The publication or circulation of official documents through social media platforms is no longer merely an individual act or a fleeting practice; this behavior can turn into a regulatory violation that leads to severe legal and administrative consequences and stringent penalties if it includes information not intended for publication, personal data, or details related to government operations and security procedures.
With the rapid spread of digital information and the difficulty of controlling its circulation after publication, the importance of adhering to the regulations and instructions governing the protection of official documents and information increases, as well as not circulating, photographing, or forwarding them without a legal justification or permission from the competent authority.
The danger of this practice lies in the fact that an official document is not just a piece of paper or an electronic file; it may contain information that is prohibited from disclosure, or data that affects individuals' rights and privacy, without the publisher realizing the risks of leaking it. This makes the preservation of such documents a responsibility that extends beyond the employee or individual who received the document, to include anyone who handles, republishes, or contributes to its spread.
What is meant by a document?
Examples of violations, depending on the nature of the document, the surrounding circumstances, and the applicable regulations, include publishing documents without permission, leaking correspondence and official letters, circulating minutes and reports that are not available to the public, or publishing images of documents that contain personal data or confidential information, in addition to forwarding leaked files in digital groups or through public accounts.
This does not mean that every document issued by a government entity is prohibited from publication; official documents and information that are publicly available differ from internal, classified, or restricted documents. The regulatory judgment is determined by the content of the document, its level of confidentiality, the publisher's authority, the purpose of publication, and the existence of permission or legal justification.
Moreover, obtaining a document by virtue of one's job or viewing it while performing work does not grant the holder the right to publish it, as accessing it may be linked to professional and regulatory obligations that require maintaining its confidentiality and not using it outside its intended purpose.
The instigator and participant are subject to punishment. Lawyer and legal consultant Majid Al-Ahmari emphasized that the system has set severe penalties for publishing and leaking confidential documents and information, according to the penalties for publishing and leaking confidential documents and information system.
He added that Article Five of the system stipulates punishing anyone who publishes or leaks confidential documents or information with imprisonment for a term not exceeding twenty years, or a fine not exceeding one million riyals, or both penalties together, without prejudice to any harsher penalty prescribed by law. The punishment also includes other forms, including obtaining confidential documents through illegal means, or leaking them without a legally authorized justification, or failing to maintain their confidentiality. He stated to "Okaz": The responsibility does not rest solely on the person who published the document for the first time; Article Six stipulates punishing anyone who participates in the crimes mentioned in the system with the same penalty if the conditions for participation are met, including agreement, instigation, or assistance with knowledge of it, and the crime occurring as a result.
The ease of publication does not mean its legality
Legal consultant lawyer Abdulaziz bin Dhabshi believes that with the spread of social media platforms and instant messaging applications, the circulation of photographed documents and electronic files has become a quick means of disseminating information to large numbers of people. However, the ease of publication does not imply its legality, clarifying to "Okaz" that resending a document that has already been circulated does not grant the publisher immunity from accountability. Depending on the incident and its elements, the provisions of other regulations may apply, including the Anti-Cyber Crime Law; Article Three stipulates penalties for certain cyber crimes, including defaming others and causing harm to them through technological means, with imprisonment for a term not exceeding one year and a fine not exceeding 500,000 riyals, or one of the two penalties. This does not mean that this penalty automatically applies to every case of publishing an official document, as it depends on the nature of the act and the applicable legal text.
Interpretation, distortion, and deception
Security expert retired Major General Hussein Al-Harithi emphasized that the damages resulting from publishing official documents without authorization are numerous, foremost among them the potential impact on national security or harming public interests if the documents contain sensitive information. Leaking certain documents may also lead to the disclosure of personal data, harm the reputation of individuals and entities, or affect ongoing investigations and legal procedures.
Other potential effects include disrupting institutional work, harming public trust in the relevant authorities, and providing information to beneficiaries in an unauthorized manner, in addition to the difficulty of containing the leak after copies and images have spread across multiple accounts. A single document can become a source of interpretation, distortion, or deception, especially if published out of context or before the completion of related procedures.
Major General Al-Harithi concluded his remarks to "Okaz" by emphasizing that leaking documents may harm individuals' rights, especially when they contain identity numbers, contact information, financial data, or personal details, which makes protecting documents part of protecting privacy and legal rights.
Protecting documents is everyone's responsibility
In the opinion of information security expert Mohammed Al-Suraihi, preventing these violations requires enhancing the culture of document preservation, ensuring their classification and level of confidentiality before circulation, and not photographing, copying, or sending them to unauthorized parties. Employees and workers in government entities should adhere to the regulations governing official communications and document preservation, and use approved channels when needing to exchange information or request permission to publish it.
He added that any document can easily be published electronically and via mobile devices, but in reality, it is very difficult to control its spread afterward.
Al-Suraihi advises through "Okaz" that if a document suspected of being confidential reaches an unauthorized person, responsible action requires refraining from republishing or circulating it, returning to the competent authority to verify its status, and reporting the leak through official channels when necessary, as preserving official documents is not merely an administrative obligation but a legal, security, and ethical responsibility, and interpretation, distortion, or deception can harm public interests or violate privacy.
