تعتزم وزارة السياحة إقرار قواعد وجدول مخالفات وعقوبات مرافق الضيافة السياحية في مدينتي مكة المكرمة والمدينة المنورة، وتتضمن القواعد إلغاء الترخيص و50 ألف ريال غرامة عند التعاقد لتقديم الخدمة عبر عقود غير موثقة من الوزارة.
ونص المشروع على أن النطاق الزمني لتطبيق جدول المخالفات والعقوبات هو موسم الحج الذي يبدأ سنوياً في غرة ذي القعدة، وينتهي في منتصف محرم، ما لم يصدر خلاف ذلك.
وقسم المشروع مستويات الأنشطة إلى 5 فئات، إضافة إلى حجم المنشأة ما بين متناهية الصغر والنسبة المقررة للعقوبة المالية 25%، فيما المنشآت الصغيرة ونسبتها 50% من العقوبة، والمتوسطة وحدد النسبة من قيمة العقوبة المالية 75%، والمنشآت الكبيرة بلغت نسبتها 100%.
ومن المخالفات التي تضمنها المشروع عدم توفير وحدة بديلة للسائح في مكان قريب ومساوية لنوع المرفق ودرجة تصنيفه أو أعلى، أو إعادة المبالغ المالية المدفوعة له عن الليلة التي انقطعت فيها الخدمة كالكهرباء أو الماء، للمدة المتبقية من الحجز لمدة تتجاوز ساعتين، وعقوبتها 20 ألف ريال للفئة الأولى و15 ألف ريال للفئة الثانية و10 آلاف ريال لبقية الفئات.
ومن المخالفات التي تضمنها الجدول عدم التحقق من أصل إثبات الهوية، بحيث يكون التحقق منها من خلال الاطلاع على أصلها وتسجيل بياناتها فقط دون أخذ صوره منها، وعقوبة الفئة الأولى 10 آلاف ريال، وللفئة الثانية غرامة 8 آلاف، وللفئة الثالثة 6 آلاف و4 آلاف للفئة الرابعة، و2000 للفئة الخامسة.
ومن المخالفات عدم الإبلاغ الفوري للجهات المعنية عن أي حادث يتعلق بالأمن والسلامة في مرفق الضيافة السياحي، واعتبر المشروع ذلك من المخالفات الجسيمة وحددت غرامتها 10 آلاف ريال للفئة الأولى، و8 آلاف للفئة الثانية و6 آلاف للفئة الثالثة، وللفئة الرابعة 4 آلاف ريال وللفئة الخامسة 2000 ريال بالإضافة إلى اغلاق مؤقت او كلي حتى تصحيح المخالفة.
كما أكدت على أنه إذا كانت المخالفة التي وقعت خلال موسم الحج مكررة لمخالفة وقعت في الموسم ذاته، فيتم تطبيق العقوبة المالية الواردة في هذا الجدول مع مضاعفتها، وإذا كانت المخالفة التي وقعت بعد الموسم مكررة لمخالفة وقعت أثناء الموسم، فتتم مضاعفة الحد الأدنى للعقوبة المالية في الجدول الأساسي حسب مرات التكرار.
The Ministry of Tourism intends to establish rules and a schedule of violations and penalties for tourism hospitality facilities in the cities of Mecca and Medina. The rules include revocation of the license and a fine of 50,000 riyals when contracting to provide services through unverified contracts from the ministry.
The project stipulates that the time frame for applying the schedule of violations and penalties is the Hajj season, which begins annually on the first of Dhul-Qi'dah and ends in the middle of Muharram, unless stated otherwise.
The project categorizes activities into 5 levels, in addition to the size of the establishment ranging from micro to small, with a financial penalty rate of 25%. For small establishments, the rate is 50% of the penalty, for medium establishments it is set at 75% of the financial penalty, and for large establishments, the rate reaches 100%.
Among the violations included in the project is the failure to provide an alternative unit for the tourist in a nearby location equivalent to the type of facility and its classification level or higher, or the failure to refund the amounts paid for the night when services such as electricity or water were interrupted, for the remaining duration of the booking exceeding two hours. The penalty for this is 20,000 riyals for the first category, 15,000 riyals for the second category, and 10,000 riyals for the remaining categories.
Another violation included in the schedule is the failure to verify the original identity document, whereby verification should be done by viewing the original and recording its details only without taking a copy of it. The penalty for the first category is 10,000 riyals, for the second category is 8,000 riyals, for the third category is 6,000 riyals, for the fourth category is 4,000 riyals, and for the fifth category is 2,000 riyals.
Additionally, the violation of failing to immediately report to the relevant authorities any incident related to security and safety in the tourism hospitality facility is considered a serious violation, with a penalty of 10,000 riyals for the first category, 8,000 riyals for the second category, 6,000 riyals for the third category, 4,000 riyals for the fourth category, and 2,000 riyals for the fifth category, in addition to temporary or complete closure until the violation is corrected.
It was also emphasized that if the violation that occurred during the Hajj season is a repeat of a violation that occurred in the same season, the financial penalty stated in this schedule will be applied with a doubling effect. If the violation that occurred after the season is a repeat of a violation that occurred during the season, the minimum financial penalty in the main schedule will be doubled according to the number of repetitions.
