Two decades ago or more, if you asked a lawyer, "What do you expect for this case?" his answer was ready: "It depends on the judge." This lawyer was not evading the question; rather, he was being honest.
Two similar cases with different rulings; because each judge interprets from his own books, the client leaves the office more confused than when he entered, and the lawyer knows that this confusion is no one's fault.
However, today, any client sitting in front of me as a lawyer and asking me the same question has a different answer, and the reason for the difference is the subject of this article.
On February 8, 2021 (26 Jumada al-Thani 1442 AH); I was reading the Crown Prince's statement about the four judicial system projects, where he clearly stated that the absence of legislation led to "divergence in rulings and a lack of clarity in the rules," and that this was painful for families (especially for women). The young leadership prince provided a diagnosis of what people experience in courts every day.
Shortly after that date; those promises began to transform into regulatory materials; the Personal Status Law (1443 AH), the Evidence Law (1443 AH), the Penal Code for Discretionary Punishments, and the Civil Transactions Law (1444 AH). This alone contains hundreds of articles that cover every transaction a person experiences in their daily life, and finally, "the Penal Code for Discretionary Punishments" (to be issued soon).
So, what is the difference between the old and the new for the average person? The difference is that today he can open the system and read the article before signing any contract, not after he loses, meaning that "everything has a solution in a regulatory article."
This does not mean that interpretation has died; rather, it remains within the framework. The judge applies a text that both parties to the case are already aware of, and the lawyer can tell his client: because Article X states this.
This reflects on something beyond the courts, which is the investor entering the Saudi market knowing what governs his contract, and the family that writes a marriage contract now knows its rights before marriage, not after a dispute. Clarity here is not an added bonus but a foundation for trust, and people have come to know that what they contract for cannot be built unless they know what to expect.
A state that writes its rules on paper is a state that respects the mind of its citizens because it tells them: this is what you have, and this is what you owe without surprises.
On National Day, I see that these four systems are an achievement that parallels roads and airports; the road transports your body, and the system protects your rights, so the phrase "it depends" that used to be the lawyer's answer is no longer relevant.
It is the story of today, which we tell our children about a homeland that wrote the rights of its people with its own hand and told them: "Read."
