لا تكاد تخلو جلسة في المحاكم العمالية من الاستناد إلى عدد محدود من مواد نظام العمل، رغم أن النظام يضم عشرات النصوص التي تنظّم العلاقة بين العامل وصاحب العمل. وقد أثبتت الممارسة القضائية أن بعض المواد أصبحت تشكّل العمود الفقري لأغلب المنازعات العمالية، لما يترتب عليها من آثار مباشرة في إنهاء عقود العمل، والتعويض، ومكافأة نهاية الخدمة، والأجور، وغيرها من الحقوق الأساسية. ومن هنا برزت أهمية الإلمام بهذه النصوص، ليس بالنسبة إلى رجال القانون فحسب، وإنما لكل صاحب عمل، ومدير موارد بشرية، وعامل، لما لها من أثر مباشر في استقرار العلاقة التعاقدية والحد من النزاعات.
ويأتي في مقدمة هذه النصوص المادة الثامنة من نظام العمل، التي قررت مبدأً قانونيًا بالغ الأهمية يتمثّل في بطلان كل شرط يخالف أحكام النظام أو ينتقص من الحقوق التي قررها للعامل، ولو تضمنه عقد العمل أو وافق عليه العامل صراحة. وقد أسهم هذا النص في ترسيخ قاعدة مفادها أن الحقوق التي كفلها المنظم لا يجوز الالتفاف عليها باتفاقات خاصة، الأمر الذي جعل هذه المادة من أكثر النصوص استنادًا إليها في القضاء العمالي.
وتبرز كذلك المادة الخامسة والخمسون المتعلقة بعقود العمل محددة المدة وتجديدها، إذ تنشأ حولها منازعات عديدة بسبب اختلاف الطرفين في تكييف العقد، وما إذا كان قد ظل محدد المدة أو تحول إلى عقد غير محدد المدة وفقًا لأحكام النظام. ويترتب على هذا التكييف آثار قانونية ومالية مؤثرة، لا سيما عند إنهاء العلاقة التعاقدية وما يترتب عليها من حقوق والتزامات.
وعند انتهاء العلاقة العمالية، تبدأ أكثر المواد حضورًا في ساحات القضاء. فالمادة الرابعة والسبعون تحدد الحالات النظامية لانتهاء عقد العمل، وغالبًا ما يكون السؤال الأول أمام المحكمة: هل انتهت العلاقة العمالية بسبب مشروع نص عليه النظام، أم أن الإنهاء وقع بالمخالفة لأحكامه؟ والإجابة عن هذا السؤال تقود إلى تحديد بقية الحقوق والالتزامات بين الطرفين.
وترتبط بذلك المادة الخامسة والسبعون التي تنظم إنهاء العقد غير محدد المدة بالإرادة المنفردة، وتوجب مراعاة مدة الإشعار النظامية. وقد أصبحت المطالبة بالتعويض عن عدم الالتزام بالإشعار من أكثر الطلبات شيوعًا أمام المحاكم العمالية، لما يترتب على الإنهاء المفاجئ من آثار مالية ومهنية على الطرف الآخر.
وتظل المادة السابعة والسبعون من أشهر مواد نظام العمل وأكثرها تداولًا، لما تتعلق به من التعويض عن إنهاء عقد العمل على نحو مخالف لأحكام النظام. وقد أثارت هذه المادة منذ صدورها العديد من التطبيقات والاجتهادات القضائية، وأسهمت في رسم معالم التوازن بين حق صاحب العمل في إنهاء العلاقة التعاقدية، وحق العامل في الحماية من الإنهاء غير المشروع.
وفي المقابل، جاءت المادة الثمانون لتحدد الحالات الاستثنائية التي يجوز فيها لصاحب العمل فصل العامل دون مكافأة أو إشعار أو تعويض، كالاعتداء، أو التزوير، أو الإخلال الجسيم بالواجبات الوظيفية، وغيرها من الحالات التي حددها النظام على سبيل الحصر. ولما كان تطبيق هذه المادة يرتب آثارًا بالغة على العامل، فقد استقر القضاء على ضرورة التحقق من توافر شروطها بدقة، وعدم التوسع في تفسيرها.
