حذّرت النيابة العامة من خطورة الإفصاح عن البيانات الشخصية دون مسوّغ نظامي، مؤكدة أن أي تمكين غير مصرح به يفضي إلى وصول الغير إلى البيانات أو الاطلاع عليها أو استخدامها، يُعد مخالفة جسيمة تستوجب المساءلة الجزائية.
وأوضحت النيابة العامة : أن الإفصاح عن بيانات حساسة بقصد الإضرار بصاحبها أو تحقيق منفعة شخصية يدخل ضمن نطاق الجرائم المجرّمة نظامًا، لما يترتب عليه من انتهاك مباشر للخصوصية وتهديد للأمن المعلوماتي للأفراد.
ويأتي هذا التأكيد ضمن تطبيق نظام حماية البيانات الشخصية، الذي يهدف إلى ضبط آليات جمع ومعالجة وحفظ البيانات، وحماية الحقوق المرتبطة بها، مع تحميل المسؤولية لكل من يسيء استخدامها أو يتجاوز حدود الصلاحيات الممنوحة له.
وشددت النيابة العامة على ضرورة التزام الجهات والأفراد بضوابط التعامل مع البيانات، والوعي بأن الخصوصية حق مصون، وأن أي تجاوز يمس هذا الحق يعرض مرتكبه للمساءلة وفق ما تقرره الأنظمة ذات الصلة، في إطار تعزيز الثقة الرقمية وحماية المجتمع من ممارسات ضارة.
The Public Prosecution has warned of the dangers of disclosing personal data without a legal justification, emphasizing that any unauthorized access that allows others to reach, view, or use the data constitutes a serious violation that warrants criminal accountability.
The Public Prosecution clarified that disclosing sensitive data with the intent to harm its owner or achieve personal gain falls within the scope of crimes that are criminalized by law, due to the direct violation of privacy and the threat to individuals' information security that it entails.
This affirmation comes as part of the implementation of the Personal Data Protection Law, which aims to regulate the mechanisms for collecting, processing, and storing data, and to protect the rights associated with it, while holding accountable anyone who misuses it or exceeds the limits of the powers granted to them.
The Public Prosecution stressed the necessity for entities and individuals to adhere to the regulations governing data handling, and to be aware that privacy is a protected right, and that any violation of this right exposes the perpetrator to accountability according to the relevant laws, as part of enhancing digital trust and protecting society from harmful practices.
