اشترط نظام الأنشطة الترفيهية الصادر حديثاً، الحصول على ترخيص من الهيئة العامة للترفيه لتشغيل المدن الترفيهية ومراكز الترفيه وتنظيم الفعاليات الترفيهية والعروض الحية، وذلك بهدف تنظيم هذه الأنشطة وتطويرها ورفع جودتها وبموجب النظام، لا يجوز ممارسة أي نشاط ترفيهي أو نشاط مساند إلا بعد الحصول على ترخيص أو تصريح أو شهادة اعتماد من الهيئة، مع منح المجلس صلاحية الإعفاء من متطلب التصريح عند الحاجة.
وأكد النظام، أنه بعد موافقة مجلس الوزراء، يمكن إضافة أنشطة جديدة تُعد ضمن الأنشطة الترفيهية أو المساندة المشمولة بأحكامه، بينما لا تُعد الفعاليات والعروض الخاصة التي لا يُدعى لها العموم ضمن الأنشطة الترفيهية الخاضعة للنظام. كما اشترط الحصول على الترخيص قبل تشغيل المدن الترفيهية أو مراكز الترفيه أو إقامة الفعاليات الترفيهية أو العروض الترفيهية أو العروض الحية، إضافة إلى اشتراط الحصول على شهادة اعتماد قبل ممارسة الأنشطة المساندة.
مقابل مالي من بيع التذاكر
وشدد النظام على أن للهيئة إيقاف أي نشاط ترفيهي أو مساند كلياً أو جزئياً، بشكل دائم أو مؤقت، عند وجود خطر أو تهديد يمس سلامة أو صحة الحاضرين أو المشاركين، أو عند وجود مخالفة لأحكام النظام أو اللائحة، أو لمقتضيات المصلحة العامة. كما منح النظام المحدث الهيئة حق الحصول على مقابل مالي من بيع تذاكر الأنشطة الترفيهية بما لا يتجاوز 10% من قيمة كل تذكرة، وفق ما تحدده اللائحة.
وأكد النظام ضرورة مراعاة واحترام النظام العام والآداب العامة، وتتولى الهيئة مهمات الرقابة على الأنشطة الترفيهية والمساندة، وتلقي البلاغات، وضبط المخالفات. وتحيل الهيئة المخالفات المضبوطة إلى اللجنة المختصة، ولها منح المخالف مهلة كافية لتصحيح وضعه بناءً على إشعار يتضمن تاريخ إحالة المخالفة إلى اللجنة في حال عدم التصحيح. كما يحظر منع المفتشين من أداء مهماتهم، ويلتزم أصحاب مواقع ومرافق الأنشطة الترفيهية والعاملون فيها بالتعاون معهم وتقديم التسهيلات اللازمة.
وتضمّن النظام أن يعاقب كل من يخالف أحكامه أو أحكام اللائحة بجزاء أو أكثر، تشمل الإنذار، أو غرامة مالية لا تتجاوز مليون ريال، أو المنع من ممارسة أي نشاط ترفيهي أو مساند لمدة لا تتجاوز خمس سنوات، أو إلغاء أو تعليق الترخيص أو التصريح أو شهادة الاعتماد.
قانونية لـ «عكاظ»: 180 يوماً كافية
أكدت المحامية والمستشارة القانونية ندى العتيبي لـ«عكاظ»، أن 180 يوماً كافية ليتم تطبيق نظام تشغيل المدن الترفيهية ومراكز الترفيه وتنظيم الفعاليات الترفيهية والعروض. وأضافت أنها خطوة تنظيمية محورية في تطوير منظومة قطاع الترفيه بالمملكة، ويضع الأنشطة الترفيهية تحت مظلة الترخيص وتطويرها ورفع جودتها، بما يسهم في تعزيز نمو القطاع واستدامته، ورفع جاذبيته الاستثمارية، وتحسين جودة الخدمات المقدمة للمستفيدين.
وشددت القانونية العتيبي، على أن النظام وضع إطاراً تنظيمياً متكاملاً لممارسة الأنشطة الترفيهية عبر تنظيم إجراءات التراخيص، وتحديد المعايير والاشتراطات والضوابط اللازمة لممارسة تلك الأنشطة، وأعمال الرقابة والتفتيش وضبط المخالفات التي عاقبت كل من يخالف أحكام النظام أو اللائحة بجزاء أو أكثر من الإنذار أو غرامة مالية لا تتجاوز (مليون) ريال، المنع من ممارسة أي نشاط ترفيهي أو نشاط مساند لمدة لا تتجاوز (خمس) سنوات، أو إلغاء أو تعليق الترخيص أو التصريح أو شهادة الاعتماد.
The recently issued Recreational Activities System stipulates that a license must be obtained from the General Entertainment Authority to operate amusement parks and entertainment centers, as well as to organize recreational events and live shows. This is aimed at organizing, developing, and improving the quality of these activities. According to the system, no recreational activity or supporting activity may be practiced without obtaining a license, permit, or accreditation certificate from the authority, with the council granted the authority to exempt from the permit requirement when necessary.
The system confirmed that, after the approval of the Council of Ministers, new activities can be added that are considered part of the recreational or supporting activities covered by its provisions, while private events and shows that are not open to the public are not considered recreational activities subject to the system. It also requires obtaining a license before operating amusement parks or entertainment centers or holding recreational events or entertainment shows or live performances, in addition to requiring an accreditation certificate before practicing supporting activities.
Financial compensation from ticket sales
The system emphasized that the authority has the right to suspend any recreational or supporting activity, either fully or partially, permanently or temporarily, when there is a danger or threat to the safety or health of attendees or participants, or when there is a violation of the provisions of the system or the regulations, or for the public interest. The updated system grants the authority the right to receive financial compensation from the sale of tickets for recreational activities not exceeding 10% of the value of each ticket, as determined by the regulations.
The system stressed the necessity of respecting public order and public morals, and the authority is responsible for monitoring recreational and supporting activities, receiving reports, and controlling violations. The authority refers detected violations to the competent committee and may grant the violator a sufficient period to rectify their situation based on a notice that includes the date of referral of the violation to the committee in case of non-correction. Inspectors are prohibited from being prevented from performing their duties, and owners of recreational activity sites and facilities, as well as their workers, are required to cooperate with them and provide the necessary facilities.
The system included that anyone who violates its provisions or the provisions of the regulations shall be punished with one or more penalties, including a warning, or a financial fine not exceeding one million riyals, or prohibition from practicing any recreational or supporting activity for a period not exceeding five years, or cancellation or suspension of the license, permit, or accreditation certificate.
Legal opinion for "Okaz": 180 days is sufficient
Lawyer and legal consultant Nada Al-Otaibi confirmed to "Okaz" that 180 days is sufficient for the implementation of the system for operating amusement parks and entertainment centers and organizing recreational events and shows. She added that this is a pivotal organizational step in developing the entertainment sector in the Kingdom, placing recreational activities under the umbrella of licensing, developing them, and improving their quality, which contributes to enhancing the growth and sustainability of the sector, increasing its investment attractiveness, and improving the quality of services provided to beneficiaries.
Legal consultant Al-Otaibi emphasized that the system has established a comprehensive regulatory framework for practicing recreational activities by organizing licensing procedures, defining the necessary standards, requirements, and controls for practicing those activities, as well as monitoring and inspection work and controlling violations that punish anyone who violates the provisions of the system or the regulations with one or more penalties, including a warning or a financial fine not exceeding (one million) riyals, prohibition from practicing any recreational or supporting activity for a period not exceeding (five) years, or cancellation or suspension of the license, permit, or accreditation certificate.
