أقرت وزارة البلديات والإسكان تحديث لائحة الجزاءات عن المخالفات البلدية، بإضافة مخالفة تقسيم المبنى إلى وحدات مخالفة لرخصة البناء.
وتتضمن عقوبات مخالفة تقسيم المبنى إلى وحدات فرض غرامة مالية تراوح من (5) آلاف إلى (25) ألف ريال للوحدة المخالفة، مع إلزام المخالف بإزالة المخالفة على نفقته، وفي الحالات التي يتعذّر فيها إزالة المخالفة من الناحية الإنشائية لتأثير ذلك على سلامة المبنى، يُعاقَب المخالف بدفع نصف تكلفة البناء محل المخالفة، مع إلزامه بتصحيحها وإزالة الضرر، على أن يُقدّم شهادة من مكتب هندسي مؤهل ومعتمد لدى الوزارة تُثبت سلامة المنشآت المقامة.
وأوضحت الوزارة بأن المخالف يُمنَح مهلة مدتها (60) يوماً لتصحيح الوضع بعد إشعاره بوجود المخالفة، وفق الإجراءات النظامية المعتمدة لضمان معالجة التجاوزات دون الإضرار بسلامة المباني أو ساكنيها، مشددة على ضرورة الإسراع في تصحيح مخالفات تقسيم المباني لتفادي الوقوع في الغرامات.
وأشارت إلى أن تحديث اللائحة يهدف إلى الحد من الممارسات غير النظامية التي ينتج عنها تقسيم المباني أو الشقق السكنية دون الحصول على التراخيص المطلوبة، ما يسهم في تحسين البيئة العمرانية، ورفع الضرر عن السكان، وضمان جودة التنفيذ والسلامة الإنشائية.
و تحديث لائحة الجزاءات عن مخالفات البناء وتقسيم المباني إلى وحدات غير مرخّصة يأتي ضمن الجهود المستمرة لتطوير الأنظمة البلدية والرقابية، الساعية إلى رفع مستوى الامتثال وتحسين البيئة الحضرية في المدن.

The Ministry of Municipalities and Housing has approved an update to the penalties list for municipal violations, adding the violation of dividing a building into units that contravene the building permit.
The penalties for the violation of dividing a building into units include a financial fine ranging from (5) thousand to (25) thousand Riyals for each violating unit, along with obligating the violator to remove the violation at their own expense. In cases where it is structurally impossible to remove the violation due to its impact on the safety of the building, the violator will be penalized by paying half the cost of the construction in question, while being required to correct it and remove the damage, provided that a certificate from a qualified and accredited engineering office is submitted to the ministry to prove the safety of the established facilities.
The ministry clarified that the violator is granted a period of (60) days to rectify the situation after being notified of the existence of the violation, in accordance with the approved regulatory procedures to ensure that violations are addressed without compromising the safety of the buildings or their residents, emphasizing the need to expedite the correction of building division violations to avoid incurring fines.
It was noted that the update to the list aims to reduce irregular practices that result in the division of buildings or residential apartments without obtaining the required permits, contributing to the improvement of the urban environment, alleviating harm to residents, and ensuring quality execution and structural safety.
