قضت محكمة مصرية بتغريم شقيق الفنان المصري محمد فؤاد بمبلغ قدره مليون جنيه، لصالح إحدى الشركات على خلفية امتناعه عن تسليم ألبوم غنائي وفقًا للتعاقد المبرم بينه وبين أحد المنتجين، ما تسبب بأضرار مادية جسيمة للطرف المدعي.
وأوضحت المحكمة أن الالتزام الناشئ عن العقد يقتضي التنفيذ الكامل أو الجزئي، وأن أي تقصير من المدين يعد إخلالًا يوجب التعويض.
وأكدت المحكمة أن نص المادة 160 من القانون المدني ينص على أن الفسخ يترتب عليه انحلال العقد بأثر رجعي، ويعاد كل شيء إلى ما كان عليه قبل نشوء العقد. وبناءً عليه، فإن الإخلال بتنفيذ التعاقد يُلزم المدين بالتعويض.
وقضت المحكمة بإلزام المدعى عليه بدفع مبلغ مليون جنيه كتعويض عن الأضرار المادية الناتجة عن استحالة تنفيذ التعاقد.
وعلى جانب آخر، يواصل محمد فؤاد العمل على اللمسات النهائية لألبومه الجديد، الذي يمثل عودة إلى الساحة الغنائية بعد فترة طويلة من الغياب، ومن المقرر أن يُطرح الألبوم في يونيو المقبل، وتحديدًا عقب عيد الأضحى المقبل.
An Egyptian court has ruled to fine the brother of Egyptian artist Mohamed Fouad an amount of one million pounds, in favor of a company due to his failure to deliver a musical album according to the contract made between him and one of the producers, which caused significant material damages to the plaintiff.
The court clarified that the obligation arising from the contract requires full or partial execution, and that any shortcoming by the debtor constitutes a breach that necessitates compensation.
The court confirmed that the text of Article 160 of the Civil Code states that termination results in the dissolution of the contract retroactively, and everything is returned to its state before the contract was established. Accordingly, the breach of contract execution obliges the debtor to compensate.
The court ruled that the defendant must pay an amount of one million pounds as compensation for the material damages resulting from the impossibility of executing the contract.
On another note, Mohamed Fouad continues to work on the final touches of his new album, which marks his return to the musical scene after a long absence. The album is scheduled to be released in June, specifically after the upcoming Eid al-Adha.
