The "Edward Bulling" primary school in Feltham, west London, dismissed a teaching assistant specialized in supporting students with special needs, following inappropriate behavior towards five female students. This incident ended with the court rejecting his claim against the decision to terminate his employment, after concluding that his conduct crossed professional boundaries and violated child protection rules, according to the British newspaper "Daily Mail."
The case began when a student filed a complaint with the administration of "Edward Bulling" primary school in Feltham, expressing her dissatisfaction with the assistant's behavior during a physical education class. Investigations revealed that he was chasing five girls under the age of 11 and using a crocodile-shaped puppet to tickle their waist area, in addition to making an inappropriate comment to one of the students, inspired by a cartoon song.
The employee defended his actions during the internal investigation, describing them as friendly teasing that he had practiced throughout his nearly ten years of work. However, the case, which was heard in an employment tribunal in Reading, concluded that his behavior was a clear violation of workplace rules and child protection requirements within educational institutions.
After the school's decision to terminate his employment due to what it described as gross misconduct, the assistant turned to the courts, demanding that his dismissal be considered arbitrary. However, the court rejected his claim, stating that his termination was a justified decision necessitated by the need to ensure the safety of the students, in light of the findings of the investigations regarding his behavior and touching of prohibited areas.
The court emphasized that what occurred could not be justified as a mere joke, asserting that crossing acceptable boundaries in dealing with children affects the safety of the school environment and must be taken seriously.
