The General Authority for Ports has approved new regulations to organize the return of empty containers to designated yards in the Kingdom's ports, addressing cases of inability to receive them and the associated delay fees, warning of financial penalties of up to 50,000 riyals for violators, in addition to taking further regulatory actions against non-compliant shipping agents and shipping lines.
The authority, in a circular reviewed by "Okaz," has obligated shipping agents and shipping lines to ensure the readiness of empty container reception yards, provide adequate capacity, and coordinate with yard operators to identify alternative locations when receiving is not possible, while notifying beneficiaries in writing of any changes in container return locations or schedules.
It emphasized the necessity of documenting cases of yard fullness or halting reception using a standardized form, which includes container data and reasons for inability and its duration, enabling importers and land carriers to obtain proof of inability to return containers for operational reasons, and not charging them delay fees for periods during which the return is proven to be impossible, according to regulatory controls.
The authority confirmed the responsibility of shipping agents to review claims for delay fees resulting from yard fullness or halting, and to take necessary actions to settle or cancel them according to regulatory and contractual provisions, noting that submitting a proof of inability form does not automatically exempt from fees, as claims are subject to verification and review.
The authority granted shipping agents and shipping lines a 15-day period from the issuance of the circular to submit compliance reports that include data on yards, their capacities, cases of inability to receive, delay fees, and corrective actions, emphasizing that continued violations may necessitate increased oversight and the imposition of additional requirements, in addition to applying fines and regulatory actions.
It clarified that the regulations take effect from the date of issuance of the circular, while previous related provisions remain in effect, stressing that no additional fees may be imposed or arbitrary actions taken against beneficiaries merely for submitting complaints or requests for review of delay fees.
