وكلاء السيارات هوامير السوق، رغم الفوارق بينهم وبين أمثالهم في الدول المجاورة من حيث الأسعار وخدمات ما بعد البيع وتوفر قطع غيار سياراتهم المستوردة، والفوضى التي تعم هذا القطاع، وكلاء السيارات على علاقة ود وحب مع وزارة التجارة، فنادراً ما نسمع مخالفات تستحق الذكر من الوزارة تجاه هذه الشركات المستوردة للسيارات، وأغلب ما يتردد هو استدعاء بعض الموديلات من عرباتهم لعيوب مصنعية فيها ولا نعرف هل تم إصلاح تلك الأعطال، وهل تم تلافيها في السيارات الجديدة، قبل فترة قريبة غزت أسواقنا سيارات من الصين، وهي مستمرة في السيطرة على نسبة كبيرة في قطاع العربات عندنا، وكثير من المشترين لها كانوا يعانون من عدم توفر قطع الغيار لها، وينتظرون لفترات طويلة حتى تتوفر عن الوكيل، ويبدو أن الشركات المصنعة لتلك السيارات هي من تتحكم في قطع الغيار، وعملت وأسست محلات لقطع غيارها في مدننا، أما وكلاء السيارات أو بعضهم فآخر همهم توفير تلك القطع، مسألة الأسعار عندنا في السيارات متفاوتة بشكل قوي من حيث ارتفاع سعرها مقارنة بدول أخرى، ولا أعرف لماذا لا تتدخل وزارة التجارة في هذه المسألة المهمة، والتي أعتقد أنها لن تضر بحرية السوق لدينا، فشركات السيارات ووكلاؤها المحليون تجد بينها تفاوت بالأسعار للسيارة نفسها، وبعض الأحيان مسألة الجودة في المنتج بين ما عندنا وما يتواجد في بعض الدول الخليجية المجاورة.
قبل أسبوع تفاجأت بخبر إيجابي جداً من قبل وزارة التجارة، وعلى غير العادة ضد هوامير سوق السيارات عندنا ولم نشهد مثله منذ فترة طويلة، ولا يعني هذا أن تكون المخالفات ضد هذه الشركات فقط للمخالفة ذاتها، ولكن الهدف أن يكون هناك عدالة لجميع الوكلاء والمستهلكين من حيث العدالة بالأسعار وخدمات ما بعد البيع، خبر وزارة التجارة هذا ينص على إيقاف وكالة سيارات عن الاستيراد وتغريمها 8 ملايين ريال لعدم التزامها بحقوق المستهلك، من حيث تقديم الصيانة وقطع الغيار وضمان جودة الصنع. وأتت هذه المبالغة بعد ثبوت ارتكاب الوكالة 175 مخالفة، تمثلت في عدم توفير قطع غيار لدى الشركة وعدم التزامها بتوفير سيارات بديلة لهم خلال فترة الصيانة.
الوزارة أكدت، أنها لن تتردد بتطبيق الأنظمة على شركات السيارات ووكلائها وقد تصل إلى مرحلة التشهير، ولا أعرف لماذا لم ينص قرار الوزارة هذا على اسم الشركة ووكيلها المخالف، حتى تعم الفائدة ويكون هناك صدقية في مثل هذا التوجه الإيجابي، الذي يحمي المستهلك والذي يعتبر الأضعف في هذه الحلقة، وأعتقد أن عنصر التشهير إذا وصل الحكم إلى مرحلته النهائية سوف يكتسب مصداقية لدى الجمهور، ويمثل عامل ردع قوي لهؤلاء الوكلاء أكثر من العقوبات المالية، وعلينا نحن المتعاملين مع هذه الوكالات المدللة لعقود مضت ألا نتنازل عن حقوقنا التي تكفلها الأنظمة في المملكة، والآن من خلال قنوات التقنية أصبحت عملية الشكاوى أسهل من ذي قبل، فالثقافة في هذا الجانب مهمة حتى لا تضيع الحقوق جراء عدم المطالبة بها.
Car dealers are the big players in the market, despite the differences between them and their counterparts in neighboring countries in terms of prices, after-sales services, and the availability of spare parts for their imported cars, as well as the chaos that prevails in this sector. Car dealers have a close and friendly relationship with the Ministry of Commerce, as we rarely hear of violations worth mentioning from the ministry against these car-importing companies. Most of what is reported is the recall of certain models of their vehicles due to manufacturing defects, and we do not know if those defects have been repaired or if they have been avoided in new cars. Recently, our markets have been flooded with cars from China, which continue to dominate a significant share of the vehicle sector here, and many buyers of these cars have suffered from the unavailability of spare parts, waiting for long periods until they become available from the dealer. It seems that the manufacturers of those cars control the spare parts and have established shops for their parts in our cities, while some car dealers are least concerned about providing those parts. The issue of prices for cars here varies greatly in terms of their high cost compared to other countries, and I do not understand why the Ministry of Commerce does not intervene in this important matter, which I believe would not harm market freedom in our country. Local car companies and their dealers show significant price discrepancies for the same car, and sometimes there is a difference in product quality between what we have and what is available in some neighboring Gulf countries.
Last week, I was surprised by a very positive news from the Ministry of Commerce, which, contrary to the norm, acted against the big players in the car market here, something we haven't seen in a long time. This does not mean that the violations against these companies are only for the sake of the violation itself, but the goal is to ensure fairness for all dealers and consumers in terms of fair prices and after-sales services. This news from the Ministry of Commerce states that a car dealership has been banned from importing and fined 8 million riyals for failing to comply with consumer rights regarding maintenance, spare parts, and quality assurance. This penalty came after the agency was found to have committed 175 violations, which included failing to provide spare parts and not adhering to providing alternative vehicles during the maintenance period.
The ministry confirmed that it will not hesitate to apply regulations to car companies and their dealers, which could reach the stage of public shaming. I do not know why this ministry decision did not specify the name of the company and its violating dealer, so that the benefit could be widespread and there would be credibility in such a positive approach that protects the consumer, who is considered the weakest link in this chain. I believe that if the element of public shaming reaches its final judgment, it will gain credibility among the public and serve as a strong deterrent for these dealers more than financial penalties. We, as consumers dealing with these pampered agencies for years, must not give up our rights guaranteed by the regulations in the Kingdom. Now, through technological channels, the process of filing complaints has become easier than before, and the culture in this regard is important so that rights are not lost due to a lack of demand for them.
