A person may spend years in the corridors of courts, spending their money and time until they finally obtain a judicial ruling that vindicates them. But what if they discover that their opponent transferred their assets to a relative or concealed them behind seemingly legitimate transactions, then stood before the execution court claiming an inability to pay? Here begins another suffering, which may be more burdensome than the initial dispute; because the rightful owner is no longer looking for someone to prove their right, but rather for someone to return it to them. Justice is not complete when the judge pronounces the ruling, but rather when the right reaches its owner.
Perhaps this gap between the issuance of the ruling and the fulfillment of the right is what gives the imminent implementation of the new Saudi execution system its significance. On the twenty-eighth of October this year, the system will transition from the stage of acknowledgment to the stage of implementation, marking the beginning of a new phase in developing execution tools and enhancing the effectiveness of fulfilling rights. This comes as an extension of the Ministry of Justice's efforts to develop the judicial system and provide the enablers that make judicial rulings and execution orders more capable of achieving their goals, within guarantees that protect the rights of both creditors and debtors. The ruling issued in the name of justice should find its way to execution, not remain a right fixed on paper, suspended on the ability of its owner to pursue the debtor's assets.
One of the most notable aspects worth highlighting in the new system is the expansion of tools for tracking assets. When there is evidence that the debtor has concealed their assets or transferred them with the intent to obstruct execution, it has become possible to request tracking them according to specific judicial procedures, and to verify the transactions they have conducted, including assets suspected of being transferred to relatives, agents, or individuals with whom they have financial dealings. This is not a simple procedural matter; rather, it addresses one of the most damaging forms of procrastination regarding rights, when the transfer of money shifts from a legitimate act to a means of evasion.
Let’s take a real-world example: a creditor holding a large judgment, and a debtor claiming they do not have enough to pay, while evidence suggests the transfer of their assets to someone close to them or engaging in unusual financial transactions. Here, execution should not stop at the names appearing in the records, but the search should extend, according to regulatory controls, to the reality of the transactions and their purpose. Those who think that transferring their assets to a relative or friend is enough to keep them out of reach of execution must realize that changing the name of the owner does not necessarily change the reality of the transaction.
The system's tools do not stop at tracking assets; it also addresses transactions that may aim to harm creditors, allowing, in specific cases, for their annulment through judicial means. However, this does not mean that every financial transfer between relatives is suspect, nor does the mere default of the debtor make them a fraudster. There is a fundamental difference between someone who is unable to pay despite their good intentions and someone who has the ability and deliberately conceals it. This distinction is what grants the execution tools their legitimacy and prevents their use to harm the debtor.
At the same time, the system does not overlook the protection of the debtor and the essentials of their livelihood, establishing controls for seizure and exceptions for certain assets necessary for life and work. The purpose of execution is not to strip a person of everything they own, but to enable the creditor to obtain their right within the limits of the system. Justice that vindicates the creditor should not wrong the debtor, just as the protection of the debtor should not become a cover for procrastination.
The effects of this development do not stop at the doors of the courts; they extend to the markets and the business environment. A contractor executing a project, a supplier selling on credit, and an investor entering a new partnership all assess the risks of non-fulfillment before signing contracts. The clearer and more effective the execution procedures are, the more trust is enhanced in transactions, and the more accurate the risk assessment becomes. A local or foreign investor does not only inquire about the ease of establishing their company but also about their ability to recover their rights if the other party fails to meet their obligations.
From this perspective, the efforts of the Ministry of Justice in digitizing services, simplifying procedures, enhancing electronic connectivity, developing execution tools, and benefiting from licensed service providers gain additional economic value. These transformations, when integrated, contribute to reducing the time and cost borne by the rightful owner and support the goals of Saudi Vision 2030 in building a more reliable and attractive business environment for investment.
Nevertheless, the true test of any system is not just in the strength of its texts, but in the impact of its application. It will be important to see how these tools reflect on the speed of fulfilling rights, the effectiveness of tracking assets, and the ability of procedures to distinguish between the distressed debtor and the one who deliberately obstructs execution. The success of the development is measured by what the litigant experiences in reality, not by what they read in the pages of the system.
If we want to summarize the purpose of all this development, it lies in a simple truth that often gets lost amidst the details of litigation and its procedures: that a judicial ruling, no matter how strong its reasons and sound its wording, does not achieve its full purpose if its owner remains unable to fulfill their right. Hence, the true value of the new execution system lies in bridging the gap between the ruling and the right, so that the victory of the litigant is not the end of a dispute but the beginning of another suffering. This is the swift justice: that the right reaches its owner, not merely that they hold a ruling proving it belongs to them.
