أقامت الفنانة اللبنانية هيفاء وهبي دعوى قضائية أمام مجلس الدولة ضد نقابة الموسيقيين في مصر اعتراضاً على قرار النقابة الصادر في 16 مارس الماضي بمنعها من الغناء في مصر، بناءً على شكوى تقدّم بها مدير أعمالها السابق خالد التهامي.
وطالب محامي الفنانة اللبنانية الدكتور هاني سامح، بإلغاء قرار منع هيفاء من الغناء في مصر، وعزل النقيب مصطفى كامل من منصبه، وتشكيل لجنة من وزارة الثقافة لإدارة النقابة.
وأشار في طلبه إلى أن قرارات النقيب تعكس ممارسات تعسفية تنتهك حرية الإبداع الفني وتعرقل السياحة الثقافية، مستنداً إلى المادتين 65 و67 من الدستور المصري، وأحكام المحكمة الدستورية العليا التي قضت بعدم دستورية بعض مواد قانون النقابة التي تفرض عقوبات سالبة للحرية على الفنانين غير المنضمين إلى النقابة.
وقد قرّرت الدائرة الثالثة في مفوضية مجلس الدولة تأجيل النظر في الدعوى إلى جلسة 25 (مايو) الجاري.
The Lebanese artist Haifa Wehbe filed a lawsuit before the State Council against the Musicians' Syndicate in Egypt in protest against the syndicate's decision issued on March 16 to prevent her from singing in Egypt, based on a complaint submitted by her former manager Khaled El-Tahamy.
The artist's lawyer, Dr. Hani Samah, demanded the cancellation of the decision to ban Haifa from singing in Egypt, the removal of the syndicate's head, Mustafa Kamel, from his position, and the formation of a committee from the Ministry of Culture to manage the syndicate.
In his request, he pointed out that the head's decisions reflect arbitrary practices that violate artistic freedom and hinder cultural tourism, citing Articles 65 and 67 of the Egyptian Constitution, as well as rulings from the Supreme Constitutional Court that declared some provisions of the syndicate law unconstitutional, which impose penalties that deprive artists not affiliated with the syndicate of their freedom.
The third circuit of the State Council's Commission decided to postpone the hearing of the case to the session on May 25.
