The world today is witnessing a rapid surge in artificial intelligence applications that have affected various sectors and professions, and the legal system is not immune to this swift transformation. With the emergence of generative language models and real-time data analysis, a serious question has arisen in legal and academic circles: Are we facing a technology poised to take the rug out from under lawyers, or are we looking at an enabling tool that reshapes the profession and develops its tools?
A Revolution in Efficiency and Speed
It cannot be denied that artificial intelligence has brought about a qualitative leap in the "material and analytical tasks" of lawyering. Modern algorithms are now capable of examining thousands of judicial records and summarizing approved contracts in mere seconds; tasks that previously took legal assistants and lawyers many days.
This incredible speed not only saves time and effort but also directly contributes to enhancing the quality of consultations, reducing the margin of human error in research, and enabling law firms to focus on the most important legal strategies instead of getting bogged down in routine tasks.
The Spirit of the Law and the Sense of Judicial Logic
Despite the astonishment at the capabilities of machines, viewing reality from a judicial and academic perspective reveals a deep gap that artificial intelligence cannot bridge; namely, the "spirit of the law" and "the mental and human trial."
Lawyering is not merely a process of retrieving regulatory texts or drafting ready-made templates; it is fundamentally a science and an art that relies on understanding complex human contexts, deriving legal and regulatory intents, and constructing balanced legal arguments. A single case can completely change its characteristics based on real circumstances, an assessment of the parties' intentions, or an evaluation of interest and justice; these matters require a judicial sense and human logic that algorithms cannot comprehend, as they operate according to programmed and probabilistic logic, not according to moral and value-based understanding.
Additionally, there is a subtle gap technically known as "algorithmic hallucination"; where some models of artificial intelligence sometimes produce misleading legal outputs, such as citing regulatory articles with inaccurate data and numbers, or linking texts with meanings that do not correspond to the reality of the applicable system. This technical flaw confirms that while technology may provide speed in research, it does not guarantee sound reasoning, making human legal scrutiny an essential and unavoidable condition to ensure the protection of rights and prevent deception.
Moreover, professional and ethical responsibility stands as a barrier to delegating legal decisions to machines; the confidentiality between the lawyer and their client, adherence to advocacy ethics, and accountability for professional errors are all legal principles that necessitate the presence of a human element responsible before the law and society.
From "Competition" to "Integration"
The notion of completely replacing lawyers with artificial intelligence is a misguided proposition; the reality indicates that the competition is not between "the lawyer" and "artificial intelligence," but rather between "the lawyer who uses artificial intelligence" and "the lawyer who refuses to keep up with development."
We are moving towards a phase of intelligent integration, where artificial intelligence serves as a highly powerful research and technical assistant, while the lawyer remains the strategic leader who interprets the facts, formulates the logic of defense, and addresses the court's conscience.
