كشفت جمعية المؤلفين والملحنين المصرية، برئاسة المؤلف مدحت العدل، عن اتخاذها الإجراءات القانونية ضد المطرب الشعبي محمود الليثي، بتهمة انتهاك حقوق وتشويه التراث الغنائي، باستخدامه لحن أغنية «يا مسهرني»، للموسيقار الراحل سيد مكاوي، دون الحصول على تصريح رسمي من أصحاب الحقوق الفنية.
وتقدم المستشار القانوني للجمعية ببلاغ رسمي إلى النائب العام، يتهم فيه المطرب بالتعدي على حقوق الموسيقار سيد مكاوي والشاعر الكبير أحمد رامي، من خلال استخدامه أغنية «يا مسهرني» في أغنيته الجديدة «ماتعيش فيها دور المظبوط»، من دون الحصول على تصريح رسمي من أصحاب الحقوق، ما اعتبرته الجمعية تشويهاً لمحتوى فني راقٍ وتحويلاً له إلى نص يفتقر للقيم الجمالية.
وأكدت الجمعية أن ما قام به محمود الليثي يعد تعدياً واضحاً على حقوق الملكية الفكرية لأحد أهم الأعمال الخالدة في التراث الغنائي المصري والعربي، حيث تعود الأغنية الأصلية للموسيقار الراحل سيد مكاوي، وكلمات الشاعر الكبير أحمد رامي.
وشددت الجمعية في ختام البيان الرسمي أنها لن تتهاون في اتخاذ جميع الإجراءات القانونية للحفاظ على حقوق أعضائها وصون التراث الموسيقي المصري، داعية الفنانين والمنتجين كافة إلى احترام حقوق الملكية الفكرية، ومراعاة قيمة الأعمال الفنية الكلاسيكية التي تمثل جزءاً من الهوية الثقافية لمصر والعالم العربي.
The Egyptian Authors and Composers Association, chaired by author Medhat El Adl, has announced that it is taking legal action against the popular singer Mahmoud El Leithy, on charges of violating rights and distorting musical heritage, by using the melody of the song "Ya Masahrani," by the late musician Sid Makawy, without obtaining official permission from the rights holders.
The legal advisor of the association submitted an official complaint to the public prosecutor, accusing the singer of infringing on the rights of musician Sid Makawy and the great poet Ahmed Rami, by using the song "Ya Masahrani" in his new song "Mat'eesh Fiha Dor El Mazboot," without obtaining official permission from the rights holders, which the association considered a distortion of a refined artistic content and a transformation into a text that lacks aesthetic values.
The association confirmed that what Mahmoud El Leithy did constitutes a clear violation of the intellectual property rights of one of the most important immortal works in Egyptian and Arab musical heritage, as the original song belongs to the late musician Sid Makawy, with lyrics by the great poet Ahmed Rami.
The association emphasized at the end of the official statement that it will not hesitate to take all legal actions to protect the rights of its members and preserve Egyptian musical heritage, calling on all artists and producers to respect intellectual property rights and to consider the value of classical artistic works that represent a part of the cultural identity of Egypt and the Arab world.
