يعتقد البعض أن رخصة حمل السلاح تخوّل صاحبها حمله في أي مكان، وذلك انطباع خاطئ، فرخصة السلاح لا تمنح حاملها حق التجول به والتباهي به في المناسبات العامة والأفراح، وتعمد الاستعراض وتعريض حياة الآخرين للخطر، هي مناسبات اجتماعية يفترض أنها مسرح للفرح والاجتماع، وليست موقعاً للاستعراض والتباهي، ولقد حدد نظام الأسلحة والذخائر آليات وقواعد حمل السلاح، كما حدد أماكن محددة يُحظر فيها حمل السلاح حتى لو كان مرخصاً، والمخالفة تعرض مرتكبها لعقوبات وغرامات.
وحدد النظام الأماكن المحظور فيها حمل السلاح مثل الأسواق والمساجد والمدارس والدوائر الحكومية، وأماكن التجمعات الكبيرة والاحتفالات، ومواقع ممارسة الرياضة والترفيه، وأماكن العمل التي تتطلب طبيعتها عدم حمل السلاح، والأماكن التي تحددها السلطات المختصة.
ويجب أن يكون حمل السلاح وفقاً للشروط والضوابط المحددة في نظام الأسلحة والذخائر واللائحة التنفيذية، وعلى حاملي السلاح اتخاذ جميع الاحتياطات اللازمة لتجنب الحوادث والمخاطر، وفي حالة وجود أي شك حول مكان حمل السلاح، يجب الرجوع إلى الجهات المختصة للحصول على توضيح.
ضبط مطلقي نار في مناسبات
تضمن نظام الأسلحة والذخائر، تنظيم اقتناء وحمل السلاح، ووضع ضوابط للترخيص والاستخدام، ونصوصاً لمحاسبة كل من يعرّض حياة الأفراد والممتلكات للخطر. كما سنَّ القانون النصوص التي تلاحق المخالفين وتحمي المجتمع من المتهورين والمتباهين والمستعرضين بالسلاح ومن يطلقون النار في المناسبات تعبيراً عن عواطفهم، وردع وزجر المتباهين بحمل السلاح واستخدامه وتوثيق أفعالهم في المنصات والتطبيقات الإلكترونية.
وأظهرت تلك المنصات بعضهم يحملون أسلحة وإطلاق النار عبثاً، وتعاملت معهم وزارة الداخلية، بكل حزم وهي تعلن إيقافهم وإحالتهم لجهات الاختصاص، فلا مكان لمتباهٍ بالسلاح وكل من يشكّل خطراً على نفسه والآخرين.
وقبضت إدارة التحريات والبحث الجنائي بشرطة منطقة تبوك، على مواطن ظهر في محتوى مرئي، وهو يطلق النار في الهواء من سلاح ناري داخل أحد الأحياء السكنية، ما عرّض حياة الآخرين للخطر، وجرى إيقافه واتخاذ الإجراءات النظامية بحقه، وإحالته إلى النيابة العامة، وأكدت الجهات المختصة، أنها تواصل إجراءاتها للقبض على الشخص الذي قام بتوثيق الحادثة ونشرها، وذلك لمخالفته نظام مكافحة جرائم المعلوماتية.
وفي واقعة أخرى، قبضت دوريات الأمن بمحافظة جدة على شخصين ظهرا في محتوى مرئي يحملان سلاحين ناريين في مناسبة اجتماعية، وجرى إيقافهما واتخاذ الإجراءات النظامية بحقهما، وإحالتهما إلى النيابة العامة.
«النيابة»: جريمة موجبة للتوقيف
أكدت النيابة العامة أن إطلاق النار في الأماكن العامة أو في المناسبات يُعد سلوكاً مُجرَّماً، ويُشكّل جريمة موجبة للتوقيف وفق قرار النائب العام المحدد للجرائم الموجبة التوقيف؛ وفقاً للمادة 112 من نظام الإجراءات الجزائية.
وشددت النيابة على أن مثل هذه الأفعال تُعرّض حياة الآخرين للخطر، وتُخلّ بالأمن، ولن يتم التهاون في ملاحقة مرتكبيها والمطالبة بتطبيق العقوبات النظامية بحقهم.
وكان النائب العام قرر ما يعد من الجرائم الكبيرة الموجبة للتوقيف، ومنها إطلاق النار من سلاح ناري في الأماكن العامة أو المناسبات، وإطلاق النار من سلاح ناري، أو إشهاره بقصد الاعتداء أو التهديد به ما لم يتنازل صاحب الحق الخاص.
