بين تقييم يراه مستهلك انعكاساً لتجربته، وآخر تراه منشأة إساءة إلى سمعتها، تقف تقييمات المواقع في مساحة تتقاطع فيها حرية الرأي مع المسؤولية القانونية. وأوضح مستهلكون وملاك متاجر وقانوني لـ«عكاظ»، أنه مع تزايد تأثيرها في قرارات المستهلكين، تتجدد التساؤلات حول الضوابط التي تحكمها، والحد الفاصل بين النقد والتشهير، في ظل اعتماد واضح من المستهلكين على التقييمات قبل اتخاذ قرار زيارة مطعم أو متجر، باعتبارها مصدراً للاطلاع على تجارب الآخرين، كونها أصبحت جزءاً من السمعة الرقمية للمنشآت، لما قد تتركه من أثر في ثقة العملاء وقراراتهم.
فكرة مبدئية
وعن مدى استفادة المستهلكين، أوضح عماد العرفي لـ«عكاظ»، أنه يستفيد من تقييمات «المواقع» بشكل كبير، خصوصاً عند زيارة مطعم للمرة الأولى، إذ تساعده في تكوين فكرة مبدئية عن مستوى الخدمة وجودة الطعام. وأشار إلى أنه يحرص على التقييم إذا كانت التجربة مميزة جداً أو دون المستوى المتوقع. ويرى مروان الجهني، أن تقييمات المواقع تعد من أهم المصادر التي يستفيد منها قبل اختيار أي مطعم؛ لأنها تعكس تجارب عدد كبير من الزبائن، وتساعد في تكوين انطباع أولي عن جودة الطعام ومستوى الخدمة والنظافة. وأضاف: «أحرص على مشاركة تقييمي بعد الزيارة عندما تكون لدي تجربة تستحق الإضافة، سواء كانت إيجابية أو سلبية، بهدف الفائدة للآخرين». وأضاف: «من خلال تجاربي صادفت بعض المطاعم ذات التقييمات المنخفضة، وكانت معظم الملاحظات المذكورة في التقييمات صحيحة إلى حد كبير؛ ما جعلني أكثر اهتماماً بالاطلاع على آراء الزوار قبل اتخاذ قرار الزيارة، ولا يقتصر أثر التقييمات على المستهلكين، بل يمتد إلى أصحاب الأنشطة التجارية، الذين يرون أنها أصبحت عاملاً مؤثراً في بناء الثقة مع العملاء، وفي الوقت ذاته قد تتحول إلى مصدر ضرر عندما تستند إلى معلومات غير دقيقة أو تجارب لا تعكس الواقع».
عوامل مؤثرة
لم تتوقع شهد الجهني، مالكة متجر إلكتروني، أن تتحول تقييمات العملاء إلى أحد أبرز العوامل المؤثرة في ثقة المتسوقين بمتجرها، مؤكدة أن التقييمات تمثل جزءاً كبيراً من ثقة العميل بالمتجر؛ لأن أغلب المستهلكين يعتمدون على تقييمات وتجارب العملاء السابقين قبل اتخاذ قرار الشراء. وأضافت: «تقييم العميل يؤثر بشكل مباشر في ثقة العملاء الجدد، لذلك أصبحت التقييمات في التجارة الإلكترونية عنصراً أساسياً في بناء المصداقية وتعزيز المبيعات». ويرى خالد علي العمري، مالك محل شاي، أنه سبق أن واجه بعض التقييمات التي شعر بكونها غير عادلة أو كيدية، مثل تقييمات من أشخاص لم يجربوا الخدمة أو كتبوا تعليقاً لا يعكس الواقع.
