In a major organizational leap to restructure the real estate market and protect citizens' ownership, the General Authority for Real Estate, in agreement with the Ministry of Justice, has adopted substantial amendments to the executive regulations of the Land Registration System, aiming to put a decisive end to the crises of overlapping deeds and the discrepancies between actual areas and official documents.
The explicit amendments have resolved the issue of "purely clerical and material errors" with a flexible mechanism that allows the authority or the interested party to correct the data without affecting the absolute validity of the property, in addition to organizing the procedures for initial land registration and documenting real estate transactions throughout the examination period to ensure the rights of new buyers and protect ownership during the transition.
The regulations introduced an organizational surprise by establishing precise criteria for the acceptable "tolerable error" percentages in lengths and areas for surveying, setting an error rate not exceeding 1% to 2% in the approved plans (with a maximum of 100 square meters), compared to 5% for unplanned areas and 7% for those outside the urban boundary, with the requirement of the owner's approval in case of any deficiency to proceed with the registration.
The amendments did not overlook the crises of "duplicate deeds" and cases of judicial restrictions, as the system stipulates an immediate halt to registration procedures by a reasoned decision from the real estate registrar when ownership deeds conflict until a judicial resolution is reached, while allowing for the annotation of lawsuits in the register to prevent any manipulation and ensure full protection for market participants.
