علمت «عكاظ»، أن المحكمة الإدارية في منطقة جازان، قضت بإلغاء قرار صادر من فرع وزارة الموارد بالمنطقة والمركز الوطني لتنمية القطاع غير الربحي بعزل مجلس إدارة جمعية متخصصة في الخدمات الصحية لوجود مخالفات عليها. وأكدت المحكمة أن الحكم يُعد وقتياً مبنياً على الظاهر من الأوراق، ويكون لاغياً عند ثبوت عدم صحة الدعوى. وشددت المحكمة على أن الاعتراض على الحكم لا يوقف تنفيذه على أنه يجوز الاعتراض على الأحكام الصادرة في الطلبات العاجلة، ولا يترتب على ذلك وقف تنفيذها.
وبحسب التفاصيل، استجابت المحكمة الإدارية للطلب العاجل المقدم من جمعية مختصة بالخدمات الصحية في جازان ضد فرع وزارة الموارد بالمنطقة والمركز الوطني لتنمية القطاع غير الربحي عقب قرار عزل مجلس إدارة الجمعية وإعادة تشكيل المجلس مؤقتاً، بادعاء وجود مخالفات على الجمعية وعدم تقيدها بأحكام نظام الجمعيات والمؤسسات الأهلية، وجرى توجيه إنذار لها ولم تتلاف الجمعية المخالفات وفق الإجراءات النظامية. وطالبت الجمعية في دعواها أمام المحكمة بوقف تنفيذ قرار عزل مجلس الإدارة وإعادة تشكيله وما ترتب عليه من آثار. وأشارت إلى أن قرار التوقف والعزل كبدها مطالبات مالية واجبة السداد، إلى جانب مبالغ متفرقة تجاوزت 25 مليون ريال.
وذكرت الجمعية أمام المحكمة، أن قرار العزل لم يتضمن ولم ينص على أسباب نظامية واضحة ومحددة تم الاستناد عليها لعزل المجلس، وبني القرار على ما ورد حيال الجمعية دون أن يوضح أو يذكر ما المخالفات.
وأضافت الجمعية في دعواها أمام المحكمة الإدارية بشأن الإنذار بأنه تم إرسال جميع المستندات التي طلبها المركز الوطني كاملة ولم يرِد للجمعية أي اعتراضات أو ملاحظات من المركز الوطني لتنمية القطاع غير الربحي، إضافة لذلك فقد طلب مجلس إدارة الجمعية الاجتماع مع المسؤولين في المركز إلا أنه لم تتم الموافقة دون توضيح الأسباب. وبينت الجمعية أنها لم تعلم بقرار العزل إلا بالصدفة عن طريق مراجعة مندوبها أحد أقسام شرطة جازان.
استغلال رمضان
واستقطاب التبرعات اعتبرت الجمعية، أنه بحفظ هيئة مكافحة الفساد المعاملة المتعلقة بوجود مخالفات مزعومة انتفى موجب العزل وسببه، وفيما يتعلق بالاستعجال في الدعوى ذكرت الجمعية أنه يتمثل في الضرورة الملحة لمنح صلاحيات استغلال موسم رمضان في استقطاب التبرعات من الجهات المانحة بتمثيل الجمعية والتي تعتمد صرف التبرعات خلال شهر رمضان، وهو الموسم الذي تقوم عليه الجمعية طوال السنة وفي حال عدم مباشرة ذلك فإن الجمعية ستؤول إلى التعثر الشديد، ومباشرة الدعاوى المرفوعة على الجمعية من قبل الغير -المستشفيات والمستوصفات الأهلية- لسداد المستحقات المتعثر سدادها وما يترتب على ذلك من صرف مستحقات العاملين بالجمعية، وتسيير أمور المستفيدين صحياً من الجمعية -كونها جمعية صحية- وهي الغاية التي نشأت من أجلها، إذ بلغ إجمالي المستفيدين من الجمعية المسجلين وبانتظار تقديم الخدمات الصحية والعلاجية لهم 1402 مستفيد، في حين بلغ عدد المرضى غير المتاح خدمتهم حالياً لتوقف عمل الجمعية 250 مستفيداً.
ضياع الحقوق الوظيفية
لفتت الجمعية إلى تلقيها خطابات مطالبات مالية من عدد من المستشفيات الأهلية وشركات طبية تتضمن طلب تعميد من يلزم بصرف المستحق لدى الجمعية بمبالغ متفرقة، وفي حال عدم سداد تلك المستحقات فإن ذلك يعد تشويهاً لسمعة الجمعية، ما ينعكس سلباً على تقديم الخدمات للمستفيدين، وإيقاع الغرامات والجزاءات والدعاوى والتي سيتم سداد ما ينتج عنها من أموال المتبرعين، وفي استمرار الإغلاق تضار الجمعية في موثوقيتها أمام المستفيدين والداعمين، إضافة إلى ضياع الحقوق الوظيفية لأعضاء مجلس الإدارة والفريق التنفيذي بسبب تعطل الجمعية والبدلات الوظيفية مثل بدل التميز والبحث العلمي والتي لا يمكن تعويضها إذا لم يوقف القرار. وختمت الجمعية بطلب وقف تنفيذ القرارين الصادرين من المدعى عليهما، واستئناف مطالبتها المالية المتوقفة لدى المركز الوطني لتنمية القطاع غير الربحي وصندوق دعم الجمعيات والتي تشمل طلبات (دعم مقر) والطلبات الأخرى المرفوعة وصرف المستحقات العاجلة بسبب التوقف والعزل بمبلغ قدره 19 مليون ريال، وصرف مبلغ قدره 6 ملايين ريال لرئيس مجلس الجمعية.