تجارب المستخدمين
عبدالله الجهني، مالك مقهى، أفاد بأن تقييمات المواقع مفيدة جداً لأنها تعتمد على تجارب المستخدمين الحقيقية. ونوّه إلى أنه لا ينبغي الاعتماد عليها وحدها، فقد تكون بعض التقييمات قديمة أو غير دقيقة، لذلك من الأفضل قراءة التعليقات والصور مع التقييم قبل اتخاذ القرار. وأضاف: «التقييمات الخاطئة تؤثر بالفعل على المكان، لكن إن كان هناك تقييم سلبي أو اثنان فقط وسط عدد كبير من التقييمات الإيجابية، فعادةً لا يكون تأثيرهما كبيراً، خصوصاً إذا رد صاحب النشاط باحترافية وقام بحل المشكلة». كما قال: «واجهت تقييمات كيدية من قبل، بل إن بعضها لا تعكس تجربة حقيقية، لكنني أحرص على مراجعتها، والرد عليها باحترافية، والإبلاغ عن أي تقييم يخالف السياسات حتى يتم التحقق منه».
3 أركان أساسية
من جهته، بيّن المحامي عمر عبدالله مطارد، أن تقييمات المواقع لم تعد مجرد رأي عابر، بل أصبحت اليوم أداة اقتصادية مؤثرة تصنع السمعة التجارية للمنشآت أو تدمرها في لحظات. وقال: «هذا التأثير الهائل جعل النظام يتصدى لأي استغلال سيئ لهذه المنصات؛ لحماية المستثمرين من جهة، وضمان حق المستهلك في النقد المشروع. وقد تتحول هذه التقييمات من نقد مشروع إلى جريمة تشهير ومعلوماتية يعاقب عليها القانون عند توفر 3 أركان أساسية: السب والقذف: استخدام ألفاظ نابية ومسيئة تمس الأشخاص، مثل وصف أصحاب العمل أو العاملين بـ«النصابين» أو «الحرامية» بدلاً من تقييم الخدمة. الافتراء والكذب: تعمد كتابة تفاصيل مضللة ومختلقة لا أساس لها من الصحة، بهدف إسقاط السمعة التجارية للمنشأة. الحملات الوهمية: الاستعانة بحسابات متعددة ومزيفة لشن حملة تقييمات سلبية متتالية، بقصد الإضرار المتعمد بالمنشأة وتشويهها».
التزام بالضوابط
وأضاف المحامي مطارد، أن «التقييم مشروع ونقد نظامي يكفله القانون للمستهلك إذا التزم بالضوابط التالية، أولها الموضوعية وهي أن ينصب النقد على الخدمة أو السلعة ذاتها (مثل: بطء الخدمة، أو ارتفاع الأسعار مقارنة بالجودة) دون المساس بكرامة الأشخاص، ثانيها حسن النية، وهو أن يكون الهدف توعية المستهلكين وتنبيه المنشأة لتطوير أدائها، وليس التشفي أو الرغبة في التدمير التجاري، وأخيراً الواقعية، وهي أن يعبر التقييم عن تجربة حقيقية للمستهلك مع المنشأة، ويفضل دائماً أن يكون مدعماً بأدلة كالفواتير أو الصور، كما أن المشكلات القانونية تبدأ وتتحول التقييمات إلى نزاعات وقضايا في المحاكم عند حدوث الابتزاز التجاري، أي عندما يقوم العميل بتهديد المنشأة بكتابة تقييم سلبي، أو يساومها عليه للحصول على خدمات مجانية أو مبالغ مالية غير مستحقة، أو عند حدوث ضرر مادي مثبت، وهو عندما يتسبب التقييم الكاذب في خسائر مالية فادحة للمنشأة، كإلغاء عقود أو انخفاض حاد في المبيعات، ما يمنحها الحق في طلب التعويض القضائي، أو عند المنافسة غير المشروعة، وهي عندما يثبت أن التقييمات السلبية مدفوعة أو منسقة من منافسين في القطاع نفسه لتشويه المحل، ما تترتب عليه عقوبات مالية وإدارية مغلظة، وإغلاق الحسابات».

Consumers, store owners, and legal experts explained to "Okaz" that with the increasing influence of these ratings on consumer decisions, questions arise about the regulations governing them and the fine line between criticism and defamation, given the clear reliance of consumers on ratings before deciding to visit a restaurant or store, as they serve as a source for reviewing the experiences of others, having become part of the digital reputation of businesses, due to the impact they can have on customer trust and their decisions.
