اعتمدت الهيئة العامة للنقل آلية وضوابط جديدة تنظم استمرار مقدمي الخدمة الأفراد المصرح لهم سابقاً بالعمل في نشاط النقل بسيارة الأجرة العامة وأجرة المطار.
وأكدت أن ممارسة النشاط دون بطاقة سائق مهني أو باستخدام بطاقة مُلغاة تُعدُّ من المخالفات الجسيمة، التي تستوجب غرامة 2,800 ريال للمرة الأولى مع إيقاف المركبة لمدة شهرين، وتُضاعف الغرامة عند التكرار لتصل إلى أربعة أضعاف مع إيقاف المركبة ثلاثة أشهر.
وأن تكون السيارة حديثة، ولم يسبق تسجيلها داخل المملكة عند إدخالها في النشاط، وألا يتجاوز عمرها التشغيلي خمس سنوات من سنة الصنع، مع اشتراط أن تكون مسجلة كـ(أجرة) وفق نظام المرور، وأن تتمتع برخصة سير سارية المفعول.
وشددت الهيئة على أن المفتشين يتولون فرض العقوبات الميدانية التي تشمل الإنذار والغرامات المالية التي لا تتجاوز 10 آلاف ريال، إضافة إلى عقوبة حجز المركبات، بينما تختص لجنة النظر في التظلمات ومخالفات نظام النقل البري على الطرق بإيقاع العقوبات الأشد، مثل الغرامات التي تتجاوز 10 آلاف ريال، وتعليق التراخيص كلياً أو جزئياً لمدة تصل إلى عام، وكذلك إيقاف السائق أو المركبة أو كليهما للمدة ذاتها.
ووفق الضوابط يتم تطبيق مبدأ الإنذار فقط على المخالفات غير الجسيمة قبل إيقاع العقوبة، مع منح المخالف مهلة لتصحيح وضعه، فيما لا يسري المبدأ ذاته عند تكرار ارتكاب المخالفة. كما أوجبت التدرج في فرض العقوبات.
وشددت على إمكانية فرض غرامة يومية عن كل يوم يستمر فيه المخالف في مخالفته بعد صدور القرار النهائي، على ألا يتجاوز مجموع الغرامات 10% من الحد الأعلى للعقوبة المالية المحددة، وتُحتسب الغرامة من التاريخ الذي تحدده اللجنة في القرار.
وتضمنت الضوابط عقوبات غير مالية تشمل إبعاد غير السعودي المخالف عن المملكة، ونشر ملخص العقوبة على نفقة المخالف في صحيفة محلية أو وسيلة أخرى مناسبة بعد اكتساب القرار الصفة القطعية، إلى جانب إلزام المخالف بإزالة المخالفة، أو حجب التطبيقات والمواقع الإلكترونية التابعة للمنشآت المخالفة، أو إغلاق المحل المخالف في حال ممارسة النشاط دون ترخيص ساري المفعول.
وفي الحالات المتكررة، يمكن للجنة المختصة طلب مصادرة المركبة قضائياً في حال تكرار المخالفة للمرة الخامسة أو أكثر.
وشددت الضوابط على أن مقدم الخدمة ملزم بالحصول على بطاقة تشغيل للسيارة تُعد بمثابة الترخيص الرسمي لممارسة النشاط، وتصدر لمدة عام واحد فقط، مع إمكانية إحلال أو استبدال السيارة لمرة واحدة خلال فترة سريان البطاقة، شريطة استيفاء جميع الاشتراطات النظامية.
وأكدت الهيئة على السائق الحصول على بطاقة سائق مهني، على أن تتوفر لديه بطاقة تشغيل سارية، ورخصة قيادة أجرة عامة، وسجل جنائي خالٍ من السوابق، إضافة إلى شهادة كفاءة مهنية معتمدة.
رفض الراكب ربط الحزام
أقرت الضوابط حق السائق في الامتناع عن تقديم الخدمة في حالات محددة؛ منها تجاوز عدد الركاب الطاقة الاستيعابية للسيارة، أو رفض ربط أحزمة الأمان، أو التدخين داخل السيارة، أو العبث بالتجهيزات الداخلية، أو صدور سلوك عدواني أو غير سوي من الركاب.
في حال العمل ببطاقة منتهية، تُفرض غرامة 2,200 ريال للمرة الأولى مع الإيقاف ذاته، كما تُعد ممارسة النشاط دون بطاقة تشغيل أو باستخدام بطاقة ملغاة أو منتهية مخالفة كبرى تستوجب غرامة 2,800 ريال وحجز المركبة 40 يوماً، ترتفع إلى 60 يوماً عند التكرار.
وتبدأ الغرامات على المخالفات البسيطة من 50 ريالاً فقط، وتشمل التأخر في تجديد البطاقات التشغيلية أو المهنية، وعدم الارتباط بالأنظمة الإلكترونية، وعدم مراجعة الهيئة بعد الاستدعاء، أو عدم تزويدها ببيانات التواصل والعنوان الوطني، إضافة إلى إهمال نظافة المركبة أو عدم تسليم المفقودات للجهات الأمنية خلال المدة المحددة.