قرار المحكمة
بينت المحكمة، أنها أبلغت المدعى عليهما فرع وزارة الموارد البشرية في جازان والمركز الوطني لتنمية القطاع غير الربحي ولم يحضرا جلسة النطق بالحكم، وخلصت في منطوق الحكم إلى صدور قرارها بوقف تنفيذ ما صدر من فرع وزارة الموارد والمركز الوطني لتنمية القطاع غير الربحي بعزل مجلس إدارة الجمعية وكذلك قرار إعادة تشكيل المجلس المؤقت وما ترتب عليهما من آثار.
وأكدت المحكمة، أن الحكم يحوز الحجية القضائية ويلزم تنفيذه إلا أنه نظراً لطبيعته واعتباره، يُعد حكماً وقتياً مبنياً على الظاهر من الأوراق، ويكون لاغياً عند ثبوت عدم صحة الدعوى. وشددت المحكمة على أن الاعتراض على الحكم لا يوقف تنفيذه، بل الواجب على الجهة تنفيذه مباشرة، وفقاً لنظام المرافعات أمام ديوان المظالم على أنه يجوز الاعتراض على الأحكام الصادرة في الطلبات العاجلة، ولا يترتب على ذلك وقف تنفيذها.

The court emphasized that an objection to the ruling does not suspend its execution, but it is permissible to object to rulings issued in urgent requests, and this does not result in suspending their execution.
According to the details, the Administrative Court responded to the urgent request submitted by an association specialized in health services in Jazan against the Ministry of Human Resources branch in the region and the National Center for the Development of the Non-Profit Sector following the decision to dismiss the Board of Directors of the association and temporarily reconstitute the board, claiming that there were violations against the association and that it did not comply with the provisions of the Associations and Private Institutions Law. A warning was issued to it, and the association did not rectify the violations according to the legal procedures. The association requested in its lawsuit before the court to suspend the execution of the decision to dismiss the board and reconstitute it, along with the consequences that followed. It pointed out that the decision to suspend and dismiss caused it financial claims that are due for payment, in addition to various amounts exceeding 25 million riyals.
The association stated before the court that the dismissal decision did not include or specify clear and specific legal reasons that were relied upon to dismiss the board, and the decision was based on what was stated regarding the association without clarifying or mentioning what the violations were.
The association added in its lawsuit before the Administrative Court regarding the warning that all documents requested by the National Center were sent in full, and the association did not receive any objections or comments from the National Center for the Development of the Non-Profit Sector. Additionally, the Board of Directors of the association requested to meet with the officials at the center, but approval was not granted without clarification of the reasons. The association indicated that it only learned of the dismissal decision by chance through its representative visiting one of the police departments in Jazan.
Exploiting Ramadan
The association considered that with the Anti-Corruption Authority preserving the case related to the alleged violations, the grounds for dismissal and its cause were nullified. Regarding the urgency of the lawsuit, the association stated that it is represented in the pressing necessity to grant powers to exploit the Ramadan season in attracting donations from donor entities by representing the association, which relies on distributing donations during the month of Ramadan, a season that the association operates throughout the year. If this is not initiated, the association will face severe distress, and lawsuits filed against the association by others - private hospitals and clinics - will commence to recover overdue payments, along with the implications for disbursing the dues of the association's employees and managing the health affairs of beneficiaries from the association - being a health association - which is the purpose for which it was established. The total number of registered beneficiaries from the association awaiting health and treatment services is 1,402, while the number of patients currently unable to receive services due to the association's work stoppage is 250 beneficiaries.
Loss of Employment Rights
The association pointed out that it received letters of financial claims from several private hospitals and medical companies requesting authorization for disbursing the dues owed to the association in various amounts. If these dues are not paid, it would tarnish the association's reputation, negatively impacting the provision of services to beneficiaries, leading to fines, penalties, and lawsuits, which will be paid from donor funds. In the continued closure, the association's credibility before beneficiaries and supporters is harmed, in addition to the loss of employment rights for board members and the executive team due to the association's disruption and job allowances such as excellence and scientific research allowances, which cannot be compensated if the decision is not halted. The association concluded by requesting the suspension of the execution of the two decisions issued by the defendants and the resumption of its financial claims halted at the National Center for the Development of the Non-Profit Sector and the Support Fund for Associations, which include requests for (headquarters support) and other raised requests and disbursing urgent dues due to the suspension and dismissal amounting to 19 million riyals, and disbursing an amount of 6 million riyals to the chairman of the association's board.
