed in the same type unless manually modified by the employer.
"Qiwa" indicated that an employee is removed from the establishment upon termination of the contractual relationship, and the Saudi employee is excluded after the notice period ends or immediately if the termination is direct. The resident is granted a grace period of 60 days after the contract ends to transfer his services, exit, or re-contract, after which he is reported as absent. Exclusions also occur after regulatory updates on the "Qiwa" platform. On another note, the "Qiwa" platform confirmed that the work permit data is reflected in the Ministry of Interior systems "Absher Business/Resident" within 48 hours from the payment date.
