من اللافت، أن نظام التأمينات الاجتماعية يعتمد التاريخ الميلادي عند سن التقاعد، واحتساب المدد والصرف، لكنه يعتمد التاريخ الهجري في تحديد العمر عند احتساب سقف الراتب الأخير الخاضع للاستقطاع (٥٠ عامًا)، وهو أمر مجحف وغير عادل للمشترك، إذ يُعامل بمعيارين زمنيين مختلفين !
تحديد سن ٥٠ عامًا، الذي يقف عنده سقف احتساب أي زيادة في العقود الجديدة أو الراتب، وُضع - حسب بعض المصادر - في التأمينات للحد من حالات التلاعب والتحايل لرفع مستحقات التقاعد، لكن تطبيقه الشمولي، في الحقيقة، يعبر عن العجز عن التمييز بين المشترك الطبيعي والمشترك المتحايل، وهو أشبه بالعقاب الجماعي، فهناك حوالى ١٨ شهرًا تفصل بين بلوغ الخمسين بين التاريخين الهجري والميلادي، كما أن ١٥ سنة تفصل المشترك عن بلوغ سن التقاعد المحددة بالميلادي، و١٥ سنة كفيلة بكشف المستقر في وظيفته من المتلاعب !
برأيي، أن المشرّع عند دراسة وإصدار نظام التأمينات الجديد، غفل عن التنبه للإجحاف الذي سيعاني منه من يبلغ الخمسين، وتركه في معادلة غير عادلة بين انتقائية اعتماد التاريخين الميلادي والهجري، فما دامت الدولة ونظام التأمينات قد اعتمدا التاريخ الميلادي في كل التعاملات النظامية والمالية، فالواجب أن يُعتمد التاريخ الميلادي أيضًا في احتساب العمر عند بلوغ الخمسين، فالمشترك يبلغ سن الخمسين بالتاريخ الهجري قبل التاريخ الميلادي، لكنه في النهاية يُعامل بالتاريخ الميلادي في احتساب سن التقاعد ومدد الاشتراك وصرف المعاشات !
حسب معلوماتي، أن الأمر مرفوع إلى الجهات المختصة للتعديل، لكن لماذا غفل عنه المشرّع من الأساس؟! وما ذنب المشتركين الحاليين في تحمل هذا الخلل ما لم يتم تعديله، وإذا عُدّل، فهل سيصحح بأثر رجعي، أم سيذهب المشتركون الحاليون ضحايا هفوة لا ذنب لهم فيها ؟!
باختصار.. انتقائية استخدام التاريخ الميلادي لصالح التأمينات، والتاريخ الهجري ضد المشترك، غير عادلة وتستوجب معالجة سريعة !
It is noteworthy that the social insurance system relies on the Gregorian calendar when determining the retirement age, calculating periods, and disbursement, but it uses the Hijri calendar to determine age when calculating the ceiling for the last salary subject to deduction (50 years), which is unfair and unjust to the subscriber, as they are treated with two different temporal standards!
The determination of the age of 50 years, at which the ceiling for calculating any increases in new contracts or salaries is set, was established - according to some sources - in the insurance system to limit cases of manipulation and fraud to raise retirement entitlements. However, its comprehensive application, in reality, reflects an inability to distinguish between the regular subscriber and the fraudulent one; it is akin to collective punishment. There are about 18 months that separate reaching fifty between the Hijri and Gregorian dates, and there are also 15 years separating the subscriber from reaching the retirement age set in the Gregorian calendar, and 15 years is sufficient to reveal who is stable in their job from those who manipulate!
In my opinion, the legislator, when studying and issuing the new insurance system, overlooked the injustice that those who reach fifty will suffer from, leaving them in an unfair equation between the selective reliance on the two dates, the Gregorian and the Hijri. Since the state and the insurance system have adopted the Gregorian calendar in all regulatory and financial transactions, it is necessary to also adopt the Gregorian calendar in calculating age when reaching fifty. The subscriber reaches the age of fifty in the Hijri calendar before the Gregorian calendar, but in the end, they are treated according to the Gregorian calendar in calculating the retirement age, subscription periods, and pension disbursements!
According to my information, the matter has been raised to the relevant authorities for amendment, but why did the legislator overlook it in the first place?! What is the fault of current subscribers in bearing this flaw if it is not corrected? And if it is amended, will it be corrected retroactively, or will current subscribers become victims of an oversight for which they bear no responsibility?!
In short.. the selective use of the Gregorian calendar in favor of the insurance system, and the Hijri calendar against the subscriber, is unjust and requires swift remedy!
