أكد المستشار القانوني محمد الديني في حديث خاص لـ«عكاظ» أن الأصل في العقود أن تكون شريعة المتعاقدين، بمعنى أن ما يتفق عليه الطرفان في العقد من بنود وشروط يسري عليهما ويلزمان بتنفيذها، طالما لم تخالف النظام. وأضاف أن النظام حمى العقود وألزم باحترامها وفق مبدأ استقرار العقود، ووضع تنظيماً لذلك، وحدد جزاءات حال خرقها، وبالتالي لا يجوز كسرها أو فسخها بين أطرافها دون سبب مشروع.
وأوضح الديني لـ«عكاظ» أن ما حدث في قضية اللاعب فراس البريكان بين النادي الأهلي ونادي الفتح لا يمكن اعتباره تطبيقاً لقاعدة كسر العقد من قبل اللاعب، لوجود شرط أو بند التسريح الذي يعطي اللاعب الحق في إنهاء العقد متى رغب، مع توضيح الشروط التي يجب تطبيقها لتحقيق ذلك. وأكد أن هذا البند يمثل اتفاقاً بين الطرفين تم وضع شروطه والتزاماته، وطالما تم تطبيقها من اللاعب، فإنه يحق له استخدام ذلك البند، كما حدث بالفعل مع فراس البريكان.
وشدد الديني على أنه لا مجال لاعتبار ما قام به اللاعب ككسر للعقد أو فسخه من طرف واحد، وعليه فلا يمكن تطبيق أي عقوبات أو جزاءات منصوص عليها في لائحة الاحتراف على أي طرف، كون ذلك مرتبطاً فقط بحالة فسخ العقد لسبب غير مشروع.
ولم يتضمن عقد فراس البريكان مع نادي الفتح شرط فسخ العقد، وإنما تضمن بنداً يُعرف بـ«بند التسريح»، يمنح اللاعب الحق في إنهاء العقد وفق شروط محددة ومتفق عليها بين الطرفين.
وقد أثار انتقال البريكان أخيراً جدلاً حول إمكانية اعتباره خرقاً للعقد، إلا أن التأكيد القانوني يشير إلى أن حقوق اللاعب محمية بموجب هذا البند، وأن أي عقوبات أو جزاءات محتملة لا تنطبق عند تفعيل «بند التسريح» بما يتوافق مع شروطه.
على الجانب الآخر، أكد رئيس نادي الفتح، منصور العفالق، في لقاء تلفزيوني الأسبوع الماضي، أن ناديه متمسك بالمسار القانوني في قضية فراس البريكان مع الأهلي، مشيراً إلى أن الشكوى المقدمة لدى مركز التحكيم الرياضي جاءت بعد أن حصل اللاعب على مبالغ مالية عبر وكيله، قبل تحويلها إليه مباشرة، ما اعتبره النادي تجاوزاً للنظام. وانتقد العفالق طريقة تعامل الأهلي في الصفقة، مشيراً إلى أنها لم تتم بشكل رسمي كما هو متعارف عليه مع أندية أخرى، مثل الاتحاد في صفقة أحمد الجليدان، واصفاً العملية بأنها جاءت «من النافذة» وليس من الباب، مؤكداً في الوقت نفسه حرص الفتح على الحفاظ على علاقات طيبة مع جميع الأندية السعودية، مع التشديد على أن الأولوية تبقى للالتزام بالقوانين والأنظمة بما يحمي حقوق النادي ومصالحه.
وأوضح العفالق أن مفاوضات الأهلي مع البريكان خلال صيف 2023 تمت في فترة غير نظامية، دون إخطار مسبق للفتح، وهو ما يشكل خرقاً واضحاً للمادة (26/6) من لائحة الاحتراف، التي تمنع التفاوض مع أي لاعب قبل دخوله الأشهر الستة الأخيرة من عقده إلا بموافقة كتابية من ناديه.