ويقابلها المادة الحادية والثمانون التي تمثل ضمانة مهمة للعامل، إذ تجيز له ترك العمل مع احتفاظه بكامل حقوقه إذا أخل صاحب العمل بالتزاماته النظامية، أو ارتكب أفعالًا تجعل استمرار العلاقة العمالية غير ممكن، أو تنطوي على ضرر جسيم يلحق بالعامل.
أما الحقوق المالية، فتأتي في مقدمتها المواد المنظمة لمكافأة نهاية الخدمة، ولا سيما المواد من (84) إلى (87)، التي تحتل مكانة متقدمة في المنازعات العمالية، إذ نادرًا ما تخلو دعوى من خلاف حول استحقاق المكافأة، أو كيفية احتسابها، أو أثر سبب انتهاء العقد عليها.
كما تحظى المواد المتعلقة بالأجور بأهمية كبيرة، وفي مقدمتها المادة التسعون التي أوجبت على صاحب العمل دفع أجور العامل في مواعيدها المحددة، وهي من النصوص التي تتكرر الإشارة إليها في المنازعات المتعلقة بتأخر صرف الرواتب أو الامتناع عن سدادها. ولا تقل عنها أهمية المواد المنظمة لساعات العمل، والعمل الإضافي، والإجازات السنوية والمرضية، باعتبارها تمس الحياة الوظيفية اليومية، ولذلك تتكرر المنازعات بشأنها بصورة مستمرة أمام القضاء.
ومن خلال متابعة الأحكام الصادرة عن المحاكم العمالية، يتبين أن الخلاف لا ينشأ - في كثير من الأحيان - بسبب غموض النصوص النظامية، وإنما نتيجة اختلاف الأطراف في إثبات الوقائع أو في التكييف القانوني لها. ولذلك أصبحت جودة صياغة عقد العمل، والالتزام بالإجراءات النظامية، وتوثيق القرارات والمراسلات، من أهم وسائل الوقاية من النزاعات قبل نشوئها.
وقد شهد القضاء العمالي خلال السنوات الأخيرة تطورًا ملحوظًا في استقرار المبادئ القضائية، مدعومًا بالتحول الرقمي، وتطوير إجراءات التقاضي، وارتفاع مستوى التخصص في المحاكم العمالية. وأسهم ذلك في تعزيز قابلية التنبؤ بالأحكام، ورفع مستوى الأمن القانوني في سوق العمل، بما يحقق قدرًا أكبر من العدالة والاستقرار في العلاقات العمالية.
وفي نهاية المطاف، فإن كثرة تداول هذه المواد أمام المحاكم لا تعني أنها الأكثر أهمية في نظام العمل، وإنما تعكس طبيعة النزاعات الأكثر شيوعًا في بيئة العمل. وكلما ازداد وعي أطراف العلاقة العمالية بهذه النصوص، وجرى تطبيقها بصورة صحيحة، انخفضت المنازعات، وارتفع مستوى الاستقرار الوظيفي، وتعززت الثقة في سوق العمل، بما ينسجم مع مستهدفات رؤية المملكة 2030 في بناء سوق عمل جاذب، ومستقر، وعادل.
It is rare for a session in labor courts to be devoid of reference to a limited number of provisions of the Labor Law, despite the fact that the law includes dozens of texts that regulate the relationship between the worker and the employer. Judicial practice has proven that some provisions have become the backbone of most labor disputes, due to the direct consequences they entail in terminating employment contracts, compensation, end-of-service benefits, wages, and other fundamental rights. Hence, the importance of being familiar with these texts has emerged, not only for legal professionals but also for every employer, human resources manager, and worker, due to their direct impact on the stability of the contractual relationship and the reduction of disputes.
