في خلاف قضائي جديد يكشف حيل بعض الأزواج للالتفاف على قرارات التمكين القانونية لمسكن الزوجية، أصدرت محكمة شرق الإسكندرية الابتدائية حكماً يقضي بصورية عقد إيجار مبرم بين زوج ووالدته، والذي استُخدم خصيصاً لإخراج زوجته وأولاده الخمسة من مسكن الحضانة.
تعود تفاصيل النزاع إلى نشوب خلافات أسرية بين الزوج وزوجته، انتهت بحصول الأخيرة على قرار قضائي بالتمكين من مسكن الزوجية بالمشاركة. ولمواجهة هذا القرار، اتفق الزوج مع والدته (الحماة) على إبرام عقد إيجار صوري مؤرخ في 14 أكتوبر 2021، يتظاهر فيه الزوج بأنه "مستأجر" للشقة بينما هو مالكها الأصلي بموجب عقد بيع ابتدائي يعود لعام 2016، وتتظاهر والدته بأنها المالكة المؤجرة.
وبناءً على هذا العقد المصطنع، أقامت والدة الزوج دعوى قضائية للمطالبة بطرد ابنها وزوجته وأطفالهما لعدم سداد مبلغ الإيجار، وتحصلت بالفعل على حكم بالطرد لتتشرد الزوجة وصغارها الخمسة من مسكن الحضانة.
لم تسلم الزوجة بالقرار، وقدمت مستندات دامغة تثبت ملكية الزوج الأصلية للعقار ومساهمة الزوجة من أموالها الخاصة وحصيلة بيع ذهبها في شراء الشقة. وأمام طلب إحالة الدعوى للتحقيق، استجابت المحكمة، حيث أحضرت والدة الزوج شاهداً "مريباً"، إلا أن الدفاع نجح في تفنيد شهادته ونسفها تماماً، لدرجة أن المحكمة صرحت صراحة في حيثيات حكمها بأنها "لا تطمئن لشهادته".
واستندت المحكمة في حكمها إلى المادتين 244 و245 من القانون المدني والمقرر في قضاء النقض بشأن "الصورية المطلقة والنسبية"، مؤكدة أن التصرف الظاهر الكاذب الذي يهدف إلى الإضرار بالغير وإخفاء الحقيقة لا يمكن أن يعتد به القانون في مواجهة الحقوق المشروعة. وعليه، قضت المحكمة بصورية عقد الإيجار المبرم بين الزوج ووالدته صورية مطلقة واعتباره كأن لم يكن، لتعود الحقوق لأصحابها وتنتصر العدالة للزوجة وأطفالها.

In a new judicial dispute revealing the tricks some husbands use to circumvent legal empowerment decisions regarding the marital home, the East Alexandria Primary Court issued a ruling declaring the lease contract concluded between a husband and his mother to be fictitious, which was specifically used to evict his wife and their five children from the custody residence.
The details of the dispute date back to family disagreements between the husband and his wife, which ended with the latter obtaining a judicial decision granting her joint access to the marital home. To counter this decision, the husband agreed with his mother (the mother-in-law) to create a fictitious lease contract dated October 14, 2021, in which the husband pretended to be the "tenant" of the apartment while he is its original owner under a preliminary sale contract dating back to 2016, and his mother pretended to be the renting owner.
Based on this fabricated contract, the husband’s mother filed a lawsuit demanding the eviction of her son, his wife, and their children for non-payment of rent, and she indeed obtained an eviction ruling, leaving the wife and her five young children homeless from the custody residence.
The wife did not accept the ruling and presented compelling documents proving the husband’s original ownership of the property and the wife’s contribution from her own funds and the proceeds from selling her gold to purchase the apartment. In response to the request to refer the case for investigation, the court complied, bringing in a "suspicious" witness for the husband’s mother; however, the defense succeeded in dismantling his testimony completely, to the extent that the court explicitly stated in the reasoning of its ruling that it "does not trust his testimony."
The court based its ruling on Articles 244 and 245 of the Civil Code and established in the Court of Cassation regarding "absolute and relative fictitiousness," affirming that a false apparent act aimed at harming others and concealing the truth cannot be legally recognized against legitimate rights. Consequently, the court ruled the lease contract concluded between the husband and his mother as absolutely fictitious and considered it as if it never existed, restoring rights to their rightful owners and delivering justice for the wife and her children.
