ثمة أوقاف في مدينتي مكة المكرمة والمدينة المنورة أوقفها أصحابها منذ مئات السنين في عدة وجوه؛ صرف مداخلها في وجوه البر، أو إيقافها على على ذرية الواقف للاستفادة من مداخلها.
مع مرور الزمن، أصبحت تلك الأوقاف فاقدة لعطائها، بل أصبح بعضها دوراً خرِبة معطلة، ورأى بعض نظَّار تلك الأوقاف إعادة رونقها وبنائها ثم استثمارها لتحقيق رغبة واقفها من الاستفادة منها.
ولا يبت في مثل هذه الأمور سوى القضاء الذي يعلن للمستثمرين عن الرغبة في بنائها، وتتم الموافقة بموجب صكوك شرعية بين النظَّار والمستثمرين بموافقة القضاء.
لكن -للأسف- أن هناك مستثمرين يخلّون بما اتفق عليه عقب استلامه الموقع وبنائه؛ من ذلك: امتناعه إعطاء المستحقين استحقاقاتهم، إذ يطلب إنقاص الاستحقاق إلى الثلث أو النصف، مع أن القضاء يرفض ذلك ويلزم المستثمر بالوفاء بموجب صك الاستثمار.
بعض هؤلاء المستثمرين لا يلتزمون حتى بعد صدور قرار الالتزام بموجب الحكم القضائي وصك الاستثمار، فلم يوف المستثمر بما يصدر من أحكام، ولم يحصل المستحق أي مبلغ، ويظل المبنى تحت يد المستثمر يستغله ويؤجره، وتظل مطالبة النظَّار والمستحقين في المحاكم، إضافة إلى أن المحاكم التنفيذية لا تقبل دعاوى النظَّار بالمطالبة باستحقاقاتهم، بدعوى أن صكوك الاستثمار ليس بها ما ينص على إلزام المستثمر بدفع الاستحقاقات، حسب التعليمات الجديدة.
هنا نقف متعجبين؛ إذا صك شرعي صادر من المحاكم العامة بالاستثمار، والمواقع تحت حوزة المستثمر يستغلها بالتأجير، والامتناع من دفع ما هو مستحق عليه، وتضيع السنوات، ويموت بعض المستحقين، والباقي بين كبير السن، ومريض، وحقوقهم الشرعية ضائعة، لم يستفيدوا منها بشيء، بسبب استغلال المستثمرين لها.

أضع الأمر أمام وزير العدل رئيس المجلس الأعلى للقضاء وليد الصمعاني، طمعاً في حل عاجل وسريع لهذا الأمر، فالوزير كما هو معروف عنه لديه الحلول في أي أمر يرتقي بإجراءات القضاء.
«كفى ما ضاع من سنوات على مستحقي الأوقاف»؛ عبارة أقولها في ختام هذه العجالة.

There are endowments in my cities of Mecca and Medina that their owners have dedicated for hundreds of years in various ways; allocating their revenues for charitable causes, or dedicating them to the descendants of the endower to benefit from their income.
Over time, these endowments have lost their benefits, and some have even become dilapidated and inactive. Some of the overseers of these endowments have seen the need to restore and rebuild them, then invest in them to fulfill the endower's desire to benefit from them.
However, only the judiciary can decide on such matters, announcing to investors the desire to rebuild, and approval is granted through legal documents between the overseers and the investors with the court's consent.
Unfortunately, there are investors who violate the agreements made after receiving the site and building it; for instance, they refuse to pay the rightful beneficiaries their entitlements, requesting to reduce the entitlement to a third or half, even though the judiciary rejects this and obliges the investor to fulfill the terms of the investment document.
Some of these investors do not comply even after a commitment decision is issued based on the court ruling and the investment document. The investor does not comply with the rulings issued, and the rightful beneficiaries receive no amount, while the building remains under the investor's control, who exploits and rents it out. The overseers and beneficiaries continue to pursue their claims in the courts, in addition to the fact that the enforcement courts do not accept the overseers' lawsuits demanding their entitlements, claiming that the investment documents do not stipulate the obligation of the investor to pay the entitlements, according to the new regulations.
Here we stand in astonishment; if there is a legal document issued by the general courts for investment, and the sites are under the investor's control being exploited for rent, while they refuse to pay what is due, years pass, some beneficiaries die, and the remaining ones are elderly or ill, with their legal rights lost, having gained nothing from them due to the exploitation by the investors.
In conclusion
I present this matter to the Minister of Justice, the Chairman of the Supreme Judicial Council, Walid Al-Samaani, hoping for a swift and urgent resolution to this issue, as the minister is known for having solutions to any matter that enhances judicial procedures.