مخالفة.. حتى لو لم يستخدم
المحامي المستشار القانوني عبيد العيافي، أكد أن نظام الأسلحة والذخائر نصّ على أنه يعاقب بالسجن مدة لا تتجاوز 18 شهراً وبغرامة لا تزيد على ستة آلاف ريال، أو بإحدى هاتين العقوبتين، كل من تثبت حيازته لسلاح ناري فردي أو ذخيرة دون ترخيص. كما أشارت إحدى المواد إلى أنه يعاقب بالسجن مدة لا تتجاوز سنة وبغرامة لا تزيد على خمسة آلاف ريال، أو بإحدى هاتين العقوبتين، كل من ثبت قيامه باستعمال السلاح المرخص له بحمله واقتنائه في غير الغرض المرخص له به، أو استعمال سلاح ناري للصيد ولو كان مرخصاً، أو حيازته سلاح صيد أو ذخيرته دون ترخيص. كما يعاقب بذات العقوبة عند السماح لغيره باستعمال السلاح المرخص له به، أو استعمال غيره للسلاح نتيجة إهماله، أو نقل أسلحة أو ذخائر غير مرخصة، أو المساعدة في ذلك.
وأكد أن إطلاق النار في المناسبات يُعد جريمة من الجرائم الكبيرة الموجبة للتوقيف؛ إذ شدد نظام الأسلحة والذخائر على تجريم إطلاق النار في التجمعات، كما جرّم حمل السلاح في المناسبات حتى وإن لم يُستخدم، وهو ما نصت عليه المادة الثامنة من اللائحة التنفيذية، التي تحظر حمل السلاح في المدارس والدوائر الحكومية والتجمعات العامة.
واختتم المحامي العيافي، أنه يعاقب بغرامة لا تتجاوز 1000 ريال كل من حمل سلاحه المرخص في الأماكن والأوقات التي يحظر فيها حمل السلاح، وأن اللائحة تحدد الأماكن والأوقات التي يحظر فيها حمل السلاح.

A firearm license does not grant the holder the right to roam with it and flaunt it at public events and celebrations, nor to deliberately show off and endanger the lives of others. These are social occasions that are supposed to be a stage for joy and gathering, not a site for display and boasting. The weapons and ammunition system has defined the mechanisms and rules for carrying firearms, as well as specific places where carrying firearms is prohibited even if licensed, and violations expose the offender to penalties and fines.
The system has specified the places where carrying firearms is prohibited, such as markets, mosques, schools, government offices, large gatherings and celebrations, sports and recreational venues, workplaces that require the nature of not carrying firearms, and places designated by the competent authorities.
Carrying firearms must be in accordance with the conditions and controls specified in the weapons and ammunition system and its executive regulations. Firearm holders must take all necessary precautions to avoid accidents and risks. In case of any doubt about where to carry a firearm, one should refer to the competent authorities for clarification.
Control of Gunfire at Events
The weapons and ammunition system includes regulations for the acquisition and carrying of firearms, establishes controls for licensing and use, and includes provisions to hold accountable anyone who endangers the lives of individuals and property. The law has enacted provisions that pursue violators and protect the community from reckless individuals who flaunt firearms and those who fire shots at events as an expression of their emotions, deterring and reprimanding those who boast about carrying and using firearms and documenting their actions on platforms and electronic applications.
These platforms have shown some individuals carrying firearms and firing shots recklessly, and the Ministry of Interior has dealt with them firmly, announcing their arrest and referral to the competent authorities. There is no place for those who flaunt firearms and anyone who poses a danger to themselves and others.
The Criminal Investigation Department of the Tabuk region police arrested a citizen who appeared in a video content firing into the air from a firearm within a residential neighborhood, endangering the lives of others. He was arrested, and legal procedures were taken against him, and he was referred to the public prosecution. The competent authorities confirmed that they continue their procedures to arrest the person who documented and published the incident for violating the Anti-Cyber Crime Law.
In another incident, security patrols in Jeddah arrested two individuals who appeared in video content carrying firearms at a social event. They were arrested, and legal procedures were taken against them, and they were referred to the public prosecution.
"Public Prosecution": A Crime Necessitating Detention
The public prosecution confirmed that firing shots in public places or at events is considered a criminal act and constitutes a crime necessitating detention according to the Attorney General's decision defining crimes that necessitate detention, in accordance with Article 112 of the Criminal Procedure Law.
The prosecution emphasized that such acts endanger the lives of others and disrupt security, and there will be no leniency in pursuing the perpetrators and demanding the application of legal penalties against them.
The Attorney General has determined what constitutes serious crimes necessitating detention, including firing a firearm in public places or at events, and firing a firearm or brandishing it with the intent to assault or threaten unless the private right holder waives it.
Violation... Even If Not Used
Legal consultant and attorney Obaid Al-Ayafi confirmed that the weapons and ammunition system stipulates that anyone proven to possess a personal firearm or ammunition without a license is punishable by imprisonment for a period not exceeding 18 months and a fine not exceeding six thousand riyals, or one of these penalties. One of the articles also indicated that anyone proven to have used a licensed firearm for purposes other than those for which it was licensed, or used a firearm for hunting even if licensed, or possessed hunting weapons or ammunition without a license, is punishable by imprisonment for a period not exceeding one year and a fine not exceeding five thousand riyals, or one of these penalties. The same penalty applies to anyone who allows others to use their licensed firearm or uses someone else's firearm due to negligence, or transports unlicensed firearms or ammunition, or assists in that.