وتُفرض غرامة 100 ريال على مخالفات مثل عدم إخضاع المركبة للفحص الفني عند الطلب، أو إجراء تعديلات غير معتمدة، أو إهمال الصيانة العامة، أو التدخين داخل السيارة، أو تحميل الركاب من الأرصفة المخصصة للمشاة، أو عدم توفير أدوات السلامة الأساسية.
وشملت المخالفات الأعلى تجاوزات مثل عدم تشغيل عداد الأجرة أو العبث به، أو عدم كتابة عبارة «الرحلة مجانية» عند تعطله، أو الجمع بين أكثر من طلب داخل المدينة، وتُعاقب بغرامة 400 ريال مع إيقاف المركبة ثلاثة أشهر.
ومن تلك المخالفات التنازل عن بطاقة التشغيل لشخص آخر، أو ممارسة النشاط خارج النطاق المحدد، أو عدم تحصيل الأجرة وفق السياسة المعتمدة، أو الامتناع عن تقديم الخدمة دون مبرر نظامي، يُعد من المخالفات الأعلى ضمن الفئة المتوسطة، وتستوجب غرامة قدرها 1,600 ريال، إضافة إلى إمكانية إيقاف المركبة
The Public Transport Authority has adopted a new mechanism and regulations to organize the continuation of service providers who were previously authorized to work in the activity of public taxi transportation and airport taxi services.
It confirmed that practicing the activity without a professional driver card or using a canceled card is considered a serious violation, which incurs a fine of 2,800 riyals for the first offense, along with a two-month suspension of the vehicle, and the fine is doubled upon repetition to reach four times, along with a three-month suspension of the vehicle.
The vehicle must be modern, not previously registered within the Kingdom when entering the activity, and its operational age must not exceed five years from the year of manufacture, with the requirement that it be registered as a (taxi) according to traffic regulations, and it must have a valid operating license.
The authority emphasized that inspectors are responsible for imposing field penalties that include warnings and financial fines not exceeding 10,000 riyals, in addition to the penalty of vehicle impoundment, while the committee responsible for reviewing grievances and violations of the land transport system is authorized to impose harsher penalties, such as fines exceeding 10,000 riyals, and suspending licenses completely or partially for up to a year, as well as suspending the driver or the vehicle or both for the same duration.
According to the regulations, the principle of warning is applied only to minor violations before imposing a penalty, granting the violator a grace period to correct their situation, while this principle does not apply in the case of repeated violations. It also requires a gradual imposition of penalties.
It emphasized the possibility of imposing a daily fine for each day the violator continues their violation after the final decision is issued, provided that the total fines do not exceed 10% of the maximum limit of the specified financial penalty, and the fine is calculated from the date determined by the committee in the decision.
The regulations included non-financial penalties such as deporting the violating non-Saudi from the Kingdom, publishing a summary of the penalty at the violator's expense in a local newspaper or another appropriate medium after the decision becomes final, in addition to obligating the violator to remove the violation, or blocking the applications and websites of the violating establishments, or closing the violating establishment in case of operating without a valid license.
In repeated cases, the competent committee may request the judicial confiscation of the vehicle in case of repeated violations for the fifth time or more.
The regulations emphasized that the service provider is obligated to obtain an operating card for the vehicle, which serves as the official license to practice the activity, issued for only one year, with the possibility of replacing or substituting the vehicle once during the validity period of the card, provided that all regulatory requirements are met.
The authority confirmed that the driver must obtain a professional driver card, provided that they have a valid operating card, a public taxi driving license, a criminal record free of previous offenses, in addition to an accredited professional competency certificate.
Refusal of the Passenger to Buckle Up
The regulations acknowledged the driver's right to refuse to provide service in specific cases, including exceeding the number of passengers beyond the vehicle's capacity, refusal to buckle seat belts, smoking inside the vehicle, tampering with internal equipment, or exhibiting aggressive or inappropriate behavior by passengers.
In case of working with an expired card, a fine of 2,200 riyals is imposed for the first time along with the same suspension, and practicing the activity without an operating card or using a canceled or expired card is considered a major violation that incurs a fine of 2,800 riyals and impoundment of the vehicle for 40 days, which increases to 60 days upon repetition.
Fines for minor violations start from only 50 riyals, including delays in renewing operational or professional cards, not being connected to electronic systems, failing to review the authority after being summoned, or not providing them with contact information and the national address, in addition to neglecting the cleanliness of the vehicle or failing to hand over lost items to security authorities within the specified time.
A fine of 100 riyals is imposed for violations such as not subjecting the vehicle to a technical inspection upon request, making unauthorized modifications, neglecting general maintenance, smoking inside the vehicle, picking up passengers from pedestrian sidewalks, or not providing basic safety tools.
Higher violations include offenses such as not operating the fare meter or tampering with it, not writing the phrase "the trip is free" when it malfunctions, or combining more than one request within the city, and are penalized with a fine of 400 riyals along with a three-month suspension of the vehicle.
Among these violations are transferring the operating card to another person, practicing the activity outside the specified scope, not collecting fares according to the approved policy, or refusing to provide service without a regulatory justification, which is considered one of the higher violations within the medium category, incurring a fine of 1,600 riyals, in addition to the possibility of suspending the vehicle.
