في غضون 48 ساعة فقط، أصدرت القاضية الفيدرالية كارين ج. إيميرغوت حكمين متتاليين ضد إدارة الرئيس الأمريكي دونالد ترمب، أوقفا خطته لنشر قوات الحرس الوطني في ولاية أوريغون، وتحديدًا في مدينة بورتلاند.
إيميرغوت التي عيّنها ترمب خلال فترته الرئاسية الأولى، أصبحت حديث الإعلام والدوائر السياسية بعد أن أوقفت مساء الأحد أمرًا رئاسيًا بنشر قوات من الحرس الوطني في كاليفورنيا لنقلها إلى بورتلاند، في خطوة مثّلت تصعيدًا في المواجهة بين السلطة القضائية والبيت الأبيض.
وكانت القاضية نفسها قد أصدرت حكمًا أول قبلها بيوم واحد (السبت) منعت فيه الرئيس الأمريكي من فدرلة الحرس الوطني ونشره في ولاية أوريغون، معتبرة أن تبريرات الإدارة الفيدرالية «تهدد بطمس الخط الفاصل بين السلطات المدنية والعسكرية».
من هي كارين إيميرغوت؟
تُعد إيميرغوت من القاضيات المعروفات في السلك القضائي الأمريكي، وتشغل منصب قاضية بالمحكمة الجزئية الفيدرالية في ولاية أوريغون منذ تعيينها عام 2019. وقبل ذلك، عملت في السلك القضائي المحلي، كما تولّت سابقًا مناصب في النيابة العامة.
رغم أن ترمب هو من رشّحها لهذا المنصب، إلا أن أحكامها الأخيرة كشفت استقلالها القضائي، وأكدت أنها لا تتردد في الوقوف أمام أي تجاوز دستوري، حتى لو جاء من الجهة التي عيّنتها.
لماذا ترفض قرارات ترمب العسكرية؟
ترى إيميرغوت أن استخدام السلطة الفيدرالية لنشر قوات عسكرية داخل المدن يجب أن يخضع لمعايير دستورية دقيقة، ولا يمكن تبريره إلا بوجود ضرورة واضحة وطارئة.
وفي حيثيات حكمها الأخير، كتبت: «تسويغ الحكومة لخطة نشر القوات يهدد بمحو الخط الفاصل بين السلطة المدنية والعسكرية، وهذا يمثّل خطرًا مباشرًا على توازن السلطات في البلاد».
البيت الأبيض يرد
رد الرئيس الأمريكي ترمب سريعًا على قرارات القاضية، وهاجمها علنًا عبر منصات التواصل الاجتماعي، واصفًا قراراتها بأنها «منحازة»، ومؤكدًا أن إدارته ستطعن في الأحكام وتواصل محاولات السيطرة على الوضع الأمني في مدن تعتبرها «في حالة فوضى».
لماذا بورتلاند؟ ولماذا الآن؟
كانت مدينة بورتلاند في السنوات الأخيرة مركزًا للمظاهرات السياسية، والصدامات بين محتجين والشرطة، خصوصا خلال فترة حكم ترمب الأولى. ومع اقتراب الانتخابات الرئاسية القادمة، يسعى ترمب لتأكيد موقفه كـ«رجل قانون ونظام»، لكن تحركاته تصطدم بمقاومة قانونية قوية.

In just 48 hours, federal judge Karen J. Immergut issued two consecutive rulings against the administration of U.S. President Donald Trump, halting his plan to deploy National Guard troops in Oregon, specifically in the city of Portland.
Immergut, who was appointed by Trump during his first presidential term, became the talk of the media and political circles after she blocked a presidential order on Sunday evening to deploy National Guard troops from California to Portland, in a move that represented an escalation in the confrontation between the judiciary and the White House.
The same judge had issued a prior ruling just one day earlier (Saturday), preventing the U.S. president from federalizing the National Guard and deploying it in Oregon, considering that the federal administration's justifications "threaten to blur the line between civilian and military authority."
Who is Karen Immergut?
Immergut is one of the well-known judges in the U.S. judiciary, serving as a federal district judge in Oregon since her appointment in 2019. Prior to that, she worked in local judiciary, and previously held positions in the public prosecutor's office.
Although Trump nominated her for this position, her recent rulings revealed her judicial independence and confirmed that she does not hesitate to stand against any constitutional overreach, even if it comes from the entity that appointed her.
Why does she reject Trump's military decisions?
Immergut believes that the use of federal authority to deploy military forces within cities must adhere to precise constitutional standards and can only be justified by a clear and urgent necessity.
In the reasoning for her latest ruling, she wrote: "The government's justification for the troop deployment plan threatens to erase the line between civilian and military authority, and this poses a direct risk to the balance of powers in the country."
The White House responds
President Trump quickly responded to the judge's decisions, publicly attacking her via social media platforms, describing her rulings as "biased," and asserting that his administration would appeal the rulings and continue attempts to regain control of the security situation in cities he considers "in chaos."
Why Portland? And why now?
In recent years, the city of Portland has been a center for political demonstrations and clashes between protesters and police, especially during Trump's first term. With the upcoming presidential elections, Trump seeks to assert his position as a "law and order" man, but his actions face strong legal resistance.
