Legal experts emphasized to "Okaz" that the requirement to obtain prior judicial permission to enter residences for the purpose of seizing assets ensures respect for the sanctity of the home and the privacy of its residents, and achieves a balance between fulfilling the rights of creditors and protecting the debtor and their family members. They stated that this condition does not prevent the seizure of assets located inside the residence as long as they are subject to legal seizure, but rather regulates the procedures for accessing them.
Legal advisor Saad Al-Shahrani explained to "Okaz" that the requirement for judicial permission aligns with the sanctity of homes as stipulated in Article 37 of the Basic Law of Governance, and ensures that execution procedures are subject to judicial oversight.
He indicated that the presence of assets inside the residence does not prevent their seizure if they are legally seizable, but entering the residence for this purpose cannot be done solely by the enforcement officer's decision; it requires prior permission from the court, which protects the debtor and their family members residing with them.
He added that this regulation helps reduce disputes related to the legality of execution procedures and balances the speed of fulfilling rights with the preservation of the private life of the residents of the home.
Protection of Individual Rights
For her part, lawyer Abeer Daghriri confirmed to "Okaz" that the executive regulation of the enforcement system requires obtaining prior judicial permission to enter homes when seizing assets, which protects individual rights and limits abuses during the execution of judicial rulings.
She explained that execution procedures must be conducted within the framework of legality and judicial oversight, and that the requirement for court permission ties entry into the residence to the necessity of execution and its requirements, enhancing trust in its procedures. Daghriri pointed out that the protection extends to the family members of the debtor and others who may have their belongings inside the residence, as it should not be assumed that all assets belong to the debtor; rather, ownership must be considered and verified according to legal procedures.
Daghriri emphasized that the fairness of execution is based on balancing the fulfillment of rights with respect for privacy and the preservation of the sanctity of the home, while preventing the abuse of enforcement powers.
Court Permission is Essential
Lawyer and legal advisor Abdullah Mohammed Al-Kasib clarified that Article 29 of the executive regulation of the enforcement system distinguishes between entering property in general and entering residential property when executing a seizure.
He stated to "Okaz": The text allows the person conducting the seizure to enter the property if the procedures for the seizure require it, while considering the relevant legal texts, but it requires court permission if the property is a residence, which establishes a clear regulation that preserves the sanctity of homes and ensures the discipline of execution procedures.
