أجمع قانونيون ومحامون ومختصون لـ«عكاظ» أن العقد الموحد للمحاماة أسهم في حفظ حقوق طرفي العقد سواء المحامين أو العملاء وأنهى أي خلافات قد تنشئ بينهم كون العقد الموحد للمحاماة يعد سندا تنفيذيا ملزما.
واعتبر عدد من المحامين أن عقد المحاماة الموحد إضاءة مهمة لوزارة العدل أسهمت في تنظيم العلاقة التعاقدية بين المحامين وموكليهم.
وأكد المحامون: خالد أبو راشد وعبير دغريري ونسرين الغامدي ونبيل ملحان وإيهاب أبو ظريفة وبدر العتيبي وحكم الحكمي وبشائر العظمة، أن عقد المحاماة الموحد يأتي في إطار قانوني من الشفافية والموثوقية، ما يعزز العدالة الوقائية، مشيرا إلى أن العقد الموحد للمحاماة يعتبر سندا تنفيذيا أمام القضاء ولا يحتاج للمرافعة ويفض أي خصومة.
وكان وزير العدل رئيس مجلس إدارة الهيئة السعودية للمحامين الدكتور وليد بن محمد الصمعاني أطلق أخيرا العقد الموحد لأتعاب المحاماة؛ بهدف تنظيم العلاقة التعاقدية بين المحامي وموكله.
ويكتسب العقد -المسجل في خدمة إنشاء العقود على منصة نافذ- صفة السند التنفيذي، ويتم التعامل معه من خلال محاكم التنفيذ بطريقة إلكترونية عبر منصة ناجز Najiz.sa دون الحاجة إلى رفع دعوى قضائية.
ويوفر العقد الموحد خدمات قانونية متخصصة تتضمن التمثيل القضائي، وتقديم الاستشارات القانونية، وإعداد المستندات القانونية، مع توثيق جميع العمليات المرتبطة بالخدمة بما في ذلك دفع الأتعاب، وتسليم واستلام المستندات، وتوثيق الإشعارات المتبادلة بين الطرفين.
ويضمن العقد إلزام المنشآت القانونية برد الأصول المستلمة كافة من الموكل بعد سداد الأتعاب، وكذلك إلزام الموكل بسداد الأتعاب في مواعيدها المحددة.
ويأتي العقد الموحد لأتعاب المحاماة ضمن سلسلة قدمتها وزارة العدل لمنتجات تهدف إلى الحد من المنازعات القضائية وتحقيق العدالة الوقائية.
Legal experts, lawyers, and specialists agreed to "Okaz" that the unified contract for legal services has contributed to safeguarding the rights of both parties to the contract, whether lawyers or clients, and has resolved any disputes that may arise between them, as the unified contract for legal services is considered an enforceable document.
A number of lawyers considered that the unified legal services contract is an important illumination for the Ministry of Justice that has contributed to organizing the contractual relationship between lawyers and their clients.
Lawyers: Khalid Abu Rashid, Abeer Dghairi, Nasreen Al-Ghamdi, Nabil Malhan, Ihab Abu Zareefa, Badr Al-Otaibi, Hakem Al-Hakami, and Bashair Al-Azmah confirmed that the unified legal services contract comes within a legal framework of transparency and reliability, which enhances preventive justice, noting that the unified contract for legal services is considered an enforceable document before the judiciary and does not require litigation, thus resolving any disputes.
The Minister of Justice and Chairman of the Board of Directors of the Saudi Bar Association, Dr. Walid bin Mohammed Al-Samaani, recently launched the unified contract for legal fees; aimed at organizing the contractual relationship between the lawyer and their client.
The contract - registered in the contract creation service on the Nafith platform - has the status of an enforceable document, and it is dealt with through execution courts electronically via the Najiz platform without the need to file a lawsuit.
The unified contract provides specialized legal services that include judicial representation, providing legal consultations, and preparing legal documents, while documenting all operations related to the service, including payment of fees, delivery and receipt of documents, and documenting the notifications exchanged between the two parties.
The contract ensures that legal entities are obligated to return all assets received from the client after the fees are paid, as well as obligating the client to pay the fees on their specified due dates.
The unified contract for legal fees is part of a series presented by the Ministry of Justice for products aimed at reducing judicial disputes and achieving preventive justice.
