دعت وزارة التجارة المستهلكين والمنشآت لإبداء آرائهم حول مشروع «عقد تنفيذ أعمال مطبخ منزلي»، الذي طُرح أخيراً، عبر «منصة استطلاع» التابعة للمركز الوطني للتنافسية.
ويهدف مشروع العقد -الذي تُشرف عليه الوزارة بشراكةٍ مع اللجنة الدائمة لحماية المستهلك- إلى تنظيم العلاقة التعاقديّة بين طرفي العقد؛ لتحقيق التوازن العادل في حقوقهما والتزاماتهما، ويضع الأحكام والشروط العامة التي لا يمكن مخالفتها، ويزيد من وضوح ما تم الاتفاق عليه، ويحد من النزاعات والخلافات التعاقديّة، ويأتي مُتسقاً مع أحكام الأنظمة واللوائح ذات الصلة.
وتضمّن مشروع العقد 17 مادة، من أبرزها أحكام نقل وتركيب أجزاء المطبخ، وأحكام التعديل على التصميم، والتعويض الاتفاقي، وأحكام الضمان والصيانة، وحالات فسخ العقد دون الحاجة لحكم قضائي، كما يتميّز العقد بصفة السند التنفيذي التي تمكّن طرفيه من التنفيذ القضائي مباشرة.

The Ministry of Commerce has called on consumers and businesses to express their opinions on the project "Contract for the Implementation of Home Kitchen Works," which was recently launched through the "Survey Platform" of the National Competitiveness Center.
The aim of the contract project - which is overseen by the ministry in partnership with the Permanent Committee for Consumer Protection - is to regulate the contractual relationship between the two parties to achieve a fair balance in their rights and obligations. It establishes the general terms and conditions that cannot be violated, increases the clarity of what has been agreed upon, and limits contractual disputes and disagreements. It is also consistent with the provisions of relevant laws and regulations.
The contract project includes 17 articles, among the most notable are provisions for the transportation and installation of kitchen parts, provisions for modifications to the design, agreed compensation, warranty and maintenance provisions, and cases for terminating the contract without the need for a judicial ruling. The contract is distinguished by the executive title that enables both parties to execute judicially directly.
