صنف المركز الوطني لإدارة النفايات المخالفات والعقوبات بناءً على حجم المنشأة ونشاطها ضمن مشروع تحديث للجدول للحد من التحديات ذات الصلة بالمخالفات والغرامات التي تفرض على المنشآت التجارية.
ويتولى المركز إيقاع غرامة لا تزيد على 100 ألف ريال، فيما تتولى لجنة النظر في المخالفات إيقاع واحدة أو أكثر من العقوبات التالية: الغرامات التي لا تزيد على 10 ملايين ريال، وتعليق الرخصة أو التصريح لمدة لا تتجاوز 6 أشهر على أن لا يكون تعليق الرخصة أو التصريح خلال مدة الاعتراض أو التظلم، إلا إذا كان سبب التعليق يرتبط بحالات الغش أو التحايل أو التأثير في الصحة العامة أو البيئة أو ارتكاب مخالفة جسيمة، وإلغاء الرخصة أو التصريح على أن لا يكون إلغاء الرخصة أو التصريح خلال مدة الاعتراض أو التظلم، إلا إذا كان سبب الإلغاء يرتبط بحالات الغش أو التحايل أو التأثير في الصحة العامة أو البيئة أو ارتكاب مخالفة جسيمة.
ومنح المشروع الوزير اعتماد قرارات لجنة النظر في المخالفات الصادرة بالغرامة التي تتجاوز 5 ملايين ريال، أو بإلغاء الرخصة أو التصريح، فيما تضاعف الغرامات المحددة على المخالف في حال التكرار، ويكون التكرار في حال العودة إلى ارتكاب المخالفة خلال 3 سنوات من تاريخ تحصن القرار بمضي المدة المحددة نظاماً، أو اكتساب الحكم الصادر في شأنه القطعية.
وللجان النظر في المخالفات فرض غرامة عن كل يوم يستمر فيه المخالف في مخالفته بما لا يزيد على 10% من مبلغ الغرامة على أن يبدأ احتساب الغرامة من التاريخ الذي يحدده القرار، ويتم تحديد العقوبة المناسبة للمخالفة بناء على تقييم مستوى تصنيف المخاطر للمخالفة والتأثيرات البيئية والاقتصادية والاجتماعية المباشرة وغير المباشرة الناتجة عن المخالفة. ويتمّ استخدام جدول تقييم مستوى تصنيف المخاطر لتحديد العقوبة والغرامة المالية مع مراعاة معايير عدة في تقييم مستوى تصنيف المخاطر لتحديد العقوبة والغرامة مثل المخالفة الإدارية وحجم الضرر على الصحة العامة والمرافق والمنشآت الى جانب عوامل التشديد مثل تعمّد المخالفة أو تكرارها وعوامل التخفيف: مثل تعاون المخالف أو الإفصاح أو الإجراءات العلاجية والتصحيحية المتبعة.
وطرح المشروع مستوى تصنيف المخاطر المناسب وهي منخفض جداً للمخالفات غير الجسيمة تتراوح قيمة الغرامة بين 100 ريال إلى 1000 ريال، ومنخفض للمخالفات غير الجسيمة، وتتراوح قيمة الغرامة بين 1000 ريال إلى 10 آلاف ريال، ومتوسط للمخالفات غير الجسيمة، وتتراوح قيمة الغرامة بين 10 آلاف ريال إلى 100 ألف ريال، ومرتفع للمخالفات الجسيمة، وتتراوح قيمة الغرامة بين 100 ألف ريال إلى مليون ريال، ومرتفع جداً للمخالفات الجسيمة، وتتراوح قيمة الغرامة بين مليون ريال إلى 10 ملايين ريال.
وشدد المشروع على تصنيف المخالفات والعقوبات بناءً على حجم المنشأة، ونشاطها الاقتصادي، والمنطقة، وبناء على حجم المنشأة.
The National Center for Waste Management classified violations and penalties based on the size of the facility and its activity as part of a project to update the table to mitigate challenges related to violations and fines imposed on commercial establishments.
The center imposes a fine not exceeding 100,000 riyals, while the committee reviewing violations imposes one or more of the following penalties: fines not exceeding 10 million riyals, suspension of the license or permit for a period not exceeding 6 months, provided that the suspension of the license or permit does not occur during the objection or appeal period, unless the reason for the suspension is related to cases of fraud, deception, or impact on public health or the environment, or the commission of a serious violation, and cancellation of the license or permit, provided that the cancellation of the license or permit does not occur during the objection or appeal period, unless the reason for the cancellation is related to cases of fraud, deception, or impact on public health or the environment, or the commission of a serious violation.
The project granted the minister the authority to approve the decisions of the committee reviewing violations issued with fines exceeding 5 million riyals, or for the cancellation of the license or permit, while the fines imposed on the violator are doubled in case of recurrence, where recurrence is defined as returning to commit the violation within 3 years from the date the decision becomes final after the specified period has elapsed, or the judgment issued regarding it has become final.
The committees reviewing violations may impose a fine for each day the violator continues their violation, not exceeding 10% of the fine amount, starting from the date specified by the decision, and the appropriate penalty for the violation is determined based on the assessment of the risk classification level of the violation and the direct and indirect environmental, economic, and social impacts resulting from the violation. The risk classification level assessment table is used to determine the penalty and financial fine, taking into account several criteria in assessing the risk classification level to determine the penalty and fine, such as the administrative violation and the extent of harm to public health and facilities, alongside aggravating factors such as intentional violation or recurrence, and mitigating factors such as the violator's cooperation, disclosure, or the corrective and remedial measures taken.
The project proposed an appropriate risk classification level: very low for non-serious violations with fines ranging from 100 riyals to 1,000 riyals, low for non-serious violations with fines ranging from 1,000 riyals to 10,000 riyals, medium for non-serious violations with fines ranging from 10,000 riyals to 100,000 riyals, high for serious violations with fines ranging from 100,000 riyals to 1 million riyals, and very high for serious violations with fines ranging from 1 million riyals to 10 million riyals.
The project emphasized the classification of violations and penalties based on the size of the facility, its economic activity, and the region, based on the size of the facility.
