The Board of Grievances published a judicial ruling issued by the Administrative Court in Medina, which was upheld by the Administrative Court of Appeal in the region, ruling to annul a decision by the employer to deduct amounts from the salary of an employee with visual impairment for failing to prove his attendance via the fingerprint device, despite his regular attendance at work and performance of his job duties, and without consideration of his circumstances.
The facts of the case date back to the employee, who works as a central operator, requesting the annulment of the deduction decision due to the difficulty of his repeated transfers to the fingerprint device because of his visual impairment.
After reviewing the case and examining its documents, the court established that the failure to prove his attendance through the fingerprint does not imply his absence or negligence, and that his employer had previously accepted his excuse and exempted him from the fingerprint system in consideration of his health conditions. The direct supervisor also confirmed his regular attendance at work. The court concluded that the decision was flawed in its reasoning, thus ruling to annul it, and the Administrative Court of Appeal upheld the ruling.
The publication of the ruling coincides with the convening of the Seventh International Conference on Disability and Rehabilitation, under the patronage of the Custodian of the Two Holy Mosques, King Salman bin Abdulaziz Al Saud - may God protect him - and is part of the Board of Grievances' awareness efforts to introduce the judicial protection of the rights of persons with disabilities, emphasizing the importance of considering their circumstances and enabling them to perform their work and obtain their legal rights. The ruling also reflects the care that the Kingdom gives to the rights of persons with disabilities through legislative, regulatory, and service efforts aimed at facilitating their participation in various aspects of life and achieving equal opportunities.
