تعود الفنانة المصرية ميار الببلاوي إلى واجهة الجدل القضائي، بعدما طالبت بتعويض مالي ضخم قدره 5.7 مليون جنيه من الداعية الإسلامي محمد أبوبكر، على خلفية قضية السب والقذف التي شغلت الرأي العام وأروقة المحاكم خلال الأشهر الماضية.
وتنظر المحكمة المختصة، اليوم (الأحد)، أولى جلسات دعوى التعويض التي تقدمت بها الببلاوي، مستندة إلى حكم نهائي وبات صادر من محكمة النقض، قضى برفض الطعن المقدم من دفاع الداعية محمد أبوبكر، وتثبيت إدانته في القضية.
وأوضحت مصادر قانونية أن لجوء ميار الببلاوي إلى دعوى التعويض جاء بعد إسدال الستار على المسار الجنائي للقضية، إذ أصبح الحكم الصادر ضد الداعية محمد أبوبكر نهائياً، ما يمنحها (قانونياً) الحق في المطالبة بتعويض مدني عن الأضرار الأدبية والنفسية التي لحقت بها.
ودفع محامو الفنانة في صحيفة الدعوى بأن موكلتهم تعرضت لتشهير علني واسع، تسبب في أضرار جسيمة على المستوى الشخصي والأسري، فضلاً عن الإساءة لسمعتها الفنية والاجتماعية.
وتعود تفاصيل القضية إلى تبادل اتهامات حادة بين الطرفين عبر مواقع التواصل الاجتماعي، إذ ثبت (وفق حيثيات الحكم) قيام الداعية المصري محمد أبوبكر بنشر مقطع مصور على صفحته الشخصية تضمّن عبارات سب وقذف بحق ميار الببلاوي، شملت اتهامات تمس الشرف والعرض، وهو ما اعتبرته المحكمة إساءة علنية مكتملة الأركان.
وفي المقابل، أقرت المحكمة بأن ميار الببلاوي بدورها وجهت عبارات سب وقذف للداعية محمد أبوبكر عبر حساباتها، ما دفع المحكمة في وقت سابق لإدانة الطرفين، مع توقيع غرامات مالية وتعويض مبدئي قدره 50 ألف جنيه لكل طرف.
وكانت محكمة جنح الاقتصادية قد أصدرت في وقت سابق حكماً بحبس الداعية محمد أبوبكر شهرين، قبل أن تلغي محكمة المستأنف حكم الحبس، وتُبقي على الغرامة المالية، فيما غرّمت الفنانة ميار الببلاوي 20 ألف جنيه.
إلا أن حكم محكمة النقض الأخير حسم الجدل، وثبّت الإدانة، فاتحاً الباب أمام المعركة الأثقل حول التعويض المدني بالملايين.
ويرى مراقبون أن جلسة اليوم قد تكون بداية فصل جديد من النزاع، لا سيما مع الرقم الكبير المطلوب كتعويض، الذي يعكس (بحسب مقربين من الملف) حجم الضرر الذي ترى الفنانة أنها تعرضت له.
وبينما يترقب الوسطان الفني والدعوي ما ستسفر عنه جلسات التعويض، تبقى القضية نموذجاً صارخاً لتصاعد النزاعات الشخصية عبر مواقع التواصل الاجتماعي، وتحولها إلى معارك قضائية ثقيلة الكلفة.
The Egyptian artist Maiar Al-Beblawy returns to the forefront of legal controversy, after demanding a huge financial compensation of 5.7 million pounds from the Islamic preacher Mohamed Aboubakr, in connection with the defamation case that has occupied public opinion and courtrooms over the past months.
The competent court is considering today (Sunday) the first session of the compensation lawsuit filed by Al-Beblawy, based on a final ruling issued by the Court of Cassation, which rejected the appeal submitted by the defense of preacher Mohamed Aboubakr, confirming his conviction in the case.
Legal sources explained that Maiar Al-Beblawy's resort to the compensation lawsuit came after the criminal proceedings of the case were concluded, as the ruling issued against preacher Mohamed Aboubakr became final, granting her (legally) the right to claim civil compensation for the moral and psychological damages she suffered.
The artist's lawyers argued in the lawsuit that their client was subjected to widespread public defamation, which caused severe personal and familial harm, in addition to harming her artistic and social reputation.
The details of the case date back to a sharp exchange of accusations between the two parties via social media, as it was established (according to the ruling's reasoning) that the Egyptian preacher Mohamed Aboubakr published a video clip on his personal page that included defamatory statements against Maiar Al-Beblawy, including accusations that touch on honor and dignity, which the court considered a complete public offense.
In turn, the court acknowledged that Maiar Al-Beblawy also directed defamatory statements at preacher Mohamed Aboubakr through her accounts, which previously led the court to convict both parties, imposing financial fines and an initial compensation of 50,000 pounds for each party.
The Economic Misdemeanor Court had previously issued a ruling sentencing preacher Mohamed Aboubakr to two months in prison, before the Appeals Court overturned the prison sentence while maintaining the financial fine, whereas artist Maiar Al-Beblawy was fined 20,000 pounds.
However, the recent ruling of the Court of Cassation settled the controversy and confirmed the conviction, opening the door to a heavier battle over civil compensation in the millions.
Observers believe that today's session could mark the beginning of a new chapter in the dispute, especially with the large amount demanded as compensation, which reflects (according to those close to the case) the extent of the damage the artist believes she has suffered.
While the artistic and religious communities await the outcome of the compensation sessions, the case remains a striking example of the escalation of personal disputes via social media, transforming them into costly legal battles.