At the forefront of these texts is Article Eight of the Labor Law, which establishes a highly important legal principle that invalidates any condition that contradicts the provisions of the law or diminishes the rights granted to the worker, even if it is included in the employment contract or explicitly agreed upon by the worker. This provision has contributed to establishing a rule that the rights guaranteed by the legislator cannot be circumvented by private agreements, making this article one of the most frequently cited in labor court rulings.
Article Fifty-Five, which pertains to fixed-term employment contracts and their renewal, also stands out, as numerous disputes arise around it due to the differing interpretations of the contract by the two parties, and whether it remained fixed-term or transformed into an indefinite contract according to the provisions of the law. This interpretation results in significant legal and financial consequences, especially when terminating the contractual relationship and the associated rights and obligations.
Upon the termination of the employment relationship, the most frequently cited provisions in court come into play. Article Seventy-Four specifies the legal grounds for the termination of an employment contract, and often the first question before the court is: Did the employment relationship end for a legitimate reason stipulated by the law, or was the termination in violation of its provisions? The answer to this question leads to determining the remaining rights and obligations between the parties.
This is related to Article Seventy-Five, which regulates the termination of an indefinite contract by unilateral will and requires adherence to the statutory notice period. The demand for compensation for failure to comply with the notice has become one of the most common requests before labor courts, due to the financial and professional repercussions that sudden termination has on the other party.
Article Seventy-Seven remains one of the most well-known and frequently cited provisions of the Labor Law, as it relates to compensation for the termination of an employment contract in violation of the law's provisions. Since its issuance, this article has sparked numerous applications and judicial interpretations, contributing to delineating the balance between the employer's right to terminate the contractual relationship and the worker's right to protection from unlawful termination.
Conversely, Article Eighty specifies the exceptional cases in which an employer may dismiss a worker without compensation, notice, or indemnity, such as assault, forgery, or serious breaches of job duties, among other cases specified by the law exhaustively. Given that the application of this article has significant implications for the worker, the judiciary has established the necessity of verifying the precise fulfillment of its conditions and refraining from broad interpretations.
In contrast, Article Eighty-One represents an important guarantee for the worker, as it allows them to leave work while retaining all their rights if the employer breaches their statutory obligations or commits acts that make the continuation of the employment relationship impossible or involve serious harm to the worker.
As for financial rights, the provisions regulating end-of-service benefits come first, particularly Articles (84) to (87), which hold a prominent position in labor disputes, as it is rare for a lawsuit to be free of disagreements regarding entitlement to the benefit, how it is calculated, or the effect of the reason for the contract's termination on it.
The provisions related to wages also hold great importance, particularly Article Ninety, which obligates the employer to pay the worker's wages on their due dates. This is one of the texts that is frequently referenced in disputes related to delayed salary payments or refusal to pay them. The provisions regulating working hours, overtime, and annual and sick leave are equally important, as they affect daily work life, and thus disputes regarding them arise continuously before the courts.
By following the rulings issued by labor courts, it becomes clear that disputes do not often arise due to the ambiguity of the statutory texts, but rather as a result of differing interpretations of the facts or their legal characterization by the parties. Therefore, the quality of drafting the employment contract, adherence to statutory procedures, and documenting decisions and correspondence have become some of the most important means of preventing disputes before they arise.
In recent years, labor courts have witnessed a notable development in the stability of judicial principles, supported by digital transformation, the development of litigation procedures, and an increase in specialization within labor courts. This has contributed to enhancing the predictability of rulings and raising the level of legal security in the labor market, achieving greater justice and stability in labor relations.
Ultimately, the frequent reference to these provisions in courts does not mean they are the most important in the Labor Law, but rather reflects the nature of the most common disputes in the work environment. The more aware the parties to the employment relationship are of these texts, and the more correctly they are applied, the fewer disputes will arise, the higher the level of job stability will be, and the more trust will be strengthened in the labor market, in line with the objectives of Saudi Vision 2030 in building an attractive, stable, and fair labor market.
