شهَّرت وزارة التجارة بمواطنٍ ومقيمٍ (سوري الجنسية) صدر حكم قضائي نهائي يدينهما بارتكاب جريمة التستر في بيع أجهزة ومعدات المطاعم بمدينة الرياض.
وثبت تمكين المواطن للمقيم من مزاولة النشاط التجاري تحت مظلة مؤسسته، ومنحه أدوات التصرف في المنشأة بشكل مطلق، بإدارتها وتشغيلها وتسيير أعمالها لحسابه الخاص.
كما ضبطت أدلة مادية تؤكد جريمة التستر، من بينها إبرام المتستر عليه للعقود وإشرافه على العمالة، وشراء وبيع البضائع، وتحصيل إيرادات نشاطه غير النظامي، ودفع المصروفات والإيجارات.
ونشرت الوزارة الحكم القضائي النهائي الصادر من المحكمة الجزائية بالرياض المتضمن التشهير وغرامة مالية (20000 ريالٍ مناصفة بينهما)، وشطب السجل التجاري وإلغاء الترخيص وتصفية نشاط المؤسسة، واستيفاء الزكاة والرسوم والضرائب، والمنع من مزاولة النشاط، وإبعاد المتستر عليه عن المملكة وعدم السماح له بالعودة للعمل.
يذكر أن نظام مكافحة التستر نص على فرض عقوبات بالسجن لمدة تصل إلى خمس سنوات، وغرامة مالية تصل إلى خمسة ملايين ريال، وحجز ومصادرة الأموال غير المشروعة بعد صدور أحكام قضائية نهائية ضد المتورطين.

The Ministry of Commerce has named a citizen and a resident (of Syrian nationality) who received a final judicial ruling convicting them of committing the crime of concealment in the sale of restaurant equipment and devices in Riyadh.
It was established that the citizen enabled the resident to engage in commercial activity under the umbrella of his institution, granting him absolute control over the establishment, managing, operating, and conducting its business for his own benefit.
Material evidence was also seized confirming the concealment crime, including the concealed party signing contracts, supervising the labor force, buying and selling goods, collecting revenues from his illegal activity, and paying expenses and rents.
The ministry published the final judicial ruling issued by the Criminal Court in Riyadh, which includes the naming and a financial penalty (20,000 riyals to be shared between them), cancellation of the commercial registration, revocation of the license, liquidation of the institution's activity, settlement of zakat, fees, and taxes, prohibition from engaging in the activity, and deportation of the concealed party from the Kingdom with a ban on returning to work.
It is worth mentioning that the Anti-Concealment Law stipulates penalties of imprisonment for up to five years, a financial fine of up to five million riyals, and the seizure and confiscation of illegal funds after final judicial rulings are issued against those involved.
