تُعرف العلاقة بين المحامي وموكله عادةً بكونها مساحة للأمان والدفاع، لكن خلافاً مالياً بائساً لم يتجاوز 400 دينار أردني قلب هذه المعادلة رأساً على عقب، بعدما انتهى الأمر بالموكل خلف أسوار السجن إثر كلمة أرسلها عبر الهاتف.
بدأت القصة حين جرت مطالبات مالية متوترة بين محامٍ وموكله السابق حول مبلغ من أتعاب قضايا سابقة. لكن الموكل الذي رأى أن المحامي لم ينجز أي إجراء يذكر في تلك القضايا وأنه يطلب المبالغ دون وجه حق، اختار أن يرد على رسائل المطالبة بأسلوب محفوف بالتهكم، إذ أرسل رموزاً تعبيرية ضاحكة (إيموجي) مع عبارة: «حسبي الله ونعم الوكيل فيك ربنا ينتقم منك أشد انتقام».
هذا الرد دفع المحامي لرفع دعوى قضائية مباشرة، لتتحرك النيابة العامة وتوجه للموكل تهمة من العيار الثقيل بموجب المادة 15 من قانون الجرائم الإلكترونية، وهي نشر بيانات تنطوي على الذم والقدح والتحقير.
وأمام القضاء، خضعت المحادثة لفحص دقيق، إذ استعرضت محكمة صلح جزاء عمان أوراق القضية وتقرير الخبرة، ليتبين للقاضي أن الرسالة كانت محادثة خاصة ومغلقة أرسلت مباشرة للمشتكي ولم تُنشر للعامة أو تُعد للتداول، وهو ما ينفي تطبيق قانون الجرائم الإلكترونية الشديد.
غير أن الجمع بين السخرية بالرموز التعبيرية والتهجم بالعبارة اعتبرته المحكمة «معاملة غليظة وإهانة صريحة». وبناءً عليه، قرر القاضي تعديل وصف الجرم إلى «إرسال رسائل إهانة عبر وسيلة اتصال» وفق قانون الاتصالات، وإدانة الموكل بالحكم عليه بالحبس لمدة شهر واحد.
وفي مفارقة أخرى شهدتها نفس الجلسة، وجه القضاء ضربة لطموحات المحامي المالية، حيث ردت المحكمة دعوى التعويض المدني التي تقدم بها، مؤكدة أن مجرد إثبات الجريمة لا يعني تلقائياً استحقاق التعويض المالي دون تقديم أدلة جازمة على حدوث أضرار مادية أو معنوية مباشرة.
The relationship between a lawyer and their client is usually known to be a space for safety and defense, but a miserable financial dispute that did not exceed 400 Jordanian dinars turned this equation upside down, after the client ended up behind bars due to a word sent via phone.
The story began when tense financial demands arose between a lawyer and his former client regarding a sum of fees for previous cases. However, the client, who felt that the lawyer had not accomplished any significant action in those cases and was demanding amounts without justification, chose to respond to the demand messages in a mocking manner, sending laughing emojis along with the phrase: "God is sufficient for me, and He is the best disposer of affairs. May God take revenge on you in the harshest way."
This response prompted the lawyer to file a direct lawsuit, leading the public prosecution to charge the client with a serious offense under Article 15 of the Cyber Crimes Law, which pertains to publishing data that involves defamation, slander, and insult.
In court, the conversation underwent a thorough examination, as the Amman Criminal Court reviewed the case documents and the expert report, revealing to the judge that the message was a private and closed conversation sent directly to the complainant and was not published for the public or intended for circulation, which negated the application of the severe Cyber Crimes Law.
However, the combination of mockery through emojis and the aggressive phrase was deemed by the court as "coarse treatment and a blatant insult." Accordingly, the judge decided to amend the description of the crime to "sending insulting messages via a means of communication" according to the Telecommunications Law, and convicted the client with a sentence of one month in prison.
In another twist witnessed during the same session, the court dealt a blow to the lawyer's financial ambitions, as it rejected the civil compensation claim he filed, confirming that merely proving the crime does not automatically entitle one to financial compensation without presenting conclusive evidence of direct material or moral damages.
