كشفت الهيئة العامة للنقل مسودة لائحة بيع المركبات بالمزاد العلني، وتتولى الهيئة أو من تسند إليه تنظيم المزادات العلنية لبيع المركبات المحجوزة والإعلان عن المزاد قبل موعده المحدد بـ 15 يوماً على الأقل، وتحديد طريقة تنفيذ المزاد إلكترونياً أو حضورياً في الموعد المحدد، وتحديد المركبات المستهدفة للبيع بعد التحقق من استيفائها المتطلبات النظامية، وتقديم الضمان المالي المحدد من قبل الفريق الفني، وتسجيل المشاركين في المزاد وفقاً للمدة المتاحة للتسجيل، وإصدار قرار الترسية، وإعلان النتائج، وإشعار الراسي عليه المزاد بآلية السداد، والاستلام، والتحقق من استكمال الإجراءات المالية، وتسليم المركبة بعد التحقق من سداد كافة المستحقات المالية المطلوبة.
وأضافت الهيئة أنه قبل إقامة المزاد العلني يجب التأكد من جاهزية المركبات المحددة للعرض، والتأكد من عدم وجود أي تعميم على المركبة، وتقدير القيمة الابتدائية للمركبة، وإتاحة فرصة المعاينة للمشاركين حضورياً أو إلكترونياً قبل المزاد خلال مدة لا تقل عن 48 ساعة من تاريخ المزاد، وعرض تفاصيل المركبة عبر المنصة، بما يشمل الصور، ورقم الهيكل، وتاريخ الفحص، وتمكين المزايدة الإلكترونية بطريقة شفافة، مع تفعيل الخصائص التفاعلية مثل المزايدة التلقائية والتنبيهات.
وتُنفذ المزادات العلنية لبيع المركبات وفقاً لأحكام نظام النقل البري على الطرق إما إلكترونياً من خلال منصة معتمدة، أو حضورياً في الموقع المحدد، ويُسمح بتقديم العروض خلال الفترة المحددة، مع إمكانية تعديلها حتى موعد الإغلاق، وتُعلن نتائج المزاد من خلال المنصة أو الجهة المنظمة، متضمنة بيانات المركبة، واسم المشارك الراسي عليه المزاد، وقيمة البيع النهائية، ولا يتم اعتماد الترسية إلا بعد مضي مدة 5 أيام عمل من تاريخ صدور قرار الترسية والإعلان عنه، وذلك لتمكين المزايدين من التظلم على القرار.
ويلتزم من رسا عليه المزاد بسداد كامل قيمة المركبة خلال مدة لا تتجاوز 3 أيام عمل من تاريخ انتهاء فترة التظلم، واستلامها خلال مدة لا تتجاوز 7 أيام عمل من تاريخ السداد، وتعد المركبة مستلمة من تاريخ استلامها، ويتم استلام المركبة بعد استيفاء المتطلبات النظامية كافة.
وعند الإخلال بما في القواعد، دون وجود مبرر تقبله الهيئة، يجوز إعادة بيع المركبة في مزاد لاحق لتغطية التكاليف المستحقة، دون أن يكون لمن رسا عليه المزاد الحق بالمطالبة بالمركبة أو قيمتها.

لم يتقدم أحد.. ما الحل؟

من دون الإخلال بالأنظمة والإجراءات المتبعة لدى الجهات المختصة، تتم إعادة عرض المركبات التي لم يتقدم أحد لشرائها في المزاد العلني وفقاً للإجراءات الآتية:
يتم تحديد موعد ثانٍ للمزاد خلال مدة لا تقل عن 15 يوماً من تاريخ انتهاء المزاد الأول، ويعاد تقييم المركبة، وفي حال لم يتم شراؤها في المزاد الثاني يتم تحديد موعد ثالث للمزاد خلال مدة لا تقل عن 15 يوما من تاريخ انتهاء المزاد الثاني، ولا يعاد تقييم المركبة.
وعند عدم تقدم أحد لشراء المركبة بعد عرضها للمرة الثالثة في المزاد العلني يتم التنسيق حيال إسقاط ملكية المركبة، لإتلافها، أو للتصرف فيها.

The General Transport Authority has revealed a draft regulation for the sale of vehicles at public auction. The authority, or whoever it delegates, is responsible for organizing public auctions for the sale of seized vehicles and announcing the auction at least 15 days before the scheduled date. It will determine the method of conducting the auction, either electronically or in person, at the specified time, identify the vehicles targeted for sale after verifying that they meet the regulatory requirements, provide the financial guarantee specified by the technical team, register participants in the auction according to the available registration period, issue the award decision, announce the results, notify the winning bidder of the payment mechanism, and the receipt, verify the completion of financial procedures, and deliver the vehicle after confirming that all required financial obligations have been settled.
The authority added that before holding the public auction, it must ensure the readiness of the specified vehicles for display, confirm that there are no restrictions on the vehicle, estimate the initial value of the vehicle, and provide an opportunity for participants to inspect the vehicle either in person or electronically at least 48 hours before the auction date. Details of the vehicle must be displayed on the platform, including photos, chassis number, inspection date, and enable electronic bidding in a transparent manner, activating interactive features such as automatic bidding and alerts.
Public auctions for the sale of vehicles are conducted in accordance with the provisions of the Land Transport Law either electronically through an approved platform or in person at the designated location. Bids are allowed during the specified period, with the possibility of modifying them until the closing time. The auction results are announced through the platform or the organizing entity, including vehicle data, the name of the winning participant, and the final sale value. The award is not considered valid until after 5 working days have passed from the date of issuing and announcing the award decision, allowing bidders to appeal the decision.
The winning bidder is obligated to pay the full value of the vehicle within a period not exceeding 3 working days from the end of the appeal period and to collect it within a period not exceeding 7 working days from the payment date. The vehicle is considered received from the date of collection, and it is collected after fulfilling all regulatory requirements.
If there is a breach of the rules without a justification accepted by the authority, the vehicle may be resold at a subsequent auction to cover the due costs, without the winning bidder having the right to claim the vehicle or its value.

Without prejudice to the regulations and procedures followed by the relevant authorities, vehicles that no one has applied to purchase at the public auction will be re-offered according to the following procedures:
A second auction date will be set within a period of no less than 15 days from the end date of the first auction, and the vehicle will be re-evaluated. If it is not purchased in the second auction, a third auction date will be set within a period of no less than 15 days from the end date of the second auction, and the vehicle will not be re-evaluated.
If no one applies to purchase the vehicle after it has been offered for the third time at the public auction, coordination will be made regarding the cancellation of the vehicle's ownership, for its destruction, or for its disposal.
