Two lawyers confirmed to "Okaz" that mistakenly transferring an amount of money to another beneficiary's account does not forfeit the right of the original owner to recover it, and that the regulations require payment service providers to exercise due diligence in attempting to recover the funds. They also allow the client to claim them legally if recovery cannot be achieved amicably.
Legal consultant lawyer Saad Al-Shahrani explained that the client's error in entering the beneficiary's data does not exempt the payment service provider from receiving their request and exercising due diligence to attempt to recover the funds. Al-Shahrani stated that Article 86 of the executive regulations for the payments and services system obligates the payment service provider to exercise due diligence to recover the funds from the incorrect recipient, in cooperation with the payment service provider of the recipient to the fullest extent possible. He noted that it is permissible to impose fees on the client for the recovery attempt, according to the contract concluded between the two parties. Al-Shahrani added that the third paragraph of the same article stipulates that if the payment service provider is unable to recover the funds, they must, upon a written request from the client, provide them with all available relevant information to enable them to claim their money back. He pointed out that if the bank does not respond to the client's request or fails to take the necessary actions regarding the erroneous transfer, the client has the right to escalate the complaint to the Saudi Central Bank through the designated channels.
Bank Responsibility
For her part, lawyer Abeer Daghriri clarified that mistakenly transferring an amount of money to another beneficiary's account does not mean that the transferor's right to recover it is forfeited. It is essential to distinguish between the bank's responsibility for the client's error in entering the beneficiary's data and the client's right to demand the return of the amount from the person who received it without entitlement. She explained that Article 145 of the Civil Transactions Law states that "whoever receives what is not due to them must return it," which means that the arrival of the amount in a person's account who has no entitlement relationship with the transferor does not make them the owner of it merely because it has entered their account. She added that the payment service provider does not necessarily bear the responsibility for the error made by the client, but they remain obligated to exercise due diligence to attempt to recover the funds and cooperate with the payment service provider of the beneficiary, according to Article 86 of the executive regulations for the payments and services system. She urged clients to promptly file an official complaint with the bank upon discovering the error, document the transaction, and attach the transfer details, along with a request to take recovery actions. If the complaint is not addressed or is rejected, it can be escalated to the Saudi Central Bank. She confirmed that if amicable recovery of the amount is not possible, and the beneficiary has received money to which they are not entitled, the transferor may resort to the courts to demand the return of the amount, based on the provisions of unjust enrichment and undue payment, depending on the facts of each case and the available evidence.