وتقدّم الفتح بشكوى رسمية إلى لجنة الاحتراف وأوضاع اللاعبين في الاتحاد السعودي لكرة القدم في 5 سبتمبر 2024، أي بعد عام من توقيع البريكان مع الأهلي. وباشرت اللجنة إجراءاتها فور تسلم الشكوى، وطلبت الإفادات الرسمية من جميع الأطراف، مع مراعاة التزامات اللاعب مع المنتخب السعودي، وعقدت جلسات استماع للأطراف في ديسمبر 2024 لضمان تكافؤ الفرص والاستماع لجميع وجهات النظر.
وفي 28 فبراير الماضي، رفضت اللجنة الشكوى موضوعاً بعد دراسة الملف والالتزام بالمدد النظامية، فيما استأنف الفتح القرار أمام مركز التحكيم الرياضي السعودي في 10 مارس الجاري، الذي ينظر بالقضية حالياً.

The legal advisor, Mohammed Al-Dini, confirmed in a special interview with "Okaz" that the principle in contracts is that they are governed by the law of the contracting parties, meaning that what the two parties agree upon in the contract in terms of clauses and conditions is binding on them and they are obligated to implement it, as long as it does not violate the law. He added that the law protects contracts and mandates respect for them according to the principle of contract stability, and has established regulations for that, specifying penalties in case of violation. Therefore, it is not permissible to break or terminate them among the parties without a legitimate reason.
Al-Dini explained to "Okaz" that what happened in the case of player Firas Al-Buraikan between Al-Ahli Club and Al-Fateh Club cannot be considered an application of the rule of breaking the contract by the player, due to the existence of a release clause that gives the player the right to terminate the contract whenever he wishes, with the conditions that must be applied to achieve that. He confirmed that this clause represents an agreement between the two parties, with its conditions and obligations set, and as long as it has been applied by the player, he has the right to invoke that clause, as indeed happened with Firas Al-Buraikan.
Al-Dini emphasized that there is no room to consider what the player did as a breach of the contract or its unilateral termination, and therefore no penalties or sanctions stipulated in the professional regulations can be applied to any party, as this is only related to the case of terminating the contract for an illegitimate reason.
The contract of Firas Al-Buraikan with Al-Fateh Club did not include a termination clause; rather, it included a clause known as the "release clause," which grants the player the right to terminate the contract under specific and mutually agreed conditions.
Al-Buraikan's recent transfer has sparked controversy regarding the possibility of considering it a breach of contract; however, legal confirmation indicates that the player's rights are protected under this clause, and that any potential penalties or sanctions do not apply when activating the "release clause" in accordance with its conditions.
On the other hand, the president of Al-Fateh Club, Mansour Al-Afaleq, confirmed in a television interview last week that his club is committed to the legal path in the case of Firas Al-Buraikan with Al-Ahli, pointing out that the complaint submitted to the Sports Arbitration Center came after the player received financial amounts through his agent, before they were transferred directly to him, which the club considered a violation of the law. Al-Afaleq criticized the way Al-Ahli handled the deal, indicating that it was not conducted officially as is customary with other clubs, such as the deal with Ahmed Al-Jlaydan, describing the process as having come "through the window" rather than the door, while emphasizing at the same time Al-Fateh's keenness to maintain good relations with all Saudi clubs, stressing that the priority remains to adhere to laws and regulations that protect the club's rights and interests.
Al-Afaleq clarified that negotiations between Al-Ahli and Al-Buraikan during the summer of 2023 took place during an irregular period, without prior notification to Al-Fateh, which constitutes a clear violation of Article (26/6) of the Professional Regulations, which prohibits negotiating with any player before entering the last six months of his contract unless with written consent from his club.
Al-Fateh submitted an official complaint to the Professional and Player Status Committee of the Saudi Football Federation on September 5, 2024, a year after Al-Buraikan signed with Al-Ahli. The committee began its procedures immediately upon receiving the complaint, requesting official statements from all parties, taking into account the player's commitments with the Saudi national team, and held hearings for the parties in December 2024 to ensure equal opportunities and listen to all viewpoints.
On February 28, the committee rejected the complaint on the grounds after studying the file and adhering to the legal deadlines, while Al-Fateh appealed the decision before the Saudi Sports Arbitration Center on March 10, which is currently reviewing the case.
