The Central Anti-Corruption Criminal Court in Iraq has issued prison sentences of 7 years against three members of the House of Representatives, in connection with cases related to illicit gains and asset inflation, as announced by the Federal Integrity Commission.
The sentences included the two female deputies, Alia Nasif Jassim and Ashwaq Salim Hassan, who received two in-person sentences of 7 years in prison, while the sentence against Deputy Bahaa Al-Din Noor Mohammed Hussein was issued in absentia. Additionally, the convicted individuals were ordered to return the funds that the authorities claimed resulted from illicit gains, and financial fines equivalent to their value were imposed, along with the affirmation of the seizure of their movable and immovable assets.
In the case of Alia Nasif, the Integrity Commission stated that the court ordered her to return the value of illicit gains amounting to 14.239 billion Iraqi dinars, in addition to 12.442 million dollars, with a financial fine equivalent to the value of the funds subject to the conviction. It clarified that the total amount of money and fines exceeds 61 billion dinars according to the Commission's calculations.
Nasif also received another sentence of 3 years in prison for concealing information in the financial disclosure form; however, the court decided to apply the harsher penalty. The decision also included the affirmation of the seizure of her movable and immovable assets, granting the Integrity Commission the right to claim compensation for damages after the judgment becomes final.
As for Deputy Ashwaq Salim, the court ordered her to return the value of illicit gains amounting to 2.114 billion dinars, in addition to 2.924 million dollars, and imposed a financial fine equal to the value of the funds subject to the ruling, bringing the total of the return and fine, according to the Commission's statement, to about 11.9 billion dinars.
Salim also received another sentence of 3 years in prison for concealing information in the financial disclosure form, with the application of the harsher penalty, along with the affirmation of the seizure of her movable and immovable assets.
Regarding Deputy Bahaa Al-Din Al-Nouri, the Integrity Commission announced earlier in September that a 7-year prison sentence was issued against him for the crime of illicit gains, along with an order to return the value of the funds subject to the conviction and impose a financial fine equivalent to that value. The Commission reported that the total value of the return and fine exceeds 40 billion Iraqi dinars.
These rulings are based on Article 19 of the Iraqi Integrity and Illicit Gains Law No. 30 of 2011, which addresses penalties related to illicit gains and concealing information in financial disclosure statements.
The rulings come as part of the Iraqi judicial procedures to pursue cases of asset inflation and illicit gains among officials and public office holders, with the Integrity Commission continuing to refer files that contain financial suspicions to the competent judiciary.
According to the Integrity Commission, the claim for compensation for damages related to the cases remains valid after the judgments become final, meaning that the legal and financial procedures resulting from the rulings are not limited to imprisonment and the return of funds and fines.