Initial Idea
Regarding the extent to which consumers benefit, Imad Al-Orfi explained to "Okaz" that he greatly benefits from site ratings, especially when visiting a restaurant for the first time, as they help him form an initial idea about the level of service and food quality. He noted that he is keen to rate if the experience is either exceptionally good or below expectations. Marwan Al-Juhani believes that site ratings are among the most important sources he benefits from before choosing any restaurant; they reflect the experiences of a large number of customers and help in forming a preliminary impression about food quality, service level, and cleanliness. He added, "I make sure to share my rating after the visit when I have an experience worth adding, whether positive or negative, for the benefit of others." He continued, "Through my experiences, I have encountered some restaurants with low ratings, and most of the comments mentioned in the ratings were largely accurate; this made me more interested in reviewing the opinions of visitors before making a decision to visit. The impact of ratings is not limited to consumers; it extends to business owners, who see that it has become a significant factor in building trust with customers, while at the same time it can turn into a source of harm when based on inaccurate information or experiences that do not reflect reality."
Influencing Factors
Shahd Al-Juhani, an owner of an online store, did not expect customer ratings to become one of the most influential factors in shoppers' trust in her store, emphasizing that ratings represent a large part of customer trust in the store; because most consumers rely on the ratings and experiences of previous customers before making a purchase decision. She added, "Customer ratings directly affect the trust of new customers, so ratings in e-commerce have become a fundamental element in building credibility and boosting sales." Khaled Ali Al-Amri, a tea shop owner, believes he has previously faced some ratings that he felt were unfair or malicious, such as ratings from people who did not try the service or wrote comments that do not reflect reality.
User Experiences
Abdullah Al-Juhani, a café owner, stated that site ratings are very useful because they rely on real user experiences. He pointed out that one should not rely on them alone, as some ratings may be old or inaccurate; therefore, it is better to read comments and view pictures along with the rating before making a decision. He added, "Incorrect ratings do indeed affect the place, but if there is one or two negative ratings among a large number of positive ratings, their impact is usually not significant, especially if the business owner responds professionally and resolves the issue." He also said, "I have faced malicious ratings before, some of which do not reflect a real experience, but I make sure to review them, respond to them professionally, and report any rating that violates policies so it can be verified."
3 Essential Pillars
For his part, lawyer Omar Abdullah Matar explained that site ratings are no longer just a passing opinion; they have become a significant economic tool that can build or destroy a business's reputation in moments. He said, "This immense influence has led the system to confront any misuse of these platforms; to protect investors on one hand and ensure the consumer's right to legitimate criticism. These ratings can shift from legitimate criticism to defamation and information crimes punishable by law when three essential pillars are present: slander and defamation: using offensive and abusive language that affects individuals, such as describing business owners or workers as 'frauds' or 'thieves' instead of evaluating the service. Fabrication and lying: deliberately writing misleading and fabricated details that have no basis in truth, with the aim of tarnishing the business's reputation. Fake campaigns: using multiple and fake accounts to launch a series of negative ratings aimed at deliberately harming and tarnishing the business."
Commitment to Regulations
Lawyer Matar added that "ratings are legitimate and systematic criticism guaranteed by law for consumers if they adhere to the following regulations: First, objectivity, meaning that the criticism should focus on the service or product itself (e.g., slow service, or high prices compared to quality) without affecting the dignity of individuals. Second, good faith, which means the goal should be to inform consumers and alert the business to improve its performance, not to seek revenge or a desire for commercial destruction. Finally, realism, which means that the rating should reflect a real experience of the consumer with the business, and it is always preferable to support it with evidence such as invoices or pictures. Legal problems begin, and ratings turn into disputes and cases in courts when commercial extortion occurs, meaning when a customer threatens the business with writing a negative rating, or blackmails it to obtain free services or undeserved financial amounts, or when proven material damage occurs, which is when a false rating causes significant financial losses to the business, such as contract cancellations or a sharp decline in sales, giving it the right to seek judicial compensation, or in cases of unfair competition, which is when it is proven that negative ratings are paid or coordinated by competitors in the same sector to tarnish the store, leading to severe financial and administrative penalties and account closures.
