مع الاقتراب الفعلي لانطلاق العام الدراسي، أُسدل الستار في مصر على واحدة من أعقد القضايا القانونية، إذ تلقت أمل عبدالحميد (27 عاماً) حكماً قضائياً استئنافياً غير مسبوق يثبت نسب ابنتها إلى والدها الذي اغتصبها، بعد رحلة مريرة من الرفض والملاحقات القضائية استمرت زهاء 8 سنوات.
بدأت الفاجعة عام 2018 حين تعرضت أمل لوقائع اغتصاب من زميل دراسة، نتج عنها ولادة طفلتها. ورغم صدور حكم جنائي ينص على إدانة الجاني بعد 4 سنوات من الجريمة، ظل قانون الأحوال الشخصية المصري حاجزاً منيعاً أمام إثبات نسب الطفلة، لاشتراطه وجود عقد زواج رسمي مقترن بالولادة.
هذا العائق التشريعي منع الطفلة طوال سنوات عمرها الثماني من الحصول على شهادة ميلاد رسمية، ما حرمها منطقياً من الخدمات الأساسية، ورغم التحاقها بالمدرسة إلا أنها ظلت ممنوعة رسمياً من خوض الامتحانات لعدم وجود هوية.
وأمام توالي حفظ الدعاوى القضائية ورفضها المتكرر، اتخذت أمل قراراً استثنائياً بالخروج إلى العلن عبر وسائل الإعلام ومواقع التواصل الاجتماعي. كسر هذا التحرك حاجز الصمت المجتمعي حول حوادث الاعتداء الجنسي، وأعاد تسليط الضوء على القضية، ليكون ظهورها الإعلامي نقطة التحول الحقيقية التي تحركت إثرها أروقة القضاء في مصر.
وجاءت الفتح القانوني الأبرز عقب فتوى رسمية أصدرتها هيئة كبار العلماء بالأزهر، أقرت فيها جواز استخدام تحليل الحمض النووي (DNA) المقترن بحكم إدانة المغتصب لإثبات الأبوة. وبناءً على هذه الفتوى، أصدرت محكمة الاستئناف حكمها التاريخي بإثبات النسب، في سابقة هي الأولى من نوعها داخل المحاكم المصرية.

This legislative obstacle prevented the child, throughout her eight years of life, from obtaining an official birth certificate, logically depriving her of basic services. Although she enrolled in school, she remained officially barred from taking exams due to the lack of identity.
Faced with the repeated dismissal of her lawsuits and their rejection, Amal made an exceptional decision to go public through the media and social networks. This move broke the societal silence surrounding incidents of sexual assault and brought renewed attention to the case, making her media appearance a true turning point that prompted the corridors of justice in Egypt to take action.
The most significant legal breakthrough came after an official fatwa issued by the Council of Senior Scholars at Al-Azhar, which approved the use of DNA analysis, coupled with a conviction of the rapist, to establish paternity. Based on this fatwa, the appellate court issued its historic ruling to establish paternity, marking a first of its kind in Egyptian courts.
